Can employers make COVID-19 vaccination mandatory?

A judge has just ruled that universities can require students be vaccinated. In this case the judge was ruling on a lawsuit brought by some Indiana University students. He ruled that the Constitution does not guarantee the right to attend a university. He said that students could choose to attend another school without such a requirement, or could choose not to attend at all. But he was clear that no Constitutional right to attend university exists. As a matter of interest, he was a Trump appointee.

I have opined previously that I believe employers will be able to mandate vaccines, and I further stated that there are legal reasons which may make it prudent that they do so. Laws and regulations may change on this going forward.

My reasoning is as follows:

Laws require an employer keep a safe workplace. If an employer allows unvaccinated employees in, and they spread the virus, and someone is injured and/or dies, the employer is almost automatically likely to be deemed guilty for failing to keep a safe workplace. I would not like to be in that employer’s shoes if that happens. As a business owner, I hated risk, and did almost everything possible to minimize it. Balancing risk versus reward was my most important job.

So, given what a believe is a real risk to the employer if it allows unvaccinated employees, the question becomes, can an employer mandate employees be vaccinated? I suggest the likely answer to that is yes, because:

1) there is no Constitutional right to employment. As above re universities, the employee can go elsewhere.
2) at will employment exists most everywhere, and requiring vaccination does not seem to be in violation of the at will exceptions, to my knowledge.
3) in my experience, courts are hesitant to involve themselves in situations where the employer claims there actions are to ensure a safe workplace. Courts do not have expertise to overrule employers in these matters, and they also do not like injecting themselves in the running of business.
4) employers have broad authority to mandate workplace safety process and procedure. They are rarely overridden in this when establishing requirements, generally only when failing to to do so.

Each employer will have to evaluate their risks. Many will unable to survive an exodus of employees, which will have a heavy weighting in their decisions. Others, especially owners of small businesses, may have great appetite for risk. Some older business owners may well not take any such risk, as they could not have time to recover their loss. Some will decide that the risk of losing employees and the costs thereof may be bearable but a catastrophic claim for a workplace death would not, and treat it like insurance costs: pay a smaller sum to insure against a minuscule chance of a catastrophic claim.

It will be interesting to see which way big business goes on this. The large, left leaning woke businesses would seem to be likely candidates to mandate the so called vaccines.

But based on what we have seen to date re the university ruling, which will likely be appealed, I expect that employers will legally be able to mandate their employees be vaccinated.

If it’s a small employer, then they’ll be held accountable to make sure to get rid of the last of them, if it’s an Amazon type, then it will be the responsibility of the employee.

If an employee is forced to ‘vaccinate’ with an experimental drug that hasn’t been proven or tested for safety then the employer should be liable for harm caused. As with anything else these days the law no longer exists in any real context unless the plaintiff belongs to a certain political party and has melanin enriched skin color. The Constitution is a quaint and antiquated document and no longer required so mentioning it in any legal context is also quaint and antiquated. Witness the Antifa and BLM non-prosecutions for riots and murder and destruction of property and compare that to the treatment of those who ‘stormed’ the Capitol and are now held in solitary and inhumane conditions for over six months and counting.

1.) — WHY would an employer be “almost automatically likely to be deemed guilty for failing to keep a safe workplace”? The CDC estimates there were “34,200 deaths during the 2018–2019 influenza season”.

Why didn’t employers force employees to get flu shots prior to Covid-19? I don’t recall reading about any employee’s family suing an employer because their loved one died … and then blaming the employer for not forcing them to get a flue shot. I suppose the concept of Personal Responsibility died in 2019.

2)- The employer could be protected by the passing of a simple common sense law …. that they are NOT responsible for what always has been YOUR responsibility regarding your health.

Is there anyone here who does not fully grasp that the Constitution is a dead letter?

