There’s This Thing Called Due Process That We Ought to Try

I get a little picky about this whole due process thing, not just because I’m a lawyer and not just because I helped defend our Constitution overseas in uniform a couple times, but because I’m an American citizen. Let’s understand clearly the nature of the due process argument over impeachment. This is not about Donald Trump getting due process. This is about the American people getting due process.

It’s our choice for president that is being challenged. You get due process under our glorious Constitution when you are about to have your individual rights infringed – like having your freedom or money taken. President Trump has no individual right to be president. It’s a position that we citizens gave him in order to work for us. The presidency is not his, any more than being a colonel meant the eagle belonged to me. The real due process rights at issue here belong to us, America’s citizens, who are faced with the prospect of having our right to choose our president infringed upon.

In other words, when no one is allowed to put on a defense to the impeachment inquisition, it’s not Trump who is being deprived of his due process rights. It’s the American people who are being deprived of their due process rights.

Due process means a chance to have your say, to tell your side of the story. We all used to accept that everyone has a right to make their case. Now, sometimes that may be hard – if the Five-O catches an axe murderer with a dripping hatchet and a tatt on his forehead that says “I (heart emoji) Mayhem” and he just starred in a YouTube video titled, “I Just Went On An Axe Murder Frenzy” he’s probably going to have an uphill battle to acquittal. But it would never occur to us not to tell him the charges, and to let his lawyer ask questions and call witnesses in front of an impartial judge and jury. Due process is not about a result but about giving everyone a chance to tell his side of the story. 

Until now, it seemed we all agreed on that. But, as in so many other ways, it appears that our ruling caste thinks that Trump is such a special case that we have to make an exception to the rules for him. Perhaps it’s because of how Trump destroys norms and stuff.

Is it too much to ask Adam Schiff to do the same basic things for the American people in this process that a dude accused of tearing mattress tags would get?

Tag Tearer would get told exactly what charges he is going to be defending himself against. So, what charges are we defending ourselves against here?

Tag Tearer would get a judge and jury that were impartial and unbiased, with no preconceived notions about the facts. But Schiffquemada has spent three years telling us Trump must be removed. So, we are facing a prosecutor/judge. That’s a due process abomination.

Tag Tearer would get to question witnesses against him. Really question them. We don’t get to here. Oh, Judge Schiff is willing to allow “relevant” questions. Surprise – what’s “relevant” is only stuff that supports his pre-existing narrative; anything that disputes it is “irrelevant.” That’s like a prosecutor who gets to stand up and say, “Objection, hurts my case!”

Tag Tearer could call his own witnesses, including witnesses the other side doesn’t want heard, which is, of course, the point of calling them. But we can’t do that when it comes to removing the president we elected. How is that reasonable?

Oh, and let’s not forget the origin of all this. Supposedly, the chief law enforcement officer of the United States, the president, was wrong for threatening to hold back free money from foreigners if they failed to help investigate why a former VP and current presidential contender’s drug-snorting, paternity suit-having, Navy reject son was pulling in north of $50K a month from a Ukrainian gas oligarch. If Trump didn’t do that, he should have. The dual track justice system – where the corruption of the elite and connected is actively protected while those on the outside are prosecuted for calling attention to it is, itself, a ruinous disgrace.

It’s not really due process if the accused is not allowed to prove himself innocent. Now, the objection to granting the American people their due process will be that Trump will use due process to assert “technicalities” to foil the impeachment plot. Hell to the yeah. The other word for “technicalities” is “the law.” You see, the technicalities are what accusers call the protections, procedures, and requirements that they don’t want to have to meet in order to get what they want from someone else. Most of the time the technicality is that the person didn’t do the crime or the tort.

For example, in the Ben Shapiro Clockboy case – I’m only going to talk about what’s out there in public – we won that case because we demonstrated that Ben Shapiro did not commit defamation. Critics of our victory called that a “technicality.” But it’s not a technicality when you didn’t do the thing you were accused of. And it’s not somehow underhanded to prove that using the tools provided by due process.

That’s the thing here – you have a sham process where prosecutors with a clear bias and a prejudgment of the facts are not trying to make a factual determination but to orchestrate a show trial designed to validate the decision they reached before this whole Ukrainian thing even started – before the fake Russia thing began. Heck, before Stumbles McMyturn even lost.

