California Governor Jerry Brown To Allow HIV Positive People To Donate Blood

California Governor Jerry Brown is expected to give a green light to a bill allowing HIV positive people to knowingly expose their blood to others. 

The bill, SB 239, will reduce the penalties for knowingly exposing someone to HIV without telling them, allowing HIV positive people to donate their blood to others. Lawmakers claim the current felony charge for the crime is ‘discriminatory.’

Foxnews.com reports: State Sen. Scott Wiener, a San Francisco Democrat who introduced the bill, said the current law discriminates against people with HIV because people who expose others with different viruses get only a misdemeanor rather than a felony.

“Right now HIV is singled out for uniquely harsh treatment as a felony,” Wiener said during the floor debate, according to the L.A. Times. He added that modern drugs allow someone with HIV to be noninfectious to others, while the felony charge may discourage some from getting tested.

The bill – if passed – would also apply to people who donated semen or blood without disclosing they have HIV or AIDS.

All Republicans came out against the bill, claiming a reduction in penalties for exposing someone to HIV puts the public at risk.

“I’m of the mind that if you purposefully inflict another with a disease that alters their lifestyle the rest of their life, puts them on a regiment of medications to maintain any kind of normalcy, it should be a felony,” state Sen. Joel Anderson, of San Diego, said, the L.A. Times reported.

“It’s absolutely crazy to me that we should go light on this,” he added, suggesting tougher penalties should be applicable to those with other diseases.

Jeff Stone, a Republican senator and former pharmacist from Murrieta, said the law should remain unchanged as someone exposing their partner to HIV would “condemn one to probably $1 million in drug therapy for the rest of their lives.”

Seems to me HIV drugs should not be covered under Medicaid or Medicare since it is impossible to become infected if one observes safe sex protocols.

Had AIDs been allowed to run its course in the 1980’s those likely to be infected would have died and only HIV resistant homos left.

A year before I retired I did a surgical removal of a bad wisdom tooth. The client had no negative information on his health history. Due to his undisclosed use of steroids and who knows what else, the bone of his maxillary tuberosity was like cement and fused to the tooth – and came out with the tooth. That left a big hole and it had to be sutured to close the wound. As I struggled to make the needed stitches as he fidgeted in the chair, the suture needle went into my gloved finger, deeply. No big deal I thought. It happens quite often. Emergency room physicians have confirmed my experience with the frequency of needle sticks in the course of business. My trusty assistant later did some chair side investigation with the client. She discovered that he was gay and HIV positive – with a very heavy titer of virus. So I consulted with the infectious disease chief at a local hospital. They put me on two weeks of anti viral. I did not seroconvert. It was only because my assistant had a gay brother that she engendered trust with the individual. The hospital had to walk a very thin line in dealing with the individual with the virus to get a picture of his status. Privacy and all that.

Point being, aids is a disease putting many at risk, even those who are not gay. Women partners, health care workers and transfusion recipients come to mind as those at risk.

When honest clients disclosed their positive HIV status on their health history I had no fear of working on them. It is the ones who do not disclose that frighten me. And the law of averages dictate that I most likely saw several every week.

It is mind blowing to think this nonsense will pass. How insane!

Whatever the “crimina law” maybe in California blood banks and hospitals will still be liable in civil court if they dispense blood contaminated with HIV so the only real effect of this will be to raise the cost and, perhaps, the availability of blood.

I give platelets every 3 to 4 weeks and mentioned this to one of the nurses. She said it’s not possible, I only told her what I saw in the article. I am under the impression that all blood is tested for HIV. I do know you are asked a series of about 50 question several of which are directly AIDS related including time spent in jail, accidental needle stick and various sexual contact questions. Any of these would automatically disqualify you from donating, as well as things such as a fever or elevated blood pressure. I cannot see any purpose for putting the nations blood supply in danger, and yes you donations go all over the nation depending on where the need is.

Somehow I cannot imagine the Red Cross opening itself up to massive litigation for the purpose of trying to normalize the possible spread of a deadly virus. They keep detailed records on donations, They have mine back 15 or 20 years. I would have to think that anyone who is flagged would automatically be disqualified as a donor. Still one or two wrong tests, and many people could be unnecessarily exposed to this deadly virus. Many of the blood and platelet donations are broken up into multiple components and a single donation may well end up in several different people.

I do not see how this ends well for anybody, but it is California.
