Do you suppose cows have any idea what’s coming as they’re marched down the chute? Or do they stare with bovine indifference at the tail and hind quarters in front of them, until they’re suddenly – and very briefly – startled by the man with the nail gun?
Perhaps Americans will – likewise too late – ask themselves What Happened in the very near future. Perhaps just after the midnight knock comes and they are taken away into the night.

It is not an exaggeration.

America is now on the cusp of becoming a state that does exactly such things; things exactly like the things done by 20th century horror shows such as NS Germany or Stalin’s USSR. Literally. Not “this is where it might lead” or “the tendency is similar.” Exactly, literally, the same thing. The only difference is that it awaits being done on a mass scale. But the power to do it openly – brazenly – has been asserted.

And is about to be sanctified by law.

The National Defense Authorization Act will make it official. It will confer upon the executive branch and the military (increasingly, the same things) the permanent authority to snatch and grab any person, U.S. citizens included, whom it decrees to be a “terrorist” – as defined or not by the executive or the military – and imprison them, indefinitely, without formal charge, presentation of evidence or judicial proceeding of any kind. These “detainees” will have neither civilian rights in the civil court system, nor – crucially – even the minimal rights to due process and decent treatment conferred upon prisoners of war. (And we are allegedly “at war,” are we not?)

The language of the bill specifically includes American citizens “caught” within the borders of the United States – aka, the “battlefield.” It is claimed by sponsors that only those awful them – you know, theenemies of freedom The Chimp and his successors like to reference as they systematically gut our freedoms – need worry. But read the actual document, and be afraid. The wording is such that any shyster lawyer for the government will be able to draw up a memorandum at some point in the near future equating, say, criticism of the federal government’s policies in the Middle East with “substantially supporting” the enemies of the United States. As defined by the United States.

That is, as defined by the government.
At its whim. At the personal discretion of whomever happens to be the Maximum Leader, or even one of the ML’s duly appointed minions.

As the always excellent Matt Taibbi of Rolling Stone recently observed, what happens when some nutjob who attended a few Tea Party meetings tries to bomb a federal building? Will the Tea Party itself – and anyone who “substantially supports” it be thus transformed into an “enemy combatant”? How about the OWS protestors? How about this web site – and this author – which have on several occasions called bullshit on the federal government’s usurpations and follies? How hard will it be, really, to describe such actions – such thoughtsexpressed in an article or an interview – as “substantially supporting” whatever the government decides amounts to “terrorism” or the threat thereof against itself?

Surely, the door is now wide open for such an interpretation by some John Woo or Dick Cheney waiting in the wings. Prospective jefe Newtie is practically turgid at the prospect of getting his hands on such power. And there is no longer (or soon won’t be) any legal means available to contest a one-way trip to Treblinka in Topeka – or wherever it is they will send you.

Taibbi writes:

“The really galling thing is that this act specifically envisions American citizens falling under the authority of the bill. One of its supporters, the dependably-unlikeable Lindsey Graham of South Carolina, bragged that the law ‘basically says … for the first time that the homeland is part of the battlefield’ and that people can be jailed without trial, be they ‘American citizen or not.’ New Hampshire Republican Kelly Ayotte reiterated that ‘America is part of the battlefield.’ ”

Graham further stated:

“It is not unfair to make an American citizen account for the fact that they decided to help Al Qaeda to kill us all and hold them as long as it takes to find intelligence about what may be coming next. And when they say, ‘I want my lawyer,’ you tell them, ‘Shut up. You don’t get a lawyer.’ ”

The key thing being, it is entirely up to the government to decide what constitutes “helping” al Qaeda. It can be nothing more than a vague assertion. Indeed, no evidence of any kind whatsoever is necessary to “hold them as ling as it takes” in order to “find intelligence” (not defined, either) by any means it wishes to employ.

As Taibbi notes:

“If these laws are passed, we would be forced to rely upon the discretion of a demonstrably corrupt and consistently idiotic government to not use these awful powers to strike back at legitimate domestic unrest.”

The Fuhrer (oops, President Obama) is about to sign this latter-day Enabling act and when he does, it will mark the moment that America’s coffin is nailed shut. The corpse has been on view since 9/11. But there was always some hope that, perhaps, it might be jolted back into life. Now we know the awful truth. Death is permanent.

And it’s coming for us.