This is an unAmerican disgrace. It deprives the American people of their rights.

Of course, our garbage elite waves that off. Why, this is Trump, and this is a “special case.” But there are no “special cases.” When you change the standards in your “special case,” every case inevitably becomes a “special case.” Then it becomes normal.

These clowns will do more damage to our country with their attempt to rid it of the alleged norm-breaker Trump than Trump ever could. And when they cry out, “Help us!” as the new rules they made devour them, we will smile and whisper, “No.”

Where is anybody not speaking out against this outrage going on on any side of the so called political aisle? All these public servants seem to just be going along, not questioning anything, collecting their tax-payer supplied salaries and benifits.
Civil war is becoming mainstream talk now and lessons can be learned from the first one, the main one being the Confederates should have followed up on the victory at First Manasas, destroyed the retreating Union Army, hung Lincoln, and burnt down Washington DC.

Before you go all indignant and self-righteous, perhaps you should know a tad more about your ‘innocent’ Schiff. Perhaps you should educate yourself about the role of Congress and then pay attention to Obama and his actions. Schiff is a congressman, Schiff, as a congressman signed off on those ‘wars’ and authorized funding the very institution that sends those soldiers into the fray, thus making his hands far bloodier than any foot soldier….

In March 2015, when Saudi Arabia launched air strikes against Yemen that began the ongoing murderous intervention, Schiff went out of his way to voice support. The Obama administration, he declared, “made the right decision” to support the Saudi bombing. Said Schiff: “The military action by Saudi Arabia and its partners was necessitated by the illegal action of the Houthi rebels and their Iranian backers.”

Ukraine seems to have been used as a money-laundering platform…send billions on US Aid…then skim that aid via contributions to Clinton Foundation, Rosemont, Burisma BOD seats, etc….

I guess what I am still struggling with is why all the drama when busting out poor countries in this manner is not all that new. I feel like that there must be more to this than covering up government criminality. So either the scale is much larger than we can imagine or Obama was directly involved etc…..

Usually, the new regime gives the old regime a pass so that they can wet the beak during their time in office and then pass the baton…rinse and repeat. So why didn’t that happen?

It’s about the process and the people, not the President. Schlichter is a Trump cheerleader for sure. But that’s beside the point. If they can remove Trump in a sham proceeding, then they can do this again if we were to pick someone else who managed to win and really did want to steer the country back on course.
I don’t think this will be successful, so they will move on to the next thing to take him down. They will do whatever it takes to get rid of him. The people are not allowed to pick who they want if that person goes against the mob that represents the left. They have the intelligence agencies behind them and they are far more powerful than we can imagine. There is a mob that represents the right but I’m not sure they are as powerful as the one on the left. Not only that, they pick weak candidates. I don’t think they can win this war, which is what it is. A war between two mobs.

Good Post Mary, I’m with MyGirl as we both have long agreed on the competing Crime Family Game of Throne reality.

One of my questions is are the Crime Families just fighting for control of the emerging New World Order or is there really any hope for any real ‘White Hat’ non Crime Family alliences fighting back for the long subdued Republic, not the tottering fractionalized empire we are today?

I became convinced after Poppy’s funeral (and trip to hell) by the Trump/Georgie W truce meeting at the Blair House just before, that it led to Bushie Consigliere Barr becoming AG to oversee the Trump/Bush truce, followed by Mueller following orders and fading away (as part of that truce) that Trump support from the Zionists (they reportedly have called Trump their boy) is what is keeping him in power…as no individual could stand alone against the Crime Families.

What we are seeing is just different factions of the same ‘Mob’ fighting for the top spot and control of the emerging NWO.

Is the hate for Trump by many in other Crime Families a hate for them being exposed as the Zionists take full control of the NWO disposing of them and replacing them with their own made men & woman, to use the Mafia vernacular?

Anyway, this is from 2016 (you may be familar with it) and is a powerful case explaining what we all are facing. Its title is deceiving as there is almost nothing in it directly about Trump himself? However, his ties to the Rothschild’s are well known and documented.

