Biden’s ‘Infrastructure’ Bill Contains Backdoor ‘Kill Switch’ For Cars

Buried deep within the massive infrastructure legislation recently signed by President Joe Biden is a little-noticed “safety” measure that will take effect in five years. Marketed to Congress as a benign tool to help prevent drunk driving, the measure will mandate that automobile manufacturers build into every car what amounts to a “vehicle kill switch.”

As has become standard for legislative mandates passed by Congress, this measure is disturbingly short on details. What we do know is that the “safety” device must “passively monitor the performance of a driver of a motor vehicle to accurately identify whether that driver may be impaired.”

Everything about this mandatory measure should set off red flares.

First, use of the word “passively” suggests the system will always be on and constantly monitoring the vehicle. Secondly, the system must connect to the vehicle’s operational controls, so as to disable the vehicle either before driving or during, when impairment is detected. Thirdly, it will be an “open” system, or at least one with a backdoor, meaning authorized (or unauthorized) third-parties can remotely access the system’s data at any time.

This is a privacy disaster in the making, and the fact that the provision made it through the Congress reveals — yet again — how little its members care about the privacy of their constituents.

The lack of ultimate control over one’s vehicle presents numerous and extremely serious safety issues; issues that should have been obvious to Members of Congress before they voted on the measure.

For example, what if a driver is not drunk, but sleepy, and the car forces itself to the side of the road before the driver can find a safe place to pull over and rest? Considering that there are no realistic mechanisms to immediately challenge or stop the car from being disabled, drivers will be forced into dangerous situations without their consent or control.

The choice as to whether a vehicle can or cannot be driven — for vehicles built after 2026 — will rest in the hands of an algorithm over which the car’s owner or driver have neither knowledge nor control.

If that is not reason enough for concern, there are serious legal issues with this mandate. Other vehicle-related enforcement methods used by the Nanny State, such as traffic cameras and license plate readers, have long presented constitutional problems; notably with the 5th Amendment’s right to not self-incriminate, and the 6th Amendment’s right to face one’s accuser.

The same constitutional issues abound with this new technology, but with the added confusion surrounding what Congress even means by “impaired driving.” Does it mean legally drunk, or perhaps under the limit but still “impaired” to a degree? Would police be summoned automatically by the system in order to make that determination? These are questions that should have been addressed openly and thoroughly during the legislative process, not left to later, back-room negotiations between interested parties other than individual car buyers – manufacturers, regulators, insurance companies and law enforcement.

Ironically, or perhaps intentionally, there also is no detail in the legislation about who would have access to the data collected and stored by the system. Could it be used by police, and could they access this information without a warrant? What about insurance companies, eager to know with what frequency their customers drove after drinking alcohol, even if it was below the legal limit? Such a trove of data presents a lucrative prize to all manner of public and private entities (including hackers), none of which have our best interests at heart.

Adding what amounts to a mandatory, backdoor government “kill switch” to cars is not only a violation of our constitutional rights, but an affront to what is — or used to be — an essential element of our national character. Unless this regulatory mandate is not quickly removed or defanged by way of an appropriations rider preventing its implementation, the freedom of the open road that individual car ownership brought to the American Dream, will be but another vague memory of an era no longer to be enjoyed by future generations.

Easy solution. Newest car i ever own will be a 2025. Though a pre emission vehicle thats repairable is prolly a much better choice.

Sold my newer F350 and bought an older 95 F150. No sensors or command modules, nada to spy or backdoored and actually cheaper and more reliable to run.

Not sure of the difference between an ECM and a ‘command module’ … but I know that the 1985 Saab 900S that we had was equipped with a ECM … 

Eric Peters often appears on TBP … and one of his recent articles mentioned the notion that EVs — being so frightfully expensive for the ‘average’ folks — are really meant for only the wealthy … and that ‘the rest of US’ will, functionally, be prohibited from driving.

