The Death Star Strategy: Is Trump Contemplating The Ultimate Constitutional Trick Shot?

Below is my column in The Hill on the possibility of contesting electoral certifications by key states. With the adverse ruling in Pennsylvania, the Trump legal team is still pledging new evidence of massive fraud as certifications are completed. The options for the team seem more and more reduced to the ultimate constitutional trick shot in engineering a fight on the floor of Congress. Here is the column:

The Thursday press conference by President Trump’s legal team left many breathless as Trump counsel Rudy Giuliani alleged a global communist conspiracy to steal the 2020 election. While making passing references to credible election challenges over provisional ballots or “curing” rules, he repeatedly returned to the allegation of a purported massive conspiracy directed by Democrats to change and “inject” votes into state tallies.

It was a strange narrative that seemed to move away from the provable to the unbelievable. The question is, why?

One possibility: to raise sweeping allegations with insufficient time to resolve them in order to force an Electoral College fight. The idea would be to give license to Republican-controlled legislatures to intervene with their own sets of electors or block the submission of any set of electors. Concern over such a strategy was magnified when Trump called key Republican leaders from Michigan’s legislature to the White House on Friday.

Call it the “Death Star strategy.”

In “Star Wars,” a struggling rebellion was in full retreat on every front against an overwhelming force in the Empire. The rebels were left with just one strategy and literally one shot. Luke Skywalker had to skim the surface of the Death Star along a trench and fire a round into a small thermal exhaust port to travel down an air shaft and cause an explosion in the core reactor. Then poof! No more Death Star.

However, if this is the Trump team’s plan, it will make Luke Skywalker’s shot look like a beanbag toss.

The electoral ‘trench’

The “trench,” in this instance, is found in state election systems leading to the electoral equivalent of the “exhaust port” in the Constitution’s Electoral College. It is the Electoral College where the actual election of an American president occurs. Each state certifies votes to the Electoral College — a figure that adds up to the number of members the states have in the two houses of Congress, or 535. (In addition, for Electoral College purposes, the District of Columbia is given three electors, for a total of 538.) Thus, a candidate must have at least 270 electoral votes to become president.

To reach that “exhaust port,” Trump’s legal-team equivalent of X-wing fighters must get all the way down the electoral “trench” by creating challenges to multiple state certifications and deny Joe Biden the 270 threshold or claim those votes for Trump. The Trump team has focused on states such as Arizona, Georgia, Michigan, Nevada and Pennsylvania. If the litigation can create serious doubts over the authentication or tabulation of ballots, the Trump campaign could force fights on the floors of these state legislatures. However, after meeting with the president on Friday, the Michigan legislative leaders dealt that potential strategy a serious blow by saying they are unaware of anything that would change their state’s certification for Biden.

The electoral ‘shaft’

Once litigation introduces doubt as to the validity of the vote, the matter travels down the electoral version of the Death Star’s air shaft to individual state legislatures. This is when things move into some uncertain constitutional physics.

Article II of the Constitution states that electors are appointed “in such Manner as the Legislature thereof may direct.” All but a couple of states have directed that all of their electoral votes will go to the candidate with the greater number of statewide votes. The question is, what happens if legislators decide they cannot say with confidence who won the greater number of votes?

Such controversies have arisen before, as in 2004, when Democrats objected to counting Ohio’s electoral votes due to voting irregularities. The greatest controversy occurred in 1876 after a close, heated election between Republican Rutherford Hayes and Democrat Samuel Tilden. Like Biden, Tilden won the popular vote and more electoral votes (184, to Hayes’s 165). The problem was that rampant fraud was alleged in Florida, Louisiana and South Carolina. (For example, South Carolina reported 101 percent of voters voting). The controversy led to rival sets of electors being sent to Congress. A long fight led to the improbable election of Hayes as president.

For Trump to pull off a similar maneuver, he would need the cooperation of Republican state legislators. He also would face collateral litigation over who should certify electors — a state’s governor or its legislature. In Bush v. Gore in 2000, the Supreme Court ordered an effective halt to further litigation, but that was just one state. It is possible that such multistate litigation could push the challenges beyond the end of the safe-harbor period for certification on Dec. 8 or beyond Dec. 23, when those votes are supposed to be submitted to Congress. Indeed, it could force a fight on Jan. 6, when Congress gathers in joint session to count the votes.

The electoral ‘reactor’

Only then would the action make it into the “core reactor” equivalent of our constitutional system — the joint session of Congress. This would trigger a law passed after the Hayes-Tilden election. Unfortunately, the Electoral Count Act (ECA) of 1887 is hardly a model of clarity and would become the focus of litigation itself. Under some circumstances, Vice President Pence could issue a ruling in favor of Trump, but one senator and one House member could challenge his ruling.

