Red Flag Gun Laws: Connecticut Man’s Firearms Seized Because His Son Shared A Meme On Facebook

Due to the recent mass shootings, there is a major push for so-called “red flag” gun laws at both the state and federal levels. These laws are the latest tool for gun control advocates to confiscate guns from people based upon only tips and suspicion. No crime has to be committed to trigger an investigation or confiscation.

Red flag laws violate multiple rights protected by our constitution. The Hill has an excellent article on how red flag laws violate more than the 2nd Amendment, including:

Hopefully you’ll never commit a mass shooting, murder, or violent assault. But while you might not have a criminal connection to such individuals, you do share at least one thing in common: you both have unalienable rights. The right to face your accuser. The right to due process. The right to protection against unreasonable searches and seizures. Every one of these rights are explicitly violated under red flag laws. (source)

What could possibly go wrong?

Just ask Brandon Wagshol and his dad, from the anti-gunner haven state, Connecticut.

Brandon’s No Innocent Angel

Before I write anything else, let me be clear. Wagshol is not some squeaky-clean, innocent angel. He wrote some vile racist and transphobic tweets. He also seemed to taunt the FBI in his tweets, which certainly isn’t the smartest thing in the world to do. That being said, holding bigoted views is not the same things as acting on those views. Voicing his bigoted opinions, while disgusting, is not a criminal act. The First Amendment protects his right to voice his hate in the same way that it protects flag burning. No one has to like it, but it’s not a criminal act.

Wagshol may also have been caught in a few lies made on Facebook. According to Norwalk police Lt. Terry Blake:

A Facebook page for the younger Wagshol said he was a former U.S. Marine and worked at the Department of Homeland Security as a janitor. Blake said both of these statements on Facebook are untrue. (source)

Wagshol also admitted to purchasing four 30-round magazines at a Bass Pro Shop in New Hampshire to circumvent Connecticut law limiting magazines to ten rounds. Wagshol is now facing four felony counts for possessing those magazines. Whether or not you support Connecticut’s ban on 30-round magazines, he will be found guilty under current CT law for possessing them.

Finally, Wagshol did admit to ordering a kit to build an AR.  A lot of preppers and gun enthusiasts have done the exact same thing. That’s more than understandable with the government chomping at the bit to enact more gun control.  Wagshol will likely be in legal trouble in CT for that too.

Be Careful What You Post on Social Media

This is where a “concerned citizen” stepped in. Wagshol shared a meme on Facebook that someone found scary.

According to News12 Connecticut:

FBI investigators say the Norwalk Police Department received a tip about Wagshol’s activity from a concerned citizen. The joint investigation began after the FBI received a tip that Wagshol was trying to buy high capacity magazines from out of state.

Police say all the weapons recovered from the home are legally owned and registered to Wagshol’s father, but that the 22-year-old had access to them. Investigators also recovered body armor with a titanium plate, camouflage shirt, pant and belt, ballistic helmet, tactical gloves, camouflage bag and computers. (source)

That’s right. The confiscated guns belong to his father. The son “had access” to them by living in the same house, but they are his father’s property. His father didn’t do anything wrong, but his property has been seized nonetheless.

This might be a good time to remind your own kids, both young and adult, to watch what they say on social media because it has real-world implications.

Let’s take a look at those other confiscated items, shall we? Camouflage clothing, body armor, gloves, bags, and computers are all legal to own. Listing it all, however, sure makes it sound super-scary. But, seriously, how much danger were people facing from that camouflage bag?

What kind of firearms were confiscated?

I bet you’re expecting to read a long list of firearms. The media spin has been predictable. CNN said “numerous” firearms were confiscated. The Washington Post described the weapons confiscated as a “cache” However, according to the Hartford Courrant:

Inside the condominium, authorities reported seizing a .40-caliber handgun, a .22-caliber rifle, a rifle scope with laser, firearm optics and flashlights, along with hundreds of rounds of ammunition. They also found body armor with a titanium plate, and tactical attire, police said.

So, two firearms. That’s what we’re talking about. And, the rifle takes the smallest rounds possible. It’s the kind of round you use plinking or to shoot squirrels or small pests. Who doesn’t have this stuff kicking around?

What Kind of Post Gets Your Guns Seized?