It was written to insure protections against an overreach by the government, but it never fully anticipated the current program of stripping rights from people by corporations or collectives backed by the government. Once those in power discovered the loophole they simply took advantage of it by surreptitiously creating corporations, entities and individuals to front for them. Things like Facebook, Google, Twitter, Amazon, Tesla, etc are not creations of individuals, they are cutouts manufactured with State/Banking cartel financing and tech then deployed as if they were organic with plausible cover stories to make it look legitimate. Then when they do every single thing that the Constitution forbade the government from doing they could throw up their hands and say, wasn’t us.

The technical aspect of this coup/revolution whatever word you want to use for the takeover wasn’t all that sophisticated, it simply relied on the corruption of the justice system from within by selective appointments of compromised judges, lawfare controlled by a select few individuals at the top Universities, and a fully converged media to provide cover. Meanwhile the rubes built their own dossiers on FB so if they ever got out of line a complete Venn diagram of their connections to others would prevent any type of organized resistance, cell phones tagged them in the same way livestock are chipped and control over food supplies- and the slow poisoning which leads most of those addicted to their offerings- fully dependent upon the pharmaceutical industry to straightjacket their minds and bodies fully.

But to suggest with a straight face, even in jest, that this is a matter of private companies is naïve in the extreme. This is happening with complete command and control out of the chambers and courtrooms of the Federal and State governments which have long ago fallen into the hands of some very evil and calculating individuals with a very long range plan.

No parchment can protect you, no laws or rulings will ever come out in your favor. This is the very definition of a rigged game and those who continue to labor under the misapprehension that we live in a nation of laws, a republic, whatever system may have once existed, is delusional.

My corporate overlords have decreed that the unclean unvaxxed must continue to wear masks and social distance while those who have taken the death jab and have the the special sticker for their name badge do not have to adhere to those rules.

If the country is breaking up, it may be good to be able to go where the sane people are quickly. Nice to be able to travel around while I hunt a tribe or a place to invest in and go to ground. Don’t have one now.

Still, it’s hard to do this when you are nearly sixty. It’s been a comfy time nestled in the coils of the corporate machine as I have been. It wasn’t hard. These days, if you are competent, it’s like being the one-eyed man in the land of the blind. As soon as the accountants take over, lowest common denominator thinking and hiring is always the end result.

I’m cool with it though. Was tired of that job anyway and tired of corporate wage slavery in general. I keep thinking about the Morgan Freeman line in Shawshank where he talks about “the excitement only a Free man can feel at the start of a long journey whose destination is uncertain.” I have missed that feeling for a while. I have felt it before and faced whatever waited at the end of the journey with open eyes.

And I still will sleep well. My conscience is clear. Other than the meat suits we use to haul our interfaces around, what do we really have other than our principles and morals? I’m not sacrificing mine to fear and willful ignorance.

I was fortunate to have a banker grandfather who taught me exactly that. My son, his wife and my three grandchildren live in a house that I had built for them on my property. He has a business with no debt because he saved quite a bit of money and I matched it to purchase the necessary equipment for his business. That´s how it should be: family, family and family. A customer of mine’s father in law’s employer ‘incentivized’ their staff to get the jab by paying every member of the business $1000 to take it. Their reasoning being that it was cheaper to do that and be preventative than to have folks get sick and have the business shut down for weeks.

Father in law got the jab and it made him sick. A few weeks later he died from the side effects. His body couldn’t fight it.

Our provincial government has distanced itself from any vax passport talk for legal reasons. Businesses, assuming they don’t want to get sued, should too.

Do you think that the FDA review will be in good faith?

Decisions in large organizations are no longer made based on logic or any sort of objective rationale. It’s all about appearances and PR. And the government is the worst of all.

Who will be the one at the FDA to review a product that 100s of millions of people have already taken, and then say “no, it isn’t safe”. No one will do that.

If there’s a review, FDA approval is a foregone conclusion. They’ll put together a committee, which will conveniently absolve any individual of any responsibility in the outcome or side effects. Then they’ll approve it. That doesn’t mean that the shot is safe. It’s just another marketing tool for Pfizer.