What if there were insufficient votes overall to elect a president? This is where we could see a rare court intervention in a contested election in Congress. The ECA is ambiguous on what it means to have a majority of electors; it does not clearly state whether a majority of “electors appointed” means a majority of the 538 electors (270) or simply a majority of those electors accepted or successfully certified (allowing election with less than 270 electoral votes). There also are untested terms and provisions, ranging from the weight given to the decision of governors and the meaning of what is “lawfully certified” or whether votes were “regularly given.”

There also is the potential under the 12th Amendment for a “contingent election” when there is a tie or insufficient votes. In such a case, Trump could win again. In that case, the vote for president is held in the House based on state delegations, not individual members. Republicans likely will control a majority of state delegations in the House, despite having fewer seats overall — as well as the Senate, where Pence could be reelected.

Again, that is all quite a long shot — a bit more than Luke Skywalker’s boast that he could sink it because he “used to bull’s-eye womp rats in my T-16 back home.” It is enough to make an Ewok weep. All one can say, to paraphrase Han Solo’s parting words before heading out for Death Star, is “Hey, Rudy. May the Force — and the ECA — be with you.”

They canned Powell today which looks pretty bad. She was dropping bombshell statements only to now get sent packing? Without proof of voting fraud and relying on legal maneuvers to stay in office is going to ignite a national firestorm. Is that what Trump wants? Does he have an ulterior motive? Is this the 3D chess I hear he plays?

I dunno. Seen elsewhere – if she is officially part of the team, then she is bound by bureaucratic constraints, specifically funding. If she is not officially part of the team, the she has more freedom to maneuver.
May be the case, may not be….need to watch and see how it pans out.

Trump just told the GSA to go ahead with opening the doors to the Biden administration. Trump did so to remove pressure from the GSA director, Mary Gibded, who was receiving death threats against her family, herself and even her pets. This is beyond wicked and for such cruel and heavy handed mafia tactics to be employed against anyone who defies the will of the communists is unconscionable but also predictable.

In her letter to Biden she wrote:

“I have dedicated much of my adult life to public service, and I have always strived to do what is right. Please know that I came to my decision independently, based on the law and available facts. I was never directly or indirectly pressured by any Executive Branch official—including those who work at the White House or GSA—with regard to the substance or timing of my decision. To be clear, I did not receive any direction to delay my determination. I did, however, receive threats online, by phone, and by mail directed at my safety, my family, my staff, and even my pets in an effort to coerce me into making this determination prematurely. Even in the face of thousands of threats, I always remained committed to upholding the law.”

That’s it. I’m sure some lip service will be paid to the ongoing legal endeavors but if you’re smart you will start defcon one now. The Republic is lost.

The states are now certifying the votes, so it was beginning to look like she was intentionally obstructing Creepy Old Joe. It is one thing to say the networks do not determine the next president, but quite another when the states actually show them to be correct through their certifications.

The strange thing is we’ve heard about watermarks, we’ve heard about Postal Workers testifying about changing dates, states like mine (MI) stopping the vote count with Trump allegedly in the lead and when counting is resumed all votes are for Joe, now I’ve seen video that the Army has the server from Germany that created the vote switch and they can trace it back to……..what exactly?
If the server exists then why all this posturing, and the hope for a technicality, get it the fuck over with or just stop.

It seems to come down to court decisions and it makes you wonder if the judges will stick to the letter of the law or be creative. There appears to be a lot of stuff in this election that is unconstitutional or breaks state laws.

I’ve been a Las Vegas odds maker and sports gaming expert for four decades- long before I became known as a nationally syndicated conservative talk show host. I understand odds and gambling in a way that no other conservative media personality, host, or politician in this country could.

And I can tell you something is very wrong with this presidential election. It reminds me of a fixed football game. Remember the famous fixed 1978 game between the New York Giants and Philadelphia Eagles. The Giants quarterback handed the ball off. The running back didn’t want it. It fell on the ground. Herm Edwards of the Eagles picked it up and ran it into the end zone with seconds left for a last second victory. Every bettor in the world knows that game was fixed. It doesn’t matter if you can prove it. We all know.

Gamblers also feel the same way about this presidential election. This presidential election is rancid. It feels as fixed as that Giants-Eagles NFL football game. Let me give you the details of this election- from a gambler’s perspective.

Trump entered the night a 2 to 1 underdog. As soon as the polls started to close and the picture became clear, Trump’s odds quickly moved to even money. Then Trump became the slight favorite. Then a moderate favorite. Then a 2-to-1 favorite. Then 3 to 1. 4 to 1. 5 to 1. 6 to 1. 7 to 1. Finally, Trump moved to 8 to 1 favorite.