Even though Wagshol has denied having any intent to commit a mass shooting, several news outlets have reported that Wagshol made a Facebook post about wanting to commit a mass shooting, including CNNand The Washington Post.

So, what was this scary Facebook post that led to Wagshol’s arrest?

Good question. There doesn’t seem to be one.

The “concerned citizen” reported a Facebook post regarding buying 30-round magazines. However, no post has surfaced stating Wagshol wanted them for a mass shooting.

The police claim, however, that Wagshol was indeed planning a mass murder. From the Hartford Courrant:

Norwalk police Lt. Terry Blake said Wagshol had posted on Facebook that he “was into planning a mass murder.” (source)

Police claimed Wagshol made social media posts showing an interest in mass shootings, but did not specify any particular posts. (source)

According to Wagshol’s lawyer, Stamford attorney Darnell Crosland, the police failed to cite any actual Facebook posts in the official report.

Crosland also said the report did not include any of Wagshol’s Facebook posts in question.

“What I understand is that he didn’t make any comments on Facebook, but there might have been other memes, as they call it, that he might have re-posted, but he didn’t make a statement on Facebook as related to any mass shooting.” (source)

Some readers here may also be familiar with the Facebook page, Uncle Sam’s Misguided Children. Their page posted an article from their website with the potential offending meme.

The article goes on to clarify what those terms mean.

“Boogaloo” – a slang term for shit-hits-the-fan, or government gone bad and they’re coming for you, time to fight back. Boogaloo toys refers to guns. The opposite of “bugging out.”

“Alphabet bois” – ATF, FBI, DEA, etc.

“Coat hanger sears” – hand-crafted drop-in auto sears for an AR.

Could this be the offending post? Maybe, maybe not. The article from Uncle Sam’s Misguided Children also says Instagram has blacklisted the term, “boogaloo”. However, I was able to search Instagram and find both the hashtag and multiple users with “boogaloo” as part of their name. So, that doesn’t seem to be entirely accurate.

The CTPost stated the “concerned citizen” reported Wagshol’s posts after talking about getting the 30-round magazines from out of state that are illegal in Connecticut.

Regardless if it was the above-mentioned meme, or a post about magazines which were banned in CT, neither mention mass shootings.

If it is, how many times have we seen similar memes shared by prepper friends or by fellow members in prepper groups on social media or prepper forums?

Rights for Some, Or Rights for All?

Red flag laws are unconstitutional on multiple levels. I know lots of people believe they are necessary. But, we make better decisions when we keep things logical and constitutional, not emotional and reaching.

Here’s what we know:

  • Wagshol is a 22-year old man, attending college, living with his 2A-supporting dad.
  • This 22-year old holds some hostile and bigoted views.
  • He also holds some anti-government views.
  • He has lied about prior military status and employment history.
  • He decided that his state of residence has imposed unconstitutional laws that violate his second amendment rights and chose to ignore them buy buying 30-round magazines from a Bass Pro shop in NH and ordering an AR kit from CA.
  • Someone reported a meme he shared to police under Connecticut’s “red flag law”.
  • An investigation took place without his knowledge, and his father’s firearms have been confiscated along with some clothing and gear.
  • The official report does not include any specific Facebook posts, never mind Facebook posts discussing mass shootings.
  • He has been banned from the college campus he attends until after the investigation.

I know I’m going to catch some flak for this assessment, and that’s ok. I’m fine with holding unpopular opinions. I try to remain consistent in my libertarian views, regardless of what’s popular or not.

But, constitutionally-protected rights apply to everyone, even jerks with bigoted views.

We’ve got an angry, young man who has run his mouth on social media combined with a general atmosphere of fear over mass shootings and firearms in general. Someone got freaked out and reported him under CT’s “red flag” law. Rather than moving to a state where the laws reflect his values, he chose to violate the law and obtain banned magazines and a kit for a banned gun. These were only found during the confiscation, which was the result of a ruling that denied him and his father (who legally owned the guns) due process. The confiscation violated multiple constitutionally-protected rights. Regardless of what is or isn’t constitutional, he’s still in jail. While Wagshol doesn’t sound like someone I would want to spend much time with, he still has civil rights which appear to have been violated.