They may punt, though, and just extend the review out indefinitely. If I am them, I fall back on the fact that there has been no rigorous gathering of information that would be needed to corroborate effectiveness or negative side effects.

Once it’s approved then the EUA argument becomes moot. It’s only a matter of what timing is best for providing approval. Approval will probably happen as quickly as they can ‘prove’ it’s safe for kids 11 and under, especially if any ‘outbreaks’ occur in schools. It will be interesting where the school outbreaks occur and how the MSM can propagandize it to instill more fear into everyone.

When humans develop something, invent a new tool, visit a previously unknown location it is their nature to continue the use/exploration/exploitation of those skills/resources/avenues.

In the case of the Moon exploration as well as the nuclear weapon system suddenly, for no apparent reason mankind altered its very nature and opted out.

You may not find that to be of merit but I think it is telling.

In both of those cases the programs were linked inexorably with military efforts to defeat a perceived threat. I don’t know how much you’ve studied warfare, but one of its central pillars has always been and continues to be deception. Convince your enemy that you have a weapon, tactic, strategy, resource that you do not actually possess so that you can win without actually having to use it or prove your capability.

The longer that I live removed from the jingoism, politics and media influence and the more I observe about innate animal nature, the more I begin to question the mythologies of our culture and dismiss the boasts and claims of the overlords.

Their own actions and words betray them and the failure to observe any historical behaviors of their species leads me to these conclusions.

I do not expect anyone to accept these hunches on face value, I have no interest in promoting them beyond the sharing of my opinions on a rather obscure platform out here on the edge of popular perception and I certainly do not accept your prohibition as writ.

Let me state categorically for the record that I could easily be incorrect about any of these conclusions and once someone could prove to me beyond a shadow of doubt that they are in fact incorrect I will openly proclaim the error in my thoughts and stand by whatever new information I have come across. However, as you know I have a pretty fair record for calling out narrative falsehoods based solely on hunches. Not because I am particularly smart or well informed, but because I know a great deal more about human nature and behavior than most people and I have no concern over how it makes me look to challenge long accepted narratives.

It is nice a Judge actually read the Constitution. Indeed that document covers the actions of the Federal Government. There is nothing in the document enabling most of the actions taken by government and it clearly lists the STATES make the rules in their jurisdiction.
What makes the waters murky is when the Federal gubmint uses its power to “incentivize” employers. We have seen the unholy alliance between Falsebook and the POTUS to censor, blacklist and ban people with ideas not of the government line. This is no longer a free employer looking out for itself and its customers but an arm of the government propaganda apparatus.
The school has a right to set standards for their students. However, the schools have spent decades creating a niche for themselves. Many jobs from accountant to engineer to physician require a college degree. The days of passing the rigorous exams are long gone. So does this make the school no longer optional as the Judge suggested?
People need to stop looking to the Nanny Federal Gubmint for permission. This is a State issue and had nothing related to the US Constitution. Always remember, if 9 people can give you a right, then 9 people can take it away.

John Galt is winning. Many people no longer want to work because there is nothing satisfying in it. Forcing people to do things they don’t like to do will drive them away. Many people fear the vaccine and forcing people to take it for fear of losing their job is going to backfire on any employer who tries it.

I know of one particular corporation; I won’t name them, that is losing customers because they no longer allow customers in their stores to purchase products. One has to call ahead and order what they need then drive up to their store, and someone comes out in a mask and gives them what they ordered. I am one customer among others I know that no longer purchase from them.

Speaking of the courts; well they are a joke. Many people have lost faith in the administrative courts. I have completely lost faith in them.

There are many skilled people dropping out of the work force at present. With less and less skilled people in the work force any employer who thinks he can bully his work force into taking this experimental vaccine will be cutting his own throat.

