Supersized IRS Will Shrink Liberty

West Virginia Senator Joe Manchin recently claimed the 15 percent corporate minimum tax contained in the Inflation Reduction Act, which should be called the Inflation Creation Act, is not a tax increase. Instead, he claimed, the bill simply closes a loophole that allows corporations to avoid paying all the taxes they owe. Despite what Senator Manchin says, the fact is the new minimum tax increases the amount of money some corporations must hand over to the government; in other words, it increases their taxes.

It is common for politicians, policy wonks, and even some libertarians to demonize loopholes for making the tax system too complex, but loopholes are simply ways that individuals can keep more of their money. Loopholes are thus pro-liberty and pro-sound economics.

In addition to raising taxes, the Inflation Reduction Act provides 80 billion dollars to the Internal Revenue Service (IRS). Some of the money will go to improving taxpayer services so, for example, taxpayers may actually talk to a real person who can provide information about the tax law when they call the agency. But, over 50 percent will be spent on enforcement.

The IRS is expected to hire approximately 87,000 new agents. Supporters of the expansion say the IRS will use the enhanced enforcement capacity to target only “the rich.” However, it is not necessary to massively increase the IRS’s enforcement capacity just to go after “rich tax cheats.”

Furthermore, rich people and big corporations can hire attorneys and accountants to make sure they limit their tax liability while staying within the legal limits. They can also fight any attempt by the IRS to make them pay more. Middle- and working-class Americans are unable to afford legions of attorneys and accountants to limit their tax liability or fight the IRS, so they are more likely to pay whatever the IRS demands.

The IRS has a history of disrespecting due process rights of Americans, so creating a new army of IRS agents with a mission to extract more money will lead to massive liberties violations. Given the IRS’s shameful history of harassing the political enemies of whoever holds power at the moment, we should expect the new agents to target opponents of US foreign policy, gun control, government promotion of green energy, and other policies of the current administration.

The IRS recently ran an ad seeking agents who are willing to carry a firearm and use deadly force. This comes after the tax agency’s purchase this year of 700,000 dollars worth of ammunition. Perhaps the agency is worried that the latest attempt to get more taxes from Americans already suffering from the inflation tax will lead to violence, or perhaps the IRS wants its agents to carry firearms to remind taxpayers that the tax laws are backed by the threat of government violence.

The premise behind the income tax is that the government is the true owner of all property and thus has the right to take as much from the people as it desires. Therefore, the income tax, like the other monstrosity created in 1913 — the Federal Reserve, is incompatible with a free society but necessary for an authoritarian welfare-warfare state. To avoid 1984, repeal 1913.

The new 15% corporate AMT (alternative minimum tax) is supposed to override tax credits. Tax credits (bribes) should not exist for individuals or corporations. They exist only to bribe people or companies to do things that make no intrinsic sense.

It is a shame Mr. Paul does not read his emails [nor does his father] or the comments to your post of his words. I stopped paying income taxes in 1978. I have been in the court system on many occasions.

THE INCOME TAX IS A SCAM

If a tax upon the labors of a Sovereign Citizen properly existed, it would authorize the subordinate government to seize 100% of an individual’s earnings. ‘Reasonable’ is not a judicial consideration. Such a law would authorize slavery. No such law exists.

LIBERTY, enshrined in the 5th and 14th Amendments, include the Citizen’s opportunity to Pursue a Livelihood as a fundamental Right. Such Rights are not suitable objects for taxation.

26 USC #1 authorizes an income tax on the “taxable income” of an individual. ‘Taxable income’ is not defined. If you wish to donate to the government, they will take your money—and demand more. [87,000 new IRS agents are getting hired to harass ‘terrorists’]  This statute is never alleged to be violated in an indictment.

26 USC #871 imposes an excise tax upon “non-resident aliens” for the privilege of being permitted into the USA.

Violations of 26 USC ##7201-7215 are frequently alleged in indictments. The Supreme Court, relying upon the Congressional Record, has identified those penalty statutes as applying to all taxes in Title 26. They cannot allege ‘violation of a legal duty’ as required for a valid indictment.

The IRS relies upon a citizen signing a tax form, under oath, over the caveat of “taxpayer’s name” to identify you as legal responsible for a tax. You have just sworn that you legally owe a tax. The court accepts your affidavit. The income tax is a scam.

Lawyers who aggressively make this claim face lose of license and HAVE been sent to jail on bogus charges.

State courts have repeatedly covered up similar challenges to state income taxes, earnings taxes, and occupational licenses, to avoid an exempt precedent from becoming established.

IRS Exempt Tax form #4852 has been claimed by Pete Hendrickson as successfully recovering prior years’ income taxes erroneously paid to the IRS.

WARNING: The location of the “burden of proof” is critical. Due Process requires the Petitioner to prove the validity of any claimed authority. [Beware of Administrative Reviews.] If the BOP can be shifted by the court to the citizen to prove the tax authority does not exist, they will require proof that there is no possible way the tax might be valid. Such a proof is impossible. This shift doomed the Springer case. circa 1870’s.

I have not read the relevant statutes regarding the creation and powers of the IRS enforcement division, so must caution as to the accuracy of my comment here. It seems to me that it is important to know that the IRS enforcement division is not just accountants with guns. It is a fully authorized law enforcement agency. That means that the federal authorities have an additional multi-thousand police force at their disposal to respond to civil ’emergencies’ anywhere around the country. That offsets the ability of the States to withhold cooperation with federal agencies if requested (state and national guards). They are increasing their ability to defeat what they will describe as rebellious actions by the people. Our democracy has evolved into a dictatorship.

Don’t forget — this 15% minimum tax is another foreign NGO agenda being pushed … I believe by the UN … and recall how President Trump’s predecessor was the one who placed US under the boot heel of these foreign NGOs … which have resulted in, for example, changes in our zoning laws at the municipal level (to push for ‘sustainability’ and ‘climate change’ agendas) and countless other items.

Truly death by a thousand small cuts is in the agenda against US …

How will the bureaucracy, lobbyists and the FSA survive if income taxes are ended? Government would have to return to enumerated powers.

First & foremost, businesses & corporations DO NOT PAY TAXES. The extra $$$ they send to the Federal Goobermint is just another cost of doing business & is passed along to those who avail themselves of theri products & services, ie. the consumer. ANY tax increase is totally born by the consumer……..Econ 101….use your fricking head for something besides a hat rack!!!!!

Loophole is just the word criminals use when they find a way to tax you that wasn’t thought of before.
To them breathing air is a tax loophole.

Large Corporations paid good money buying politicians so they could get those tax write-offs and avoid taxes. How dare CONgress not live up to their end of the bargain!