Many would say that because of his views toward other races or towards transsexuals, that alone is enough to constitute a credible threat of violence. Except, that it isn’t. There is a difference between saying, “I don’t like you” and “I am personally going to harm you.” Red flag laws are pure “Thought Police” and “Pre-Crime Division” stuff. 1984 and The Minority Report were supposed to be warnings, not blueprints.

We either have rights for all, or we have rights for none. If we can overlook someone’s rights because we dislike their beliefs or views, then we should have every expectation that our own rights can and will be overlooked as well. groups we dislike, or we will be torn apart from within by our differences.

I’m hoping it will be the first but preparing for the second.

This is a reason if you have firearms to perhaps have a few “away” from home,whether stolen by the feds or just a average scumbag crook at least you are not then completely disarmed.Have a safe in your home,while not completely burglar proof will keep majority from getting your items.You have a firearm in say night table and do not carry it during the day/lock it up.Would be real dumb way to die,shot by a burglar with ones own firearm,yet it has happened,with freedom comes responsibility.

As for the speech,tis protected whether you agree with it or not,this country is well down a long/dangerous road.

Surely the 3% have already been identified and red flag laws are the calm before the storm attempt to slowly raid them, then have the same corrupt judge place a gag order on the victim and doxx him so he loses his job too. That said,tis a nice day so out to install some new drilled/slotted rotors and ceramic brake pads on one of the vehicles,love the freedom of driving around but want to be able to stop in a efficient manner!

Looking for another classic 4x4newest will accept is late 70’s,can be mechanically shot as long as nice body/frame,really do not have body skills but dropping in motors/trannies/clutches ect all a breeze(or,so it seems when done!).

In honesty this brake job is for me little Mazda 3,good little get around grey man car unlike some of what I own.

My rotors like ones you show are zinc plated/new to me.Tis the first time I got rotors not in a sealed plastic bag oil coated/almost cosmolined,but,need to do a specific break and stop break in period with the ceramic pads,weird,will see how it goes long term.I have really liked the ceramic in that it does not dust the hell out of mags with broken down pad crud.

MG,have one with 5 speed and been a good traveling/grey man car,actually holds a lot in trunk.I did and so should your son if not already get a full size mag with spare,donot useless,yes,takes space in trunk but worth the peace of mind.

As for Charger,well,unless beyond salvage would say go for it!

I never had a Mopar among my hot rods but would really like a Roadrunner,383 or 440 would be fine for me!

Yep….I marched on the capital in Hartford CT when the magazine ban and registration of “bad rifles” was being debated in the statehouse and of course, it passed overwhelmingly post Sandy Hook.

Once passed, well…..I started looking for real estate in the American Redoubt and then moved to MT.

CT got some compliance with the registration effort, estimated at 30% of the covered firearms and magazines (you had to register them also) the subsequent registration efforts in NY and NJ got much less compliance. You cannot buy body armor in CT BTW so the rifle plates (not Titanium trust me) were probably illegal unless the dad can prove he bought them out of state, New Hampshire is popular.

So right now today……all the bad black rifles and lots of other rifles are simply unavailable in the state of CT. It is just a matter of time until confiscation occurs.

Norwalk is a lower-income city with lots of blacks and Hispanics and poor whites so its no surprise racist boy lives there and is pissed off.

Prior restraint is a key legal concept and these Red Flag Laws are unconstitutional because no criminal act is required to break the law…that is called prior restraint….you are in violation of the law by simply being who you are….in this case a typical trash spouting troll.

Under the 1st Amendment hate speech is protected speech……that’s the whole point. You are guaranteed your right to speak freely even if it is hurtful and you look like an asshat…..calls to action with a credible threat are not however protected and that’s the line the Red Flag laws are walking.

Red Flag laws claim that the accused is not protected under the 1st Amendment because their speech is a dangerous threat and therefore their firearms can be pre-emptively confiscated without due process (or limited due process). Once in place….and with a Dem in power (or Ivanka) imagine how far this concept can be pushed.

Trump Mulling ‘Uniquely Dystopian’ Proposal to Use AI to Identify Mental Health Issues as Risk Factors for Gun Violence

U.S., President Donald Trump is reportedly considering a new project aimed at detecting mental health issues to stop shootings before they happen.