Many people can see when they look that the economy is in trouble. Many large corporations are not making profits. They are selling stock on wall street so they have money to operate. Someone or entity; probably the federal reserve, is buying their stock. Yesterday the stock market dropped over 600 points and today the stock market gained over 600 points. This is the pattern with the stock market for over a year and a half now. What is going on with this in a failing economy?

With the economy failing and more people not being able to purchase the necessary items they need for survival I will not be surprised to see what is now happening in South Africa to happen here in our big cities. A nightmare is unfolding and many are getting caught up in it.

My military mind is telling me we are experiencing bio warfare. Healthy people don’t need a shot to survive it. Unfortunately there are many unhealthy people in this country that are subject to be affected to it. But they don’t need this vaccine to fight it. They need to get healthy.

We are at war but it has not yet gone kinetic. We have a failing economy and it is currently being propped up by excessive money printing and the billionaires are buying up all the tangible assets. Reminds me of what happened when the former soviet union failed.

So who cares if some employers want their employees vaccinated. They are pissing up a rope; a rope of their own demise. We have bigger problems than this fake pandemic. And it is becoming more evident as the days and weeks go by.

When it all crashes the people behind this fake pandemic will lose their power over the people. This nightmare will pass just like the nightmare of WW2 passed and those who committed the atrocities of that war were tried and executed.

Those that have faith in their own consciousness to get them through this period will see freedom. Those that have hope in the government to save them will have neither security nor freedom.

I saw an article around the first of July concerning “leaked info” where Army officials told commands to get ready for military mandatory vaccinations in September. The article also stated that the vaccines were expected to be **approved by the CDC** for “official use” and taken out of the experimental stage. Apparently, there is a process to go through and several vaccine companies have already started the process. It sounded like they expect it to happen in August but could be delayed.

Courts will, most likely, leverage existing case law to support mandating vaccines. That being said, in the Indiana case the judge (to my knowledge) didn’t comment on the fact that, while there is no Constitutional right to a college education, there is no Constitutional right to a risk-free environment or mandating certain health treatments. The fact that the vaccines are experimental at this point means, per the Nuremberg Code, there are serious questions surrounding mandating them. Secondly, what is the thresh hold for risk here? Can employers mandate flu vaccines? Hepatitis shots? TB tests? Mental evaluations? Employees that work on valuable accounts and must be depended on — can an employer demand that they get colonoscopies, regularly check their blood pressure and glucose levels? Can airlines demand that pilots and crew members have their appendix removed before working on long, oversea flights? Third, if students have financial aid or are advanced in their studies at a college or university, they should then be able to sue said schools for essentially changing the terms of their education: if a U of Indiana third-year has a full-ride scholarship and is now required to go elsewhere due to a mandated vaccine, that burdens and harms them, especially if they haven’t had time to take action in anticipation of the policy. Here is a tort waiting to happen. Lastly, if others are vaccinated and, per the claims of the vaccine proponents, they offer protection in whole or part, who, then, is really at risk? Surely not the vaccinated — right? So, the unvaccinated accept the risk — end of story.

Two questions (since I’m looking at termination in September over vx requirements)…I understand the “right-to-work” situation, at-will employment and all that, but there are limits, especially with respect to medical procedures and bodily autonomy. An employer cannot require you to have an abortion, for example, or be strip-searched to ensure workplace safety. How is that linedrawn, and how to argue that invasive procedures must be over the line?

I’m also wondering about the feasibility of making an argument that since the VX does not have an established efficacy in preventing transmission, it cannot be substituted for demonstrating an absence of CV infection. Therefore, if the goal is to provide a zero-transmission environment, the only real legitimate strategy is daily testing prior to admission. Which the employer would need to provide at least as an alternative. Thoughts?

It also has an entire chapter on “emergency use authorization,” in which we immediately see that (a) this is not a legitimate ’emergency,’ and (b) the authorization is illegal because alternative treatments do exist.
