Another statist authoritarian of either the liberal or conservative variety, not much of a difference. This person will twist the very simple language of the constitution to rubber stamp whatever new edict the president and/or congress wants to ram down out throats. There is no other outcome possible.

WASHINGTON — Who could replace Supreme Court Justice Antonin Scalia if Republicans don’t block all of President Obama’s nominees, as appears likely? Here are 10 possibilities:

Sri Srinivasan: The 48-year-old federal appeals court judge was confirmed unanimously in 2013 for a seat on the U.S. Court of Appeals for the D.C. Circuit — a traditional steppingstone to the Supreme Court. He would be the court’s first Indian-American justice.

Patricia Millett: Srinivasan’s 52-year-old colleague on the D.C. Circuit is popular in both parties and is frequently mentioned as a possible candidate. She argued 32 cases before the Supreme Court as an advocate.

Merrick Garland: At 63, Garland is older than most nominees, since presidents want their choices to stick around for decades on the bench. He is a moderate who serves as chief judge on the D.C. Circuit court and could be a compromise choice.

Kamala Harris: California’s attorney general, 51, could be another leading candidate. She has the added luster of holding political office, a life experience that is sorely lacking on the Supreme Court. She’s currently running for the U.S. Senate seat of retiring Sen. Barbara Boxer.

Jacqueline Nguyen: The Asian-American judge, who sits on the U.S. Court of Appeals for the 9th Circuit, has been mentioned frequently in the initial hours after Scalia’s death. At 50, she is the perfect age for a nominee.

Amy Klobuchar: If the Senate would be less inclined to block one of its own, the senior senator from Minnesota, 55, might be someone Obama would consider.

Sheldon Whitehouse: See “Senate” above. Whitehouse, 60, the junior senator from Rhode Island, is a former attorney general of Rhode Island and U.S. attorney with strong credentials.

Cory Booker: The third in a triumverate of senators who could be chosen if Obama wants to put Republican senators on the spot by threatening to block one of their own. Booker, 46, the former Newark, N.J., mayor, has been in the Senate since 2013.

Paul Watford: A judge on the U.S. Court of Appeals for the 9th Circuit, Watford, 48, is another Obama nominee with a potentially stellar future. Some court-watchers expect the African-American judge to be Obama’s first choice.

Jane Kelly: She is a 51-year-old judge on the U.S. Court of Appeals for the 8th Circuit who was a career public defender. From Iowa, she has enjoyed the prior support of Republican Sen. Chuck Grassley, who heads the Senate Judiciary Committee.

From my many years of experience of being unemployed while watching daytime TV and swilling beer, I can tell you that Judge Judy (cerebral legal giant that she is) must not take precedence over the many Persons Of Color that have spent considerable time ‘filling the airwaves’ with their wisdom and unique form of adjudication. This should count for something. Michelle Obama has never really been given a chance in her legal career either. So there are plenty to pick from.

Obama’s whereabouts are fully documented for every minute of the day and night, by the press as well as the appropriate government agencies,with any “secret” meetings glaringly obvious unless they were conducted surreptitiously at the White House.

His absence from there sometime between Friday and Saturday morning -along with any transportation to and from some airport that harbors Air Force jets- would have been noted.

As would have been Scalia’s.

Let’s at least keep conspiracy theories in the plausible realm if we much have them without any current evidence other than speculation to support them.

Maybe Hillary should be appointed, that would make her happy to drop out of the Democrat primaries and make Sanders happy as well with her gone ad nothing standing in his way.

After the election -Hillary’s removal from the race and the probable Republican establishment defeat of Trump giving it to him- Sanders can then appoint Obama as the next Chief Justice after Roberts suffers a sudden and poorly explained death from natural causes.

Everybody’s happy all the way around that way.

At least everybody that counts for anything to the ruling establishment.

Cory Booker ended up on a list for potential SC justice? We’re further down the rabbit hole than I thought! I notice Lieawatha Warren, Loretta Lynch and Eric the Blackheart aren’t on that list.