As The Washington Post reported Thursday, the Trump administration has worked with Bob Wright, a close friend of Trump’s and his collaborator on the reality show “The Apprentice,” to develop a proposal for a new federal agency that would be called the Health Advanced Research Projects Agency (HARPA), within the Health and Human Services Department.

HARPA would be modeled after and led by a top official at the Pentagon’s research office, the Defense Advanced Research Projects Agency (DARPA), which has developed drones, artificial intelligence meant to merge with deadly weapons, and technology to help U.S. soldiers detect safety threats during deployments.  

Instead of developing military equipment, HARPA would draw information from people—gathered strictly from people who opt in to the program, the administration says—to identify “neurobehavioral signs” of “someone headed toward a violent explosive act.”

As Sarah Orem, a postdoctoral student who researches disability rights, wrote on social media, HARPA’s technology “deeply resembles” the Pentagon’s, “which scans for ‘possible threats’ to soldiers at war.”

“Except the ‘threat’ here is mentally ill Americans,” Orem said.

HARPA’s goal of using “volunteer data to identify ‘neurobehavioral signs’ of ‘someone headed toward a violent explosive act'” deeply resembles the above technology, which scans for “possible threats” to soldiers at war. Except the “threat” here is mentally ill Americans. (5/

Trump has reportedly been receptive to the HARPA proposal and the administration is currently considering a potential project within the agency called “Safe Home” (Stopping Aberrant Fatal Events by Helping Overcome Mental Extremes), which would involve a “sensor suite” using AI to identify people who could be prone to violence.

Just as DARPA has partnered with private companies, HARPA would potentially use personal technology devices like Apple Watches, Google Home, and FitBit to identify behavioral or mental health changes.

It’s stupid because what mass murderer having a plan to mass murder is going to opt in? Thats like if someone was going to rob a bank, would they go tell everyone? So I think that’s just government and corporate propaganda.
And how long before these devices are mandated in every household for ‘our personal safety’?

While addressing the issue of mental illness and gun violence seems logical, this appears to be an attempt to allow the government to further erode what little personal privacy the public has now. This also ignores the fact that in many of the mass shooting events, the perpetrators were previously known by authorities to be dangerous and nothing was done. Considering the fact that many of these shootings bear the signature of false flag domestic terror events, additional government snooping will do nothing to prevent more of the same.

The loss of a belief in God is the cause of mental illness in many people. Whatever government does to counter mental illness in people will not work because government policies under current administrative laws lack values; human values. Only a balance between fact and value bring harmony which is severely lacking in much of our society and totally lacking in our current form of government.

The fact still remains property was taken without just compensation for the actions of someone else. This is technically unlawful search and seizure from a third party and there’s no proof the father would’ve been involved in any violence.
Anyone who is able should leave such a jurisdiction and let the Progs wallow in the social filth they’ve created.

I read the list of “vile racist and transphopic” comments that were used against him. I can easily say that far worse is posted here often, so this first and foremost is a freedom of speech and thought issue.

His worst 2 were ” I hate niggers” — which I’ve heard uttered from even a few black friends of mine, so not necessarily racist at all………. I suspect the person who alerted authorities is a Transvestite because the comment about “transvestites should be first in the gas chambers” is pretty harsh, but again not a threatening statement that he is going to commit violence.

He has probably posted 100,000 comments, likes, or re-posted memes so the “evidence” against him is really thin–likely he’ll be like MAGA hat boy in DC, completely exonerated of any wrongdoing but a nice nugget for media propaganda.

This one is very disturbing– pre-crime and thought police indeed. If this becomes the norm, none of us are safe because we’ve all been pissed off at one time or other and posted words off the cuff.

Prior restraint is a doctrine used in Press Law that applies to 2A law as well.

Clear and present danger should be obvious before such action by the legal authority. Words on social media are just words no matter how vile they are declared to be.

Do not read them.

Investigate perhaps but not cause for 4th Amendment violation.

Words lead to actions. One needs to be careful about the words they use and how they phrase them. Our brain is a form of computer. Put garbage in and bad effects can manifest out of it.

Society has broken down in many areas of the country to third world status. People live in fear. So the words we use can cause alarm. Free speech is a two edged sword. It has an effect on people.

Administrative law does not look at the 4th amendment to the constitution in the same way that our forefathers looked at it. Conditions were different then.

And a big problem today is that most average people do not know the constitution nor the administrative law of the land that we live under today.