    The looming passage of this bill is one of the most horrifying developments in American history, an astonishing betrayal of this nation and its Constitution by those who have sworn to protect it. It seems to me that both the president and the congress have simply decided that it is no longer incumbent upon them to obey the very document which is the source of their authority. Am I missing something here? Do we actually have a legitimate government any more if the government says the US Constitution is not a valid document? Jeesus, forget the Constitution, these guys are ready to throw out British common law and the Magna Carta. I know that TBP is not the place to go for warm and fuzzy reassurances, but somebody tell me this is not as bad as it appears to be…….please! I’d like to think that the United States still has a fighting chance. I’m terrified that the United States may no longer actually exist. It’s one thing to have a few sociopaths operating in secret, but this seems something different, a wholesale capitulation to those who would overthrow the most basic principles our government was founded on.

    john coster: Each generation has the responsibility to protect their own liberties as the older generations pass away. What this country appears to be heading for is a super police state. Because the people see it coming and are doing nothing to stop it means they are accepting the coming reality; for now. My generation is passing. The history books still recall the Soviet & German police states for people to read. Old people from Europe and Russia that lived through these police states and witnessed the millions killed and rotted in the gulog and prisons still tell their stories for the people to hear. This forum talks about the dangers ahead. Television is now showing the riot police both in Europe and now in American cities beating the unarmed people.

    In my opinion, the young people of this country have a rude awakening coming. They do not listen to their elders telling them about what is about to happen; but instead calling us the greedy boomers. This boomer did not grow up in a police state but sure knows from history what one looks like. Us boomers fought wars with the enemies without. Now the enemy is within and if the young people want to live in a free country with the liberties my generation had they are going to have to fight the enemy within that is eager and willing to strip them of their liberties. Take a good look at those riot police and how they fight. Their boots are going to be stomping on your head as they grind your face into the concrete. This is your reality if you are not willing to fight for your liberties. You are facing horror stories of terrorism against you; “in the name of fighting terror!” This is the lie! This is what I can see coming to you as my eyes fade from the view of this earth. You have the power to change this view. Let’s hope you do it.

    there is a lack of “red lines”in the people’s mind. what happens today regarding rights in the US is plain scary and could never happen in a country like Germany. this country has been so much wrecked in the past that this memory is printed in the brain of Germans and prevent a similar fuckup in a near future.
    people should stand up against this shit, or it is garanteed that they will be crushed.

    I hope Americans won’t need another WW or a civil war to wake up against the 1%
    in my family, my generation is the only that didn’t fought a real war in the last 140 years…
    mind it.

    Our memories don’t go back 200+ years. America’s Founding Fathers fought against this shit. How many of us actually know the list of grievances in the declaration of independence? Let’s take a look ….

    what I wanted to say is that the potential consequencies of the current dictatorial behavior of the US administration could make appear 9/11 events as a walk in the park.
    if a majority of Americans were able to foresee this potentiality, there would be 5 millions people in the streets of Washington the morning after they voted their fucking homeland security act.

    this wouldn’t happen if only 20% of the elderlies had walked in the remains of Dresden in 1945, and had seen a camp from their eyes (and told about to their son and grandson)…

    As Churchill noted, there is a time when the odds are against you. We are near that now. Churchill also said, “We can always count on the Americans to do the right thing, after they have exhausted all the other possibilities.” Unfortunately, that leads us to Churchill’s “worst case.”

    Now is the time to stop the erosion of freedom, but it will not be accomplished now, as Americans do not realize – or refuse to believe – what is happening to them. Further, powerful propaganda is afloat – powerful enough to turn the 2008-09 Tea Party 180 degrees and cause them to actually align with the corrupt banks in opposition to the Occupy Movement.

    The U.S. government is on the verge of enacting legislation enabling them to legally: 1) shut down the “free press” of the Internet, 2) arrest and detain American citizens, in America, without warrant, without showing cause, without trial, and transport such citizens to foreign bases. This legislation is days away from passage. I guaranty that it will pass and be signed into law by President Obama. If you hold some hope that the U.S. Supreme Court will find these laws unconstitutional, I would refer you to the recent “Citizens United” decision …among others.

    While I do not like the odds, I feel we must fight. Even though the U.S. Constitution is being rapidly shredded via (clearly) unconstitutional laws, we still have a chance.

    It is important to know the enemy. When your grey matter is splattered over the pavement, and your blood is running into the gutter it may not matter whether the thug was a Communist or a Fascist. Until that time, it matters. We are not dealing with Communists, rather Fascists. Fascists who have no problem with Communists, but Fascists nonetheless.

    You must understand what it is like live under their rule. The German Fascists of the 1930′s were able to shut down nearly all dissent. Learn how they did this. They had advanced propaganda machinery and ideology, practiced on a war-weary and economically devastated population. Sheep, in a way …as here in the U.S. today. Remember, Hitler bragged that nothing he ever did was illegal; he was being fairly truthful …especially once the NSDAP wrote the laws.

