Justice Scalia is full of it. Everybody know that the United States Constitution is a living document that needs to be interpreted to achieve a policy result that’s best for the American people.

If you hear any nincompoop, like my friend Jackson, say that the US Constitution should be interpreted in the same way that state constitutions are interpreted, you’ll know that you’re talking to an addlepated moron. Jackson says that whenever there’s a state constitutional dispute the judges look to the intent of the framers when making a decision. He says that the SCOTUS should act the same way. SCOTUS should look to the state ratifying conventions and those who wrote the US Constitution for interpretation. Sounds like Scalia’s wrongheaded reasoning, doesn’t it?

Jackson and Scalia forget that the state courts are just minor functionaries who, like traffic court judges, have to follow the rules. The Supreme Court of the United States, on the other hand is a national policy making body, like the US Congress or the President. The Congress and the President aren’t bound by anything except their perception of what’s best for the country, their friends, and themselves. It should be that way too for the SCOTUS. You can see that, can’t you?

That false notion, and frankly rather ridiculous claim, is directly contradicted not only by the Constitution itself, but by the founding fathers who wrote it. Article III. The fact that the courts are now legislating from the bench and effecting policy changes and getting away with it, doesn’t mean it is Constitutional. The same kind of twisted logic has been used for decades with regard to powers of the President to use “executive orders” to essentially write and rewrite the law, thus usurping the power of the legislative branch. One of the reasons this country has gone to hell in a hand basket is the result of a complete break down of the checks and balances between the 3 branches of our government. This is all basic high school civics. It would seem that this subject is no longer being taught in public schools. In fact, these days far more time and effort is spent studying the Holocaust than our own system of government. Which I think goes a long way toward explaining how it is that young people aren’t screaming bloody murder about the corruption of the Constitution and the ongoing evisceration of their civil rights.

The purpose of the Court is to enforce the will of the people as declared by the Constitution and legislation pursuant to it, not to enforce the Court’s will and political agenda on the people.

I agree with Justice Scalia’s “The Constitution is…” quote, but that’s not what I want to write about.

Cibolo Creek Ranch is a high end resort owned by convicted Iran Contra felon John Poindexter (convictions later overturned – see the Wikipedia article on Poindexter.) Poindexter worked for defense contractors and in the Reagan and Geo. Bush administrations. Dick Cheney and Donald Rumsfeld helped advance Poindexter’s career.

Scalia’s El Presidente Suite at the Cibolo Creek Ranch goes for $700+ per night. A WaPo news article said that Scalia flew to the ranch by chartered aircraft. The purpose of Scalia’s trip was a hunting vacation. Scalia was such an avid hunter that a lawyer hunting companion of his said, ““He’ll do anything if you take him hunting.”

My questions are, 1) who paid for Scalia’s extravagant vacation, 2) why was he vacationing with political figures like Poindexter (and maybe others), 3) isn’t there an appearance of impropriety about his hunting trip, and 4) should Justice Scalia have known better?

In my state I believe this would be a no-no for a judge and might get him reprimanded or worse.

But, of course, Scalia didn’t live in my state nor were our rules ones that applied to him.
Scalia lived in the Crony Capital of the world where people and politicians get their exercise boosting up their friends, sending gifts and good deals their way, and covering them up from public scrutiny. And it all happens so regularly that no one seems to notice anymore or care.

In order to place a judge who will negate the 2nd amendment not caring what it says. Republicans are pussies. The democracts are not and are playing to win the great socialist victory for the people. The constitution is a legal document. It is settled .The founding fathers would be horrified to know their legal guidelines were open to subjective interpretations. That’s exactly what they wanted to avoid. The constitution tells the government what it can and can not do the US as citizens.

Irak ,figures you would say the constitution is a living organism .How come you Jews never say Israel’s constitution is open for debate.? You know why.Their constitution protects Israel. It always the American constitution , American laws and Christianity that’s open for your subjective interpretations or more of your worthless opinions.

The constitution is a list of rules to follow not to be subjected to the whims of how another person determines what they really were trying to say. It is either that or the words of the document never had meaning and neither do yours. It is how I believe you were thinking when said what you said. Not what you said.

As for Dick Cheney’s friend, it was Justice Scalia you should be concerned about, not John M. Poindexter. As the LA Times reports today, ” In 2004, (Scalia) went duck hunting with then-Vice President Dick Cheney — flying with him on a plane that served as Air Force 2 — while the high court was considering a case that challenged the secrecy of an energy task force led by Cheney. This socializing with litigants wasn’t unusual for Scalia. In 2001, he went on a pheasant hunting trip with the dean of a Kansas law school who was the lead attorney in two cases that were about to come before the Supreme Court.

As for implying that Justice Scalia got free trips. You’re right. He reported 28 trips, most of which were provided or reimbursed by the taxpayers. SCOTUS reports for 2014 (the latest reporting year for which information is available) show that all the justices got free trips. However, Scalia’s were in the US, unlike six of he other justices who were comped European jaunts.

Constitution has been dead for a long time, Justice Scalia to the contrary. He was a great constitutionalist but none of this makes any difference now. PTB have bought and paid for the courts long ago. Maybe America never was what we thought.

I try and live my life as if the Constitution was in full effect. I realize that sometimes the things I choose to do may run afoul of the establishment restrictions on essential liberty, but I don’t pay attention to that, I pay attention to conscience and I try and instill that in my children. I don’t think that there is much more that any individual can do in these times.

When I was in the service we were taught about our general orders and the Hague and Geneva conventions and our obligations under these laws and governing principles- and one thing stood out to me then as being of deep significance. You were under no obligation to obey an order that was not lawful. “How do we know if it’s unlawful?” everyone wanted to know. “Follow your conscience,” we were told. I dwelt on that a great deal for a young man, I no longer remember why it was so important to me at that time, but it was. I understood when I was doing something I shouldn’t and felt either guilty or shameful for it and as I got older I tried to avoid those behaviors and acts, selfishly in part, because I didn’t want to feel shame or remorse. It became a habit, over time, to reflect on the outcomes before I acted. I wasn’t always successful, but I improved at it and became better disciplined and after I became a parent that kind of discipline became even more important because there were eyes watching me, constantly looking to me for direction in how to behave. It’s a double edged sword, in a way, because I think a great deal of our deliberate faults are based on not wanting to appear foolish, weak, ignorant or incapable to those we respect and love and so we choose instead to be deceitful or imperious. The problem is that you pass that behavior on, so you must rely again on the direction of your conscience. I’d much rather my children think of me as being unable to do something than a fake who claims he can.

Our overlords, the elites who have taken over our systems and institutions have done the opposite. They pretend they care about us when it’s clear that they care only about themselves, they bloviate about their knowledge and understanding while wallowing in their ignorance, they talk of peace and give us perpetual conflict, they hold up ideals of bipartisanship and working together while ceaselessly sowing discord and enmity. These examples leak out and infect the body politic and so you have a seething, angry, hostile population that emulates it’s political establishment and passes that sickness on to their posterity.

They use the Constitution as justification for their sinfulness and decadence by distorting it’s meaning, they alter it where it is unyielding and impossible to contest until it no longer holds it’s original value and purpose.

A false doctrine holds no power over those who understand the truth and they are under no obligation to obey it.

Since the Steinbeck comparison has been made I have gone back and read a great deal more of his work than I have in the past and have found quite a few profound things in there, so I leave you with this-
