Land Of The Free? Michigan Man Issued Parking Ticket In His Own Driveway

Submitted by Simon Black via SovereignMan.com,

The state of Michigan is not exactly known for its balmy weather this time of year.

And residents reasonably do what they have to do to cope with often extreme winter temperatures.

Last Thursday a man named Taylor Trupiano of Roseville, Michigan did what a lot of people do in cold climates.

He walked out of his house, started his car, turned on the heat, and went back inside for a few minutes while his engine and vehicle interior warmed up.

According to Mr. Trupiano, he was only inside for about 7 or 8 minutes.

But by the time he came back to his car, there was already a parking ticket on his windshield– with a fine totaling $128.

Some local police officer had apparently driven by, noticed the vehicle was unattended, written up this heinous infraction, and left.

There are so many things wrong with this picture it’s hard to know where to begin.

First off, the citation that Mr. Trupiano received was a parking ticket. Yet his car was parked on his own private property.

Let that sink in: this man received a parking ticket while his car was parked on his own property.

You can’t even park your car on your own property anymore without being in violation of some series of laws, rules, or local ordinances.

The city government’s reasoning is that, if you leave a vehicle unattended, it may encourage car thieves to steal it.

This is pretty flimsy logic.

Sure, maybe if a car thief is standing right there he/she may take the opportunity.

But it’s not like some lowlife felon is going to turn the other cheek and stop stealing cars just because there are no unattended vehicles with the keys in the ignition.

Criminals bent on theft are going to steal no matter what, just like some murderous thug in Chicago is going to find a gun and kill people regardless of local firearm regulations.

When the story broke on local news, Roseville’s Police Chief told reporters that his department is unapologetic about issuing the citation to Mr. Trupiano.

Sounding like a man who cares more about statistics than actually catching criminals, the Chief claimed that 5-10 unattended vehicles are stolen every winter, which “drives our crime rates up.”

I looked at Roseville’s crime rates. They’re high. This is not a safe place.

With a population of less than 50,000, there are nearly 2,000 property crime incidents per year.

That includes at least a few hundred car thefts– which means that 5-10 vehicles is statistically trivial.

Clearly this issue of unattended vehicles is NOT the root of the problem.

And even if all the citizens of Roseville never again left their vehicles unattended, even on a cold winter day for just a few minutes to let the car warm up, it still wouldn’t make a dent in the larger crime rate.

But that doesn’t matter.

Roseville’s city government deals with its crime problem by establishing obscure regulations to restrict what law-abiding people are allowed to do in their own homes with their private property.

It doesn’t matter whether you are aware that these ridiculous rules even exist: ignorance of the law is not an excuse.

You’re probably in violation of half a dozen rules and regulations right now without even knowing about them.

Naturally, they’re all for your own good… to protect you against all the terrible choices that you might make as a grown adult.

Thank goodness these people are here to save us from ourselves! Of course, there’s always more work to do.

Speaking of statistically trivial risks, I read recently that falling vending machines kill a handful of people each year. Let’s get rid of them.

Roller coaster malfunctions claim 4 lives each year. Maybe they should ban those too.

Sugary drinks are clearly bad for you. Perhaps they should outlaw those, at least above a certain size.

Oh wait, they’re already trying to do that.

This is what freedom means today in the United Nanny States of America.

Do you have a Plan B?

I wonder what the percentage overall of all “puffers” vs the number of them being stolen because of it is.

Both before and after the laws in question were instituted.

Many laws are instituted to solve problems that don’t really exist and only catch people violating them while doing nothing to actually solve the alleged problem they were intended to solve.

And as a revenue source for the state.

As a resident of Michigan, or any cold state, damn near everybody starts their cars and trucks. My diesel runs for five minutes before I leave and still takes another ten minutes to warm up enough to get the heat flowing, even if I leave the oil warmer plugged in all night.

So, the cops are claiming they ticketed for public safety eh? Then why didn’t the cop come to the door, issue the ticket, and have the man shut the engine off and lock the car doors?

Seems that the “public safety” claim is bullshit since the officer issued a ticket, and then also left the unattended vehicle running, prime for a theft or some other crime.

I’ve lived in the Metro Detroit area my entire life. Roseville will never be confused with Northville but believe me, there are much, much worse places to live in Michigan. Especially in the Metropolitan Detroit area.

This is nothing more than a shakedown for revenue. Legalized theft. The justifying of this by the police chief is laughable as well as insulting! Good grief!! Next thing you know people will be given a ticket for an unlocked door. Wouldn’t want someone to break in and drive up the burglary rate.

There’s a lot of Ferguson,Missouri’s in this country-they just don’t all blowup.
Not sure if that’s a good thing or a bad thing.

Another victimless “crime”, ie tax collection opportunity.

