Philip Brailsford, Arizona police officer who shot unarmed man, briefly rehired in order to receive pension

Two years after he was fired for shooting an unarmed man in a hotel, an Arizona police officer was rehired for 42 days so that he could receive a special pension, America’s ABC News reports.

Officer Philip Brailsford, 28, shot 26-year-old Daniel Shaver in the hallway of a hotel in 2016.

Officers were called to the hotel with reports a man was pointing a rifle out a window. It was later revealed Mr Shaver had a pellet gun that he used for his pest-control work and was showing it to other guests in his room.

He did not have the gun when he was shot five times in the hallway with a semi-automatic weapon, and could be seen on bodycam footage begging officers not to fire as he followed their instructions.

Mr Brailsford was fired after the incident for violations of department policy and later charged with murder, but was acquitted at trial in 2017.

His lawyers argued he was responding appropriately according to his training, after Mr Shaver reached for his waistband.

In 2018, Mr Brailsford signed an agreement with his former employer, the City of Mesa, that allowed him to be temporarily rehired, meaning he could apply for an accidental disability pension and medical retirement, according to ABC News.

The former police officer’s lawyer said Mr Brailsford had post-traumatic stress disorder stemming from the shooting of Mr Shaver and the subsequent criminal trial.

Due to the fact he is now technically retired rather than fired, he is eligible for a monthly payment of $3,660 for the rest of his life.

Mr Brailsford was not performing in any capacity as a police officer during the six weeks he was rehired, a police spokesperson told the Arizona Republic newspaper.

I have no take. My opinion was that it was a good shoot at the time. He was charged with murder, tried and acquitted. The jury saw what I saw. an innocent but very stupid guy died. Nothing to be happy about one way or the other.

The part where cops have an unlimited right to murder people. The dead man’s family should have killed the murdering cop. In a just world they would have been acquitted on the legal theory that he needed killing. Also temporary insanity or whatever other justification you have laying around. Now that would be an acquittal I could appreciate.

CC, I caught three idiots stealing a van in December, and had to go down to the Sheriff’s Station to fill out some paperwork. I had a lot of time to chitchat with the deputies about Scott’s situation. I was surprised at how universally hated he was. He was always known as a tough cop. Working for Democratic politicians had turned him into a buttercup, and he had zero support from the rank-and-file. Things change, life goes on.

If a slew equals three, then it appears you are correct; child endangerment, culpable negligence, and perjury.

The comparison is one of apples to oranges, and the subject of ‘lawsuits’ should NEVER enter into police training. If they hold the individual officer’s assets to account-good. I would say that cops are paid well, let them obtain errors and omissions type of insurance. Training should focus on the rights and protection of individuals.

I don’t believe I’ll ever be able to see eye to eye with you on this issue. The cops outnumbered, out flanked, out armed, and showed more aggression than the horribly disobedient serf !

…and in Los Angeles, FBI is investigating LA Sheriff having a gang operating inside that frames people and protecting members who are using excessive force and committing other felonies. The gang is reputed to be subverting chain of command and actually running some LA Sheriffs stations. They even have gang tats.

This is not the way it was when I was a kid. Parents used to tell us,”If you need help , go to a policeman”. Not that way any more. Sad.

I have seen this video before, and both times I nearly chucked my breakfast. If every human being isn’t horrified by the power and control a police officer can have over you, then your head is in the sand. This poor young man was nothing but cooperative, obviously frightened for his life. Yet a power-hungry rookie wanted to show his control and took an innocent life. How in the world could a jury find him not guilty?? Surely at least manslaughter was in order!

And why aren’t the tax payers of Mesa outraged and protesting?? How does he receive this kind of compensation with maybe 7 years on the job?????? I worked 30 years for the federal government and don’t even receive 2/3 of what he is paid….and he will get it for, what, up to 50 years? Does the dead man’s family get that compensation???
Our country is so back-asswards, I don’t recognize it as a free, just American any longer.

Brailsford had the words “you’re f#cked” on the dust cover of his AR-15. If an ordinary citizen defended himself against a criminal and had the same saying etched on his weapon, the prosecutor would be seeking a conviction for intent to commit murder.
As far as I am concerned Brailsford WANTED to shoot someone “just to see what it was like”–a typical police attitude. He not only succeeded in fulfilling his “dream” but will be rewarded with a nice pension for the rest of his (sorry) life.
If I were the Shaver family, I would be looking for retribution of some sort.
Just maybe, permanent irreversible paralysis would be the ticket…

He can be cured of his PTSD if he wants to. He does not have to be a “victim” for the rest of his life. If he is suffering from guilt because he got off scott free and he knows he was trigger happy, then no amount of PTSD treatments will cure him until he owns up to what he did.

Similarly, a black guy with a CPL was pulled over, with his gf sitting in front passenger seat.
He was cooperative, with both hands on steering wheel.
Now, as I heard it reported, the cop asked for ID, while being on high alert b/c this guy had a CPL.
Upon complying with the request for ID, he went to grab his wallet, probably in his right hip pocket, and the cop thinks he’s pulling his gun, and then shoots the dude X number of times.

How do you prevent this?
The cop phucked up, and should have asked: “Where is your pistol? and, where is your ID located?
Instead of just demanding ID from a guy known to have a pistol.

Additionally, the victim should have said: My ID is in my wallet in my back pants pocket, so I’m not pulling my pistol. How should I retrieve it, to comply, without you blowing me away, thinking I’m reaching for my piece?

Personally, if I’m getting pulled over, I immediately grab my ID, vehicle registration, and POI, and have it out and available, before the cop even approaches my window. I turn on the interior overhead light, and place both hands on top of the steering wheel, or out the window.

IMO, when dealing with a cop, some modest amount of respect, and small actions to minimize their legit concerns is not too much of a hassle, to avoid getting killed by a nervous badge wearing idiot.

I’m not saying you roll over let a potential copfuck abuse you.

It’s inexcusable, for thug cops to buffalo and murder innocent victims, and then seek protection behind the blue shield, under the horseshit claim he feared for his life.
Not defending that.
Where proven, they should be convicted of manslaughter and do major time, as they are no better than the non-cops who kill others.

The alternative is, non-cop threats to you, your wife, and kids will be allowed free range, when cops stop trying to find them, and get them off the street, because the risk and blowback is not worth it. They have wives and kids, too.

Departments need to weed out the Rambos with badges, and minimize their decent cops’ fears, by teaching smarter, more respectful dialogue between cop & public.

Responding to a cop with an attitude of aggressive defensiveness is just escalating a volatile encounter.

Stand your ground, go ahead, but some copfucks react with retribution, and the courts will back them.

Piling on, and labeling all of law enforcement as corrupt and abusive of their power is an awfully broad brush to paint a picture.

You’re insane, if you think they’re all useless, and not needed to maintain a civil society.
Because not everyone follows the easy, unrealistic solution to just leave other people alone.
Predators exist.
And yeah, some of them wear a badge.
But many do not.
Who keeps them in order?

It’s a shitty job, and will never be done to perfection.
And like every other occupations, there are ones who do it right, but far too many who should find another job, or be forced to.

he called it a bad shoot,but he also said it should have been manslaughter,not murder,and that if the jury did not have the option to convict on a lesser charge(the story did not specify) that that might have been enough to get him off–

i looked this up on wikipedia–
the one who was barking all the orders was the sergeant,not brailsford the shooter —
the sergeant retired not long after the shooting & moved to the philippines–
in 2018,the us justice dept opened an investigation into the incident but wiki did not say what the results were–
