Let’s Call The Liberals’ Second Amendment Militia Bluff

Let’s Call The Liberals’ Second Amendment Militia Bluff

The Second Amendment is so clear and simple that only liberals, aided by a half-wit liberal law school professor-tariat that is to real lawyering as Jerry Nadler is to Chippendales, could pretend to be confused about its meaning with a straight face.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

The whole “shall not be infringed” part is a real problem for the left, since collectivist Castro-channelers prefer that we Americans be defenseless serfs existing at the government’s (i.e., their) mercy when we should be armed, freedom-loving citizens with the personal firepower to veto their pinko utopian schemes. So, they fixate on the 2A’s passing reference to the militia, spinning a prefatory statement that recognizes that a militia is a good thing into a directive to cancel out the whole “citizens having guns” part of the Second Amendment.

In other words, to defeat its very purpose.

It’s a silly interpretation, and one that’s not even remotely asserted in good faith, but why not put aside all the constitutional arguments supporting our right to pack heat and just call their militia bluff? Maybe we should reinvigorate the concept of a militia in our great nation, if only to annoy liberals.

So, pick up your weapon and fall in. Let’s do this thing. America, let’s get our militia on.

What is the “militia” anyway? It’s not goofy dudes in camo playing army. It’s the American people. It was those farmers, blacksmiths and other assorted non-hipsters who the Brits tried to disarm and who got all shooty in response. Today, it’s us, you and me, regular citizens with military arms so they can cap criminals and tyrants like bosses just as Nature intended.

That “well-regulated” part is what the Second Amendment Truthers focus on, but their analysis here (as with everything) is all wrong. They think Congress can well-regulate the militia into oblivion, presuming to misuse the clause to regulate away any right of actual citizens to have firearms with the ultimate goal of a militia that can’t be militant. That violates the longstanding principle that you do not interpret Constitutional provisions in such a way as to negate them, but liberals hate the Bill of Rights so what do you expect?

Just for fun, let’s assume Congress can regulate the militia instead of the individual states outside of the situations set forth in Article 1, section 8, clause 15 (“To provide for the calling of the militia to execute the laws of the Union, suppress insurrections, and repel invasions.”). If so, then Congress has already clearly chosen to regulate the militia by not really regulating it much at all. It has left it to us citizens to prepare ourselves for armed service, primarily by privately owning guns. And many of us are doing our duty, but tragically, there are millions of Americans who lack the effective modern weapons they need. This must change.

You see, that militia reference, when read as the liberals wish to read it, means Congress can regulate the militia to be more than it is now. You libs are always talking about the militia, so fine. Let’s make the militia a thing again.

First, we need to start by re-well-regulating the militia’s exact composition. United States Code Title 10, § 246 defines the “militia” as follows: “The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.” Clearly, this definition is far too restrictive for 2019, as well as sexist and cis-normative. The modern militia should consist of all healthy, law-abiding American citizens (and those intending to become American citizens) between 17 and, say, 65. After all, back in the olden days, if you made it to 35 you were pretty crusty, practically Joe Biden-like.

Everybody. Basically, if you aren’t nuts, incapacitated, a crook or as old as a leading Democrat candidate, you’re in the militia. And that’s good, because a republic requires participation. For too long, we’ve outsourced the vital duties of individual citizens to our great first responders and organized military. No more. Time to step up, people.

You’re in the Army now, sort of. We all are.

Now, the militia is not the National Guard, which I’m a bit familiar with after serving in it for 23 years. People who know nothing often claim it is, but that’s silly. Review 10 USC § 246 above. The combined Army and Air Force Guard membership in 2019 is about 442,000 personnel. That’s about .001% of the ~329,000,000 million Americans, not even close to even the limited Section 246 membership. Moreover, the Guard is an organized reserve component of the United States that operates under state control except when mobilized – as an officer, I held both a federal commission and a state commission from California. My uniform read “U.S. ARMY.” I had the same training as active officer – in fact, like most of us, I spent years on active duty. We had guns (the same as the active Army’s) locked away in centralized locations. To join, you had to meet active Army or Air Force standards. It’s an awesome and vital force, but it is not a militia.

