What I disagree with is breaking down a door to arrest someone on a drug charge, but some black robed lawyers have told the police they can do just that, regardless of the wording of the 4th Amendment.
In the Breonna Taylor case, the cops knocked and announced themselves.
And then they broke down the door, just to serve a warrant on a drug dealer (who was not even there). I doubt Madison or Jefferson would approve of police breaking into a house over a non-violent, victimless crime.
Actually the drug dealer was there and opened fire first. Regardless of the unconstitutionality of drug laws, every person has the right to self defense.
The boyfriend that was there was not the one on the warrant and yes, he shot first at those who were breaking into the apt. He claims he did not know they were cops.
They had a non-knock warrant, just in case. But they knocked and announced themselves. The boyfriend in the house shot through the door, hitting an officer. That’s when they broke in the door.
From what I’ve read, the warrant had Breonna Taylor’s name on it.