The WEF has been promoting ’15-minute cities’ … which, in its full operational mode, means that we’re going to be limited in our travels to basically home, work and the ‘programming’ academy — public schools and universities.

Brave New World and 1984 combined to bring US … the future.

For me 2000 is the absolute latest I will drive. Even ABS pisses me off as, at least on the GM products, it cuts in WAY too early.

Have my next four (1994, 1995, 1996, 1999) daily drivers parked in the barn, waiting to be needed. Should be enough to see me out without ever buying any of the new garbage.

But France already is banning older cars from Paris. It will happen everywhere eventually.

My little 1988 sports car will be my Red Barchetta in the end. It is even red.

This feature uses the GPS locator embedded in every OnStar-equipped car or truck sold by the company to coordinate its position with police officers in pursuit and then, at their command, gradually shut down the vehicle’s ignition system.”

I bet that’s not all they can do with OnStar.

First thing with any new GM? Tear out the Onstar antenna.

I’ll never do so though as I would never buy a vehicle that had it or anything similar.

How about some sort of method of preventing signals from reaching the antenna … sort of a Faraday cage?

I’ve got similar questions regarding my ’22 VW Golf GTI and its IQ.drive system … which needs to be disabled (to the extent it can be) upon each start of the engine.

I’ve already experienced its hitting the brakes when the sensors in the front bumpers think that a car nearly 75′ away was somehow a hazard to be avoided …

I’ve been wondering just what kind of bending over VW had to do in order to gain the good graces of our EPA since that whole diesel-gate BS event several years ago … and what kinds of control mechanisms they’re already including in their automobiles.

Remember, too, that 5G and the upcoming 6G are meant to go hand-in-glove with cars that can be controlled by someone other than the driver …

Currently the only safe and effective method of installation is with the 5.56. There might be a slight correlation of the injection and sudden death, possibly but unknown at this time.

To eliminate this possibility there may have to be a study commissioned to determine this. Some are calling this a feature, so you know its working. In the meantime all communists should get the booster installations to be safe.

I need to get my ’90s diesel Suburban repaired.
Diesel lasts a long time and PRI-D keeps diesel from deteriorating.

The Peasant Class will do nothing but Complain and protest.
Then they will go home and submit to what ever Rules the Nobility Class dictates.

The end of private car ownership is on the horizon.

If you are of the “fuck the State” mentality, find a good dual purpose motorcycle. When the cars are banned, these will be good “illegal” vehicles as they can easily disappear into the woods where no cop car can follow.

Of course the Judge Dread drones will probably be in wide use before this happens, so might be pointless too.

Better to fight before they have total control, but nobody cares to. Too busy staring at their rectangular glass addiction.

this is not going to be a problem at all. unless they make the PCM unavailable to the aftermarket including salvage units. This will be a readily available software patch 3 months after hitting the market.

Don’t follow the distraction here. It is not about how you drive but about collecting data to sell. Experion was one of the first credit reporting agencies and made and makes more money selling user data than looking out for credit fraud.
The government is constrained by the Constitution. GM and Ford are not. Same as Facebook and the rest. The game is about gathering data to use for marketing, to control insurance costs, or to find enemies of the tyrants.
While I am confident that some 18 year old will figure out a hack for the backdoor, I am just as confident that your digital account will be frozen if they can’t find your car’s reporting info.

1981 AMC Eagle SX-4.
4WD, rock solid inline 6, Jeep chassis (back when AMC built Jeeps).
No kill switch.

1953 M38A1 (Jeep).
No electronics, save for the condenser.
Will hopefully survive the big kill switch (EMP).

As a truck driver I expect this to be a top ten killer in the southwest. Down there I pass a lot of poor people driving beaters slowly to save fuel. Cops take swerving and hard braking as a sign of impairment, as does the “safety” garbage my company has already tacked onto my truck. Even when this doesn’t cause massive pileups, it’s still going to leave people stranded and unprepared.