The idea of the militia is that it includes (almost) everybody, but everybody can’t join the military – only a fraction of our citizens can. The militia is different. It is about all of us doing our part personally for our nation, like answering a jury summons or paying taxes. Hey citizens, time to do your duty. Time to get well-regulated. And that starts with owning a weapon.

What kind of weapon? Well, the requirement for every citizen should be a firearm suited to combat – an actual assault rifle. The M16/M4 is the classic American military weapon, and every member of the militia should have one or an appropriate analogue. If you want to go with a 7.62 mm battle rifle instead of a 5.56 mm, that’s your prerogative. As a member of the modern militia, you’ll need to provide your own kit, and Kit Item No. 1 is some kind of rifle. You need to be able to defend yourself, your family, your community and your Constitution, whether with an AR, AK, FAL, SIG, HK or some other high-velocity acronym.

Oh, you need to have a pistol too. Supplementary shotguns are optional but encouraged.

Training? We won’t need a huge amount, other than requiring citizens to maintain proficiency on their firearms. Every citizen can show up for a month at 18 years old and take a break from dope smoking and their crappy Taylor Swift music to learn some basics, including safe weapons-handling procedures. Also, it would be a good time to do some basic lifesaving first aid training – stop the bleeding, treating shock, CPR. That’s not just vital for when the lead flies– what if you come on a car wreck and a fellow citizen has face-dived through the windshield and is spurting from an artery? What do you do? Oh yeah, my militia training!

If it saves one life, right?

Once initial training is done, then citizens can be assigned to local militia units with an annual muster. Everyone gathers with their basic equipment, updates contact info, touches base with the leadership, and then goes home after a BBQ to regular life until being called up. Don’t think they could never be called up either – I spent three weeks with the Army on the streets of Los Angeles during the 1992 riots and another week after the 1994 Northridge earthquake. LA is shaking as we speak; we citizens need to be ready. How long is there going to be nonsense going down if everyone on the street is carrying a rifle? Not long.

It’s not too much to ask citizens to take personal responsibility for their own country, and the ultimate responsibility is to defend it. That’s why the Second Amendment’s militia reference, taken seriously, means not stripping Americans of their ability to defend their freedom but enhancing it.

After all, for the security of a free state, it’s necessary that every healthy, law-abiding American citizen owns a real combat rifle and is ready to deploy on a moment’s notice to protect our people and our Constitution.

The Second Amendment prevents the kind of nightmarish leftist hellscape that I describe in my action-packed yet highly amusing novels about the United States’ split into red and blue countries, People’s Republic, Indian Country and Wildfire. Hated by liberals and hailed by the sad Loser Boat crew from the failed Weekly Standard as “Appalling,” your right to be entertained shall not be infringed!

1. FAL’s are cool.
2. Every rifle should have a sling.
3. Where do these criminally insane who hate liberty and freedom come from?
4. Being great at Call of Duty does not qualify one for BUDS.

I bought a saiga 308 a couple years ago and it has turned out to be one of best rifles I have ever had. Can Hunt with it or take into battle if you had to. Never had an FAL but have heard a lot of good things about them.
About the article. Our 2 amendment is the only thing stopping these envious thieves who are full of murderous hate towards us traditional white Americans. As long as we have guns and ammo we can make these bastards bleed and they truly fear death. I just hope and Pray young white people never fall for their lies and various propaganda bullshit but alot of white people think all people are GOOD and would never commit mass murder. History says otherwise. Most young people don’t know the history of genocide . It’s not taught in school. They just don’t know how evil and wicked people can be. If they did you would never here another word about gun control.

The govt doesn’t follow the Constitution especially the 2nd amendment. We get to keep our guns because we have them. They can repeal the 2nd amendment whenever they want. Its all for theater.