Obama will nominate someone designed to drive us bitter clingers apoplectic and watch us twist and turn and fuss and cuss. His goal of further dividing America will be achieved no matter the nominee. Sitting Republican Senators will be courted, begged, bribed, pleaded with, bribed and exhorted. They will be ostracized, spat upon, bribed, called names, vilified by the press, dragged through the mud by the press, and bribed. Then, after a “No” vote on Ovomit’s first nominee, the process begins anew with a 2nd, equally unacceptable – possibly even more pungent than the first – nominee and, to add a new sense of urgency to the bruising deliberations Clarence Thomas is found dead in his chambers, a chicken bone stuck irretrievably in his windpipe.
Now it gets serious. Elijah Cummings is placed under arrest by the House Sergeant at Arms for tampering with the scene before the investigation is complete, having eaten the remainder of the chicken left by Thomas. In his defense, it was still hot. Ovomit’s like a kid in a candy store now, he doesn’t know whether to shit or go blind. Al Sharpton begins a back-channel effort to get his name placed in contention and mounts a PMSNBC defense of Elijah Cummings including a Twitter poll with the hashtag #ChickenChokingJustice4Cumming.

Since there are no white males with both feet firmly planted on the Right up and coming in US bureaucracy or academia , it is most unlikley that there will ever be another Scalia type ever nominated to the SCOTUS.
The next SCJ will be a black women. Probably Loretta Lynch. Diversity is our strength and anti-Americanism is a virtue.

I think it is despicable to suggest that a sitting president with over 20% of his term remaining be asked to ‘refrain’ from nominating a Supreme Court Justice!

BO will nominate the most left-leaning person possible to get confirmed in the next several months — so, a left-leaning ‘moderate’, ultimately confirmed by a narrow margin.

As far as the Supreme Court goes, it will be the next President who is likely to put an enduring stamp on the makeup of the Court — half of those geezers look like they have one foot in the grave already!

Let’s see–we have been given a Mexican in Sotomayer, liberal Jewess with Ginsburg,an Asian man…wouldn’t be surprised if Obama pushes for a Muslim if there is a viable Islamist candidate.
If the Repubs stall or filibuster, they’ll all be labeled xenophobes by the media and anti-Islamic.

Read the article about ex-pats, and I’m no quitter, but a Hitlery presidency, dems taking over the senate and an anti-constitutionalist progressive supreme court majority makes 2016 + look very bleak.

If you get the appointment, consider tapping JQ to do your research and write your opinions. The two of you ought to be able to make the USSC much more interesting to follow than the Philadelphia 76ers or the Eagles.

My boss is just back from a trip to So. Cal. for his birthday. He was playing golf on the same course with Obama when Scalia’s death was announced. He saw Obammy break to speak to the sheople. I asked about security and he said it was apparent but not over the top and added that he could have easily sliced a few in his direction. I told him that I now have less respect for him for not having done so.

Obama will nominate a total leftist judge. He/she will be rejected, or, no hearings at all. By mid-summer, if the Democrat looks likely to win the presidential race, Obama will gladly accept a stand-off, thinking it will help the democrat as a political issue. If by mid-summer, losing the White House seems more probable, then Obama wil replace the brazen liberal with a stealth liberal and try to pry a few weak Republican senators away to confirm the stealth liberal. If the Senate goes into recess at all, Obama may try a recess appointment – likely a black person, trying to suppress Trump’s “unexpected” support among blacks. Bottom line, we don’t know excatly ow this will progress, since it hinges on the ebb & flow of the parties’ political fortunes.

They will trade their constituents’ interests for some special favors and backroom deals from the administration. FWIW,

There are no qualifications for a USSC Justice other than Senate confirmation.

It could be a foreigner or illegal alien and that would be just fine Constitutionally if the Senate approved it.

We should pay more attention to what the Senate approves than who the President nominates for their approval. It wouldn’t hurt to start contacting your Senators now just to let them know what your wishes are.

Of course, those who say elections don’t matter shouldn’t concern themselves with such things (or any political issue at all for that matter).

Abolish The Supreme Court

The Court in Its Present Form Could be Abolished Overnight

If it wished to, Congress could overhaul the Court this afternoon. Nothing more than simple legislation would be necessary to radically change or completely abolish the lower federal courts. Congress could decide what topics fall under the lower courts’ jurisdiction, and thereby limit the Supreme Court’s jurisdiction as well. Congress could also decide that the Supreme court is made up of one justice or 100 justices.

Indeed, since the Supreme Court is nothing more than a legislature, why not make it one? Why not make SCOTUS a body of 50 “judges,” with the understanding that the Senate will not ratify any appointment which does not hold to the rule that each state gets a judge on the Court? Politics and ideology prevent this, but no Constitutional provision does.

“But the court would just declare all those reforms to be unconstitutional,” some might say. That is true, although to that, we need only paraphrase the (possibly apocryphal) words of Andrew Jackson: “the Court has made its decision. Now let them enforce it.”

The Court need not worry, though, since its can nearly always count on the support of the President and the Congress precisely because the Court serves an essential role in augmenting the power of the other branches of the federal government.