    Reading the journals of those who lived in Germany during the 1930′s will give you a glimpse of the magnitude, and perhaps folly, of the task of opposition. I would suggest starting with “Defying Hitler,” by Sebastian Haffner, an unfinished work ending in 1933; also, “They Thought They Were Free, The Germans 1933 – 1945,” by Milton Mayer. You may safely ignore any thoughts of WWII while reading these works, as this time there will be no white knights.

    We will be up against the most powerful military machine in the history of the world, backed up by ruthless police (…make that “law enforcement”) departments locally. These forces will believe they are American Heroes, and the majority of the population may take their side. You, on the other hand, will be labeled a Terrorist – to be shown no mercy, and given no rights.

    The battle to regain our freedom will be bloody. It will pit family against family, friend against friend. America’s external enemies may attempt to take advantage of the turmoil, and may succeed. The odds of winning look poor to me at this time, but I consider a life of freedom worth the risk.

    As I see it, the immediate tasks are to: 1) rapidly develop a network of friends and family, with communication not dependent on the Internet; 2) gain a knowledge of exactly what a Fascist is, how a Fascist state operates, and how to defeat if from within; 3) as much as possible, educate your family, friends, and co-workers.

    We don’t know how much time we have. Judging from the speed at which tyrannical and unconstitutional law is being fomented, we may have less than any us believe we have. I am assuming that a massive economic crash will be the “kick off” point. My best guess is that this Christmas will look quite different from those to come.

    May God bless all who stay to fight, and those who feel they must leave.

    It appears that our politial leaders in congress have no moral compass. When we start seeing our troops patrolling the streets and the main intersections; then I know the end of this country as we know it is real. The people have not given their permission for this. The new law we now live under is administrative, or what some call positive law. This law is not based on moral foundations and it clashes with the constitution and our “Bill of Rights” as US citizens.

    Freedom is not free in this world; it has to be paid for in blood and be maintained by moral men in leadership. That is a natural law in this world. When people living under a free society neglect their duty to maintain their freedom, trading it for a false security, then their society descends into the despotism of slavery to amoral men. While our society still maintains many freedoms I have observed the groundwork laid in administrative law since 911 for a massive police state. Administrative law becomes active through acquiescense of the people. People in this country still hold the notion that those senators & congressmen in congress represent them. But in reality they don’t because of their practice of passing administrative statutes that are activated through the acquiescene of the people. The congress no longer practices constitutional law therefore we no longer have a representitive government of the people.

    Many people are starting to wake up and see that the government has changed. Many are alarmed at the laws congress is passing and what it means to our freedoms. The politicians are so out of touch with the people and their spending bills are downright scary. What we are witnessing is no longer a representative government but rather a dictatorial one that does not bend or consider the complaints of the people. The TSA is a good example of abuse of the people with the people having no recourse to abusive and arbitrary treatment by it’s agents. And when they are sued the cases are dismissed by the excuse of National Security. National Security is a lame excuse.

    People have become so domesticated; like a dog or a cat, that they no longer question their master’s actions and when they do they are further abused. These are the signs of a police state. But the time is coming when history will be repeated and there will be no place for people to run. People will have to stand up and fight back. That is when it will get bloody. Despotism has a bloody end for all including the despots. It is a human law. God is not going to save this country. Why should he? God is about universal natural law; not arbitrary manmade law based on the whims of absolute power & greed.

    But we still have some time to enjoy the freedoms we have left and for the old people; we die. What is coming is an inheritance to the young. It is the young who will have to decide to be freemen or slaves. It is up to each generation to decide their fate.

    I am really disappointed when it comes to freedom and liberty, that people quote others in the past that said great things about freedom and liberty. I have read all these quotes and stand by them. But these quotes are not needed to be said as quoted by men of the past. Freedom and liberty mean just as much today as then. So to those quoting; do it from your own words from your own heart. This has value today. This brings the matter to the present with real live flesh & blood speaking out to our enemies within. And we all know who our enemies are today. Be passionate because wheather we want it or not the revolution is coming. History has been warning us.

    Indeed, it does, but I’ve heard no words lately having the power of those used by (for instance) Churchill. When I discover some, I’ll be the first to quote them. Until then, if we need go back centuries to discover wisdom and power in words, I feel we should do so. Perhaps had I interlaced quotes by Ron Paul with those of Churchill, my post may have had more of the feel of the “latest tweet.”

    History, being cyclical, not linear as is often taught today, gives us the advantage of looking in the mirror to find how past generations have handled events. The rise of tyranny in a nation of free people has happened before. While there are always differences due to customs, language, location, technology (or the lack thereof), etc., much of the psychology remains the same throughout the centuries. I have attempted to draw parallels with our present situation and those of early 1930′s Germany, as my guess is that more are familiar with that case than those of earlier times. The words of Churchill, as he looked at the near certain annihilation of his nation, transmit a message that I want present day Americans to feel in their hearts. Do I think this will happen? Probably not, but I will keep trying. Sadly, I’m largely preaching to the choir at TBP.