Social media is a modern version of the coconut express. It has power to influence the thoughts of people. Don’t under estimate the power it has on social consciousness.

We need to realize that the law of the land is Administrative Law created in the 20th century and not the constitution that was created in the 18th century. There is no due process of law guaranteed in Administrative law.

One also needs to realize that it is our thoughts that create our reality and that manifested actions result from our thoughts. When we change our thoughts we change our view of reality.

Red Flag laws are created out of Administrative law. All State Statutes are Administrative Law which all the States accepted under the Administrative Procedures Act. So Red Flag Laws are acceptable under State Statutes. Do these Red Flag laws violate the Bill of Rights under the Constitution? Yes they do, but the Constitution is not the law of the land. Administrative Law is the law of the land. We don’t have constitution courts across the land; rather, we have administrative courts. And because of this we have no way to challenge Red Flag Laws.

In view of the conditions we live in under administrative law we need to consider our thoughts & subsequent speech and what this means to those who practice and create administrative laws, rules and regulations under the color of this law. Because this law does not recognize the Bill of Rights we need to be careful about what we say in public. As we can see in the administrative laws already in existence along with the new ones coming we no longer have unalienable rights.

Under administrative law individuality is not accepted. Individuality is a pattern of self directing ability to adjust behavior and influence an occasion. Conversely, the pattern of administrative laws is to be the directing authority to adjust behavior and influence the direction of occasions. The two patterns are in contradiction.

When the general public finally wakes up and becomes aware of this contradiction then perhaps a solution can be found that can restore our unalienable rights that were spelled out in our founding constitution.

In regard to our thought processes and self direction many need to take responsibility for their thoughts & speech and consequent actions. We are constantly subjected to violent Hollywood movies and video games that do influence our behavior. These movies and video games lack human values that promote good judgment. They have taken the place of literature that promotes values essential to our development as a human being. Rad Flag laws point this out but since administrative law also lacks human values the imposition of these laws only creates more problems in causing unintended consequences.

In conclusion I would like to say that people with big mouths need to shut up. This man got what he deserved because he didn’t teach his son how to use good judgment and measure how he used his words. Gun ownership is a responsibility that these two seemed to take for granted. So they got caught in the administrative trap.

It seems pretty clear to me that what we’ve been talking about for the last several years is no longer tinting the horizon, but has peeked its brazen face into what is predicted to be a ‘brassy’ hot day.
The old way of thinking is dead.
Every person needs to construct a new paradigm about our imminent future, and how reality needs to be the complete focus. No more pointing fingers, or boasting about what you will or will not do; that leads to a false self-image. And you better be right-on-the-money about your true abilities – emotional, mental and spiritual right along with the physical. When the first hot brass hits the ground, it will be too late, probably in more ways than one.
This is why I welcome Trump as a last chance to better prepare, in whatever area. He certainly is not, despite his possible best intentions, going to do more than offer a thin insulation against the incoming Crematorian winds.
So far Trump is what I expected. He is what must be at this stage of historical cycles, whether Turnings or the larger theme of civilizational rise and fall. And for me, I see the biblical aspect, also.
This going to be Epic, one way or another.

How about thinking of God; the cosmic consciousness, as the whole and our individual consciousness as a part of that whole. The higher cosmic intelligence feeds the lower human intelligence through the subconscious and new ideas spring forth out of our objective consciousness.

Look at all the technical advancements that have come forth out of human intelligence? Do we really think these ideas came from man or as some people thing an alien source? These ideas came from a cosmic intelligence

Subjective mind in a person is the same subjective mind at work in the universe giving rise to natural forms including ourselves. It is the supporter of our individuality and our personal share in universal mind.

I’m going to be the outlier here and say the red-flag laws are inevitable and necessary. Why? As John Adams said, “Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.” The population of the “United States” is largely immoral and atheist. Throw in undisciplined and ignorant and you have a recipe for disaster. The Second Amendment can only apply to a citizenry that has self-discipline.

An ignorant, immoral, undisciplined and atheist country must be ruled by an iron fist. History shows that, time and time again. Tyranny is at hand for just such a reason.

If the States had retained their rights re: the 10th Amendment, there are many States that would not need red-flag laws. Alas, the states are little more than administrative provinces to the Empire.