The New World Order has a lock on everything and can deflect any challenge. However, when the current system comes crashing down (say during the next Fourth Turning event) there is a chance, but no guarantee, that a ‘White Hat’ leader will emerge and be successful. Early in Trump’s candidacy I hoped that he would keep his promises to drain the swamp and MAGA if he was elected, but that obviously didn’t happen.

I started to write a post on who the individual Banksters families, Think Tanks, Foundations, Secret Societies, etc. were…their history in chronological order…and half way through I was overwhelmed and depressed. So to ease the depression I read my Bible!

POW! WHAM! HOLY, HOLY, HOLY, BATMAN…I felt better. (I miss Adam West).

I think if I made a list of everything Trump has ‘done’ (who cares what he says), and everything he hasn’t ‘done’, and then splashed in my suspicions, he would being wearing a dark grey hat. I’d like to see his hat bleached, but I’m worried it will get tossed into the wash with the colors and get even darker.

I am determined to control what I can and build a prepared bridge into the future for my family, and wife of 43 years as the Luciferian Globalists seem to be closing in for their big play.

This right here. Everyone on this site knows I’m no Trump cheerleader, but the rule of law is (was?) the binding force of Western civilization. I would be in favor of due process for Epstein, that sick and twisted fuck. It is essential to try someone impartially and to mete out justice impartially and fairly.

Neverending appeals are the extreme on the other end and just as deadly to the rule of law.

After USAF, I took Western European Diplomacy for kicks (I liked taking 4000 level classes with a bunch of 20-something smart-asses after a decade in AWACS).

Italy’s government fell almost every single year after World War II into the 80s. I imagine is is still a mess.

They have many parties in Italy and to form a Majority, some of the most bizarre coalitions are formed to elect a President and then they fall apart on the first piece of legislation and the government “falls” to the next coalition to form a majority and get a “leader” elected. It was a mess.

We’re already witnessing power struggles within government agencies and across all branches because the corruption has gotten so bad. The American democratic experiment is in shambles as is the Republic and the rule of law that supports it.
Some of that is explained in the German book about the Iron Rule and competitive oligarchies. At some point it has to be stopped or a messy repeat of the French Revolution is going to happen, which is a premise I totally agree with.

IMHO it’ll be worse than Robespierre if this continues. I firmly believe we are looking at Yugoslavia by 2024 and can find no reason to believe the velocity as we hurtle toward the brick wall will be impeded. The sad thing is that we aren’t crash test dummies so it’s gonna hurt. If we do go Yugoslavia, I’d fully expect Russia and the ChiComs to be immediately engaged. This is why DC is attempting to topple just about every govt. south of the border…they know.

I think Europe is even worse off because they aren’t armed and they already have a multi-million, young male sleeper cell throughout the entire continent. Australia will also have its problems if the ChiComs get feisty.

You cannot preserve half your freedoms in a negotiation with totalitarians.
They have been relentless over the decades – negro civil rights, women’s rights / feminism, gay rights, now pedophile rights. We must be relentless, and gain back the lost ground.
Kim Jong Il invaded South Korea; using an UN mandate, Truman sent MacArthur to kick his butt out. MacArthur wanted to finish the job, but Truman had no stomach to take on the ChiComs back then. The result was decades of provocations, the Norks getting atomic weapons, spying and so forth. Stopping halfway only emboldened Kim Jong-Il, and lost the initiative for removing him.
Saddam Hussein was a similar story. He invaded Kuwait, and Bush I sent troops to kick him out. They stopped at the border, where Bush I’s “mandate” ended. In less than ten years troops were back, this time ending Saddam Hussein.
The lesson is that stopping halfway will not end leftist propaganda, provocations and incursions into the culture any more than stopping halfway discouraged K. Jong-Il or Saddam Hussein. You must throw them out of the schools and universities, out of the media and out of positions of power in the government, and REVERSE THEIR POLICIES. It will never be simple or easy, but it must be done – or your children will have to do it again, once the nightmares really start. What we have now is bad, but it will get exponentially worse the next time the President and Congress are both socialist / communist.
Then the reason for the Second Amendment will become obvious.

Ok, so “due process” sounds good in theory. However, due process exists outside of the paradigm of tyranny. Which is why it is so antithetical to every endeavor pursued by the satanic demoncrats.