What does all this mean? Bettors putting their money on the line during Election Night have always proven to be deadly accurate. Smart bettors can clearly see what direction a race is taking. Bettors around the world clearly saw what I saw, when they stared at the electoral map- Trump was headed for an electoral landslide.But something wasn’t quite right. Fox News wouldn’t call Florida for Trump- even though he was ahead by a mile. They wouldn’t call Ohio- even though Trump was ahead by a mile, They wouldn’t call Texas- even though Trump was ahead by a mile. I sat there screaming at my television.

More strange calls. Fox News had called Virginia for Biden at the start of the night- with Trump well ahead in Virginia. Trump would remain ahead in Virginia for three long hours after Fox awarded the electoral votes to Biden. Why would they do that? What was the rush? It made no sense.

Biden was awarded Virginia with Trump ahead. But Trump was ahead by a mile in Florida, Ohio and Texas, yet Fox News refused to award him the electoral votes. I knew at that moment, something was wrong. Something smelled fishy. Something was rotten in the DC Swamp.Bettors witnessed Trump dominating. He clearly won not only those key states of Florida, Ohio and Texas, but Trump also enjoyed large leads in the entire Midwest- Pennsylvania, Michigan, Wisconsin and Iowa. It was all but over. Trump had an electoral landslide. Hence the massive 8 to 1 odds in favor of Trump.

And then it happened. It was the most bizarre call in Election Night history. Fox News called Arizona for Biden. Why? It wasn’t even close to over. There was no reason on earth to make that call. Arizona is STILL not over 8 days later. CNN still hasn’t awarded Arizona. ABC pulled it back from Biden only 24 hours ago.

Why would Fox News be in such a rush to call Arizona for Biden? At that moment, Trump’s odds crashed almost instantly from 8 to 1, back down to 2 to 1. That drop set off alarm bells. My friend who is one of the biggest bookmakers in the country called me to say, “Wayne, something is wrong. I’ve never seen a drop like that, let alone a drop that fast. How can Trump go from 8 to 1, to 2 to 1. Someone knows something. We’ve got a problem.”

It was as if someone had decided in advance to give Arizona to Biden- whether he won it, or not. It was as if the secret code was known to only a few billionaire gamblers, “Fox News awards Arizona to Biden.” Six magic words. Someone was ready for that call. Someone waited until Trump was a prohibitive 8 to 1 favorite, then knew to bet millions of dollars on Biden at the longest odds of the night. Someone knew the fix was in. Someone made a fortune.

There’s more to the story. First, by awarding both Virginia and Arizona to Biden way too early in the evening and also going super slow awarding states to Trump where he led by a mile, Fox News made sure Biden had the electoral lead all night. That’s another big part of the story. Just like the fake pollsters suppressed Trump voters for months in advance of the election with polls falsely showing Trump losing by a landslide, fake “news desk” employees sure appeared to be suppressing Trump votes on Election Night. And also creating an air of invincibility for Biden. If Biden led in every poll before the election, and led all night in electoral votes, then it wouldn’t look like a fix was in, when Biden suddenly wound up the winner the morning after. Right?

One more piece of the puzzle. From almost the moment that secret code “Fox News awards Arizona to Biden” was spoken, three key Midwest battleground states with Democrat Governors all decided to stop counting votes for the night, with Trump way ahead. Why? Why all three, at the same time? Like they were coordinated in advance. Wisconsin, Michigan and Pennsylvania all mysteriously quit counting around midnight.

To add to the idea of a fix, these states merely claimed they were stopping counting for the night. After TV cameras and Republican poll watchers were all sent home, these Democrat states all resumed counting, suddenly finding all the ballots they needed to overcome large Trump leads.

I actually took screen shots before I went to bed. Trump was winning Michigan by over 300,000 votes when they stopped counting. He was up in Wisconsin by over 100,000. In Pennsylvania he was up almost 700,000 votes. But in the wee hours of the morning I took a new screenshot. Suddenly Biden was up by 9,000 in Wisconsin and 30,000 in Michigan. How’d that happen? I thought they stopped counting?

It all started with that bizarre Arizona call by Fox News.

Folks, someone knew. The fix was in. A few key people made millions betting on this election. They knew the exact minute to jump in. They knew exactly when a Trump landslide would turn to a Biden victory, with the help of a fake TV network call and fake ballots.

They knew Arizona was going to be called way too early. They knew that fake Arizona call would trigger vote counting to stop and massive ballot fraud to begin.

I don’t know what the Supreme Court will decide. But bettors all over the world know in our guts exactly what happened. The fix was in, no different than that famous NY Giants-Philadelphia Eagle fix in 1978 at the Meadowlands.

Trump was robbed. This election was stolen.