    At present, I find no equal to the words of the past, but I keep looking. I suspect many are looking for some “savior” who might rise above the crowd, but that has its own issues…

    As a sidebar, today’s (Dec. 18) Houston Chronicle, which is my home paper, ran an article about the issues involved with the National Defense Authorization Act. I expected to see a blizzard of comments posted online regarding this story. Counting my post, there is one other. Perhaps I shouldn’t be so surprised, but I’m more saddened than anything else to see the apathy.

    The words of the past have no meaning to many of the present population because, in my opinion, the experience of the police state has yet to be assimulated by the people in general. As of yet only the people living in the ghettos have the taste, so to speak, and they are not listened to for obvious reasons. Reality television shows their experience but the light has not gone on that this could be the experience of the general public.

    As I write this the police departments across the land are being militarized. Why? Why does the police need drones, tanks, and even military trained riot police? This is not done by accident. It is the trend for the building of a police state. It is a mentality for the control of populations who have been and are being exploited for the purpose of world domination by force.

    The world has always been plagued by secret organizations of men that want to control the commerce of others to grow their dominance. Then they seek to control everything.

    America has been blessed for the last 200 years in that the effect of these men in secret have had minimum empact on the majority of our population. But this has changed since the fall of the Soviet Union. America; the last super power standing could have had a positive influence on world peace but these men of the secret organizations hyjacked our government with its powerful military to seek world domination. They started two unjust wars, and because these wars were unjust, they financed them with borrowed money. But both wars are lost, they economy is busting, and the country is bankrupt. Now they expect the public to pay for their blunders. Now the people are upset because of exported and lost jobs, the busted economy, and a bankrupt nation. Next will come the financial crash which comes with lost wars. So these men that control the government, the mega-corporations, Wall Street, and the banks are running scared because the people are beginning to demand accountability for their actions.

    This, in my opinion, is why the police state is being organized. The actions of Homeland Security and the TSA is being felt across the land. Because there is no recourse to the citizen to the unjustified abuses the agents and policies of these agencies are causing the people; this is an indication of absolute power being displayed by the government against the people.

    Now America is being declared a battle ground by the congress of the United States? So now the United States is plotting against their own citizens? Look at how the military fights their unjust wars in other countries that are battle grounds and one can visualize what is coming to this country.

    The population of this country has no idea what is coming. Words can describe it but words have little if any impact on the perceptions of a people or their preceeding generations that have never experienced the police state.

    That is why you find no words equal to the words of the past regarding precious liberty and freedom. But I can assure you those words of the past are going to find renewed meaning when the police state arrives in our communites.

    God bless you and your family. God will be our only refuge when the police state arrives.

    Recall what was going on before the fall of the Soviet Block? People in those countries were suffering from a lack of products to buy in the stores. People had plenty of money in savings but there was nothing on the store shelves to buy. And when products arrived people stood in long lines for hours to get the rationed products.

    I remember my mother telling me from letters she got from my Uncle who lived in Estonia wanted to purchase a car but couldn’t because the demand far exceeded production. He had the money to pay but the state owned company that manufactured these low quality cars could only produce so many.

    Now look at what is now going on in our country. The store shelves here are overflowing with products but many don’t have the money to buy because they have overextended their credit cards or they don’t have jobs. JUST THE OPPOSITE. This is what capitalism has produced.

    People don’t care what type of government they have as long as the products are there to buy. We still have 70+ percent of the people with the money to buy; even on credit. As long as people can shop and indulge in consumerism then they can care less what government they have and what the government does.

    In my opinion our country has been taken over and we have a new government. Not one shot fired to take over the country. Yes we still have the old form; that is, three branches, the executive, legislative, and judicial, however, it operates differently. This difference is instead of operating in constitutional authority it operates under the uniform commercial code UCC and issues administrative statutes the likes of Admiralty law of the sea.

    But people don’t care as long as they can spend money and buy products. You can’t see red lines with rose colored glasses on.

    It appears that the banks own everything left that foreigners don’t own. Yes there are people who have paid for their houses but this is small compared to all the commercial property morgaged to the banks. And when the old people die the young are there waiting to get the money out of those houses to buy stuff; then the banks will own them.

    Yes, I also believe we have crossed the rubicon but what does that mean? Our old form of government is now only a memory in this old mans’ mind. The young will have to deal with it if they want to. But they seem to be fine with the new sheriff as long as they can buy new stuff and there are plenty of foodstamps to go around to buy food.