The author skips over the term “well-regulated” as used in the Second Amendment. In 18th century parlance, the term “well-regulated” meant “well-disciplined” and effective control of the weapon by the weapon’s owner, NOT “regulation by law”.

Yes, well disciplined, and also properly equipped. When the militia was called to duty, the men often needed to bring their own firearms, as the government frequently did not have the arms to provide or the money to purchase them.

US Code requires militia to provide their own weapon in a currently used military caliber. While there are others, today it mostly means 9mm, 5.56, 7.62×51, 12 gauge. If you have enough ammo, I have no doubt whatever you showed up with would be considered adequate.

Indeed, it was in August 24, 1814 when the Brits decided to burn down Washington DC, and the only thing standing in their way, were militia, farmers, citizens with their hunting rifles, trying to take pot shots at those scurvy dogs, after the regular US army dispersed, after the Battle of Bladensburg.

This is why the US will never be invaded, the citizens pose a too great a threat to any invading force.

Wrong well regulated means well armed the second part being necessary to the security of a free State proves well regulated means well armed,if we the people are not well armed there could be no free State tyranny would run rampant and unchecked as it is doing today with law enforcement and the corrupt tyrannical justice department today.

Good article, as far as it goes. Every rifle should have a selector for full-auto. All gun laws are unconstitutional and illegal. I suggest checking out Karl Denninger’s marketticker today. He completely destroys the commie’s argument against the Second and nicely segues into the current argument concerning citizenship and the 2020 census. bob: many of the criminally insane are the “chizzen pipples”. They hate us and want us replaced by third world idiots that they can totally control. And, unfortunately, they are succeeding. The next step is to require universal registration followed by confiscation. Look at what is happening in NZ. This is our future if we don’t collectively say “Fuck you! we will never register, we will never comply”. Stay frosty, my friends.

Good article, however; “well-regulated” does not “mean controlled by the government”. At the time the 2nd was written, it meant “in good working order”. We need to be careful to use the definitions in use at the time, or the meaning will change from what was intended when the Amendment was written.

Probably ‘well-regulated’ was meant in the horological sense?

Nautical Almanac for 1767: “Apparent Time is that deduced immediately from the Sun, whether from the Observation of his passing the Meridian, or from his observed Rising or Setting. This Time is different from that shewn by Clocks and Watches well regulated at Land, which is called equated or mean Time.”

Accurate clocks were a very big deal in the 1700s.

The 2nd is a reaffirmation of birth rights, not created by govt.I though have no felonies ect. do not buy into the ‘law abiding”BS many gun owners espouse, nothing in 2nd about law abiding and founding fathers would be considered terrorists. You are not in jail, you can and SHOULD own firearms.

With that out of the way keep in mind a lot more tools of freedom then just firearms,a poster here clued me into the TM31-210,check it out,a lot of other tolls also.

The best tool for freedom is monkey wrenching the system that is trying to oppress you, many ways to do this and do not involve firearms.

Sounds cray cray, right? Wrong.

There was a time when MAGA first became a possibility with Trumps election (you remember, back when Q was the thing), when the dems were in retreat and a certain exceptionalism was beginning to take hold in America. The evidence was just days away from being dropped and the criminal activity of the preceding administration as well as the democrat presidential candidate, sealing their fate as traitorous vermin that they were.

But time has passed with multiple false ejaculations of supposed evidence, causing the democrats to begin to regain their optimism that the next scandal will rid us of the orange bad man.

After watching the tide of swamp draining dwindle, as the President did everything in his power to implement his plan for our country’s future, only to be stopped again and again by some judge throwing a wrench into the works, its beginning to look like if there will be any real change, it won’t be coming from the oval office…

So I’m thinking state by state, Militias are beginning to look like action that can be taken before the country falls completely under the control of the snowflakes…. So

Attention…. Dress right dress…. forward march!

They were very helpful when a shipment went awry, another guy in same town with me name, they and SG got it forwarded to me pronto,I still have to meet them and give em some nice brews, was a close to 1000 dollar order.

CHECK YOUR TARGETS

I was once sold dangerously overloaded 7.62 Nato seconds by SG Ammo without warning. They were not sold as seconds and the “seconds” print was not seen until it was too late. They were so overloaded the primers were rupturing and it could have broke my gun or my face.

Shitty ammo can creep into even a good company. Check every round for dents and defects before it goes in the mag and always test a full box or two from each case!

The thing that cracks me up is when people say stuff like “25% of the military will desert, or 50% of the cops will quit” when TSHTF is this:

The instant the U.S. military loses even 10% it’s current state of readiness, WE GET ROLLED FROM ALL SIDES WITH COMMUNIST TANKS.

Foreign military forces would grind the USA military machine down to dust, and since nukes aren’t real, the only fight that really matters would be: The *remains* of the U.S. military in the form of 30 some odd million vets, pissed and on their home turf AGAINST THE WORLD.

100 million+ unemployed pissed of and heavily Ameicans = Many of them are starting to dig foxholes.

I heard there was a white-ruled nation wiped off the map when I was 10 years old that sort of stuck in my mind as to how the fuck that could ever possibly be permitted to occur:

One very real possibility is a nation who is in need of our natural resources moving in quickly to dismantle our country while we play civil war footsies with each other.
Nuclear weapons that works or not, the aggressor country would want to limit the damage to real estate to as little as possible, as their intent is to reap what at one time made us the greatest country in the world.

What? Our borders are so great that no nation can penetrate them? Just imagine a squad of combatants settling into several American cities as illegal aliens from the southern border and imagine the havoc they could cause to an already divided nation.

Time is short.

The right of the people to keep and bear arms is about all weapons not just guns, yet dumb Americans are brainwashed that the second amendment is about guns, the second amendment gives every American citizen the right to own/have and bear/carry whatever weapons the choose to own and carry as long as it can be carried in one’s two hands. We the people have the right to carry any weapon openly or concield whether it be a gun, sword, knife, baseball bat, brick, pipe, wire or rope with sticks, pencil, pen all Americans have the right to carry weapons. All weapons laws are unconstitutional because they infringe on the individuals right to bear arms and because they do so they are null and void because they are not legally law.
The constitution does not say you have the right to bear arms unless you are mentally ill or a criminal or because a judge or politicians or law enforcement say so no it says the right of the people/which means all people to keep which means have, own and bear/which means to carry to wield to use arms/means all weapons shall not be infringed/Which means shall not be taken away, shall not be limited, shall not be removed, shall not be violated.
All weapons laws are not legal law they are unconstitutional therefore it renders them null and void.

“The Supreme Court”
“The general rule is that an unconstitutional statute, though having the form and name of law,is in reality no law,but is wholly void and ineffective for any purpose, since it’s unconstitutionality dates from the time of it’s enactment…
In legal contemplation,it is as inoperative as if it had never been passed…
Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no right, creates no office, bestows no power or authority on anyone, affords no protection and justifies no acts performed under it…
A void act cannot be legally consistent with a valid one an unconstitutional law cannot operate to supersede any existing law. Indeed insofar as a statute runs counter to the fundamental law of the land(the constitution)it is superseded thereby. No one is bound to obey an unconstitutional law and no courts are bound to enforce it.”
Bonnet V. Vallier,116 N.W. 885,136 Wis.193 (1908); Norton V. Shelby County,118 U.S. 425 (1886).
All weapons cases in America are illegal if a crime of rape, murder,or theft was not committed with said weapons. All disarmament by law enforcement and courts of the American people who owned or carried weapons are illegal criminal acts they are guilty of treason they have committed PERJURY in violating their oath of office PERJURY is treason and a felony under state and federal law.

There exists a book, somewhere, (my granddad had it when I was young, I’m old now), that stated “well-regulated” meant that every able bodied man, from about 15-45 was required to have purchased a modern firearm with enough powder, wad, flint and ball as to be called to service at any time.

This is the only acceptable meaning of “well regulated”. There were inspections in small town to ensure the requirements were met.

A firearms historian would be able to point to the exact book I’m sure.