The guy took a risk losing his car to theft, and insurance may well not pay up given the circumstances. It is his risk to take.

Better would be for the cops to charge him a fee if he lodges stolen vehicle report under the circumstances – say $80 per man hour used in looking for the vehicle, or entering details in the data base. The n the owner has the right to do as he pleases, but cops the cost of poor decision-making, which is as it should be.

Disagree on the last part Llpoh.
You should be able to go away for a week & leave the front door open w/o it being burglarized & if it is,not pay a fine for being stupid because the cops have to investigate.
If a female dresses scantily & is raped, would you dare charge her an investigative fee?
These cops are bullies & tax collectors, not public servants.

Tampa – I should be able to walk around the Thirty Blocks screaming “I hate niggers” if I want without getting my ass beat, or worse, but I cannot. It is a monumentally stupid thing to do.

I woman should be able to go out dressed in a napkin, get comatose drunk, and not have to worry about being assaulted. But she cannot. It is a monumentally stupid thing to do.

Leaving a car running, unlocked, and unattended is risky, even stupid in my opinion.

Why on earth should the costs of stupid actions be foisted on responsible members of society? People doing stupid things – things a “reasonable” person knows is stupid – should bear the costs of their own stupidity.

Everything should be about personal responsibility, in my opinion.

Llpoh,
Yes it is stupid to go yelling racially charged words in an area like that, and I’m not sure in that particular instance that you even have the right.
However, the other examples are what I would call passive stupidity as opposed to active stupidity.
If I lean over to get something from the passenger floorboard & cross the center line & hit you, sure I should get a ticket, along w/a suit if I hurt you. However,I caused that.
However,if I simply leave my vehicle running unattended for a few minutes as I did about an hour ago while picking up a pizza at Hungry Howie’s and you steal my truck, why am I at fault?
The guy in the article was on his own property–imho it is a tremendous violation of property rights to ticket him for a passive activity that would never be a problem unless somebody commits a crime.
The only way I could go for this kind of violation of property rights is if it were a highly likely occurrence or if it were preventing a potentially catastrophic situation.
Otherwise put the penalty where it belongs-on the criminal who steals the vehicle.

Tampa says above “I’m not sure in that particular instance that you even have the right.”

Guess he does not understand the First Amendment.

I am against the ticket. But leaving a car running, unlocked, unattended is stoopid, and any costs incurred for said stoopid should be borne soley by stoopid. Stoopid is not a defence against being responsible.

He didn’t get a Parking ticket. He got a ticket for leaving his car running without anyone inside the car, quite a different thing. So, while he is inside for “only” 7-8 minutes, some kid walks by and jumps in and someone gets hurt. Not hard to dream up a scenario where this could go awry.

Okay, I’ll play along. What if NOBODY jumped in, and NOBODY got injured? Why not punish an individual for what ACTUALLY happens, instead of what MIGHT have happened? This could be why so many cops are getting killed on the job, these days…

I was unaware that a policeman could extract money from someone by “dreaming up a scenario.” Kind of puts a new meaning to “serving and protecting.”

The car remains locked while the engine is running.

Nice try there, bootlicker.

I moved to w Texas a couple years ago(from the mountains in CO) and I noticed the aversion my neighbors have to temps below 60. When it’s in the 40s, they’re fully wintered up with heavy coats and hats. The 20s? Looks like a ghost town!

I was washing my truck a couple Sundays ago. It was brisk, maybe 45. My neighbors were having a Cowboy watching party and just about everyone made a comment along the lines that I was crazy as they passed by.

revenue enhancement by state/local/federal leeches is to be understood as OMG the zirp instituted by POCB’s is doing way more than decimating their retirement funds! OMG cry me a fucking river and get a real job that you make a profit in and fund your own fucking retirement !
Just like real people have to do .
I cant force you to buy another hamburger just because I have a budgetary shortfall .
I cant raise your taxes and get into your wallet because I mismanaged my payroll
Fed and state and local fiduciary responsibilities CANNOT be paid at the current levels .
Wait , I apologize, the POCB just called me and said they would print money out of thin air to make them whole!
WOOT !
All is good .
Um wait a sec my eggs just went to $20 a dozen .
My house just went to $200 k
Hmm
Did those items get more valuable or hold on a sec ……… the fucking currency just got devalued again
Give me a fucking break .
Where does it end?
No ideal.
Better produce your own needed items is my thought
Fuck
Isnt their an executive order by oniggrr that says you cant even keep that ?
WTF

The very first night I lived in my Detroit ‘burn home, I received a notice on my door before 8am.

Our last load from our move arrived at our house around 11pm. We unloaded the truck and decided to leave it in our large circular driveway until 7 am, it was a good 20 feet off the road, absolutely not infringing on any neighbor’s “enjoyment” of their property.

The notice, delivered an hour and a half after the truck had vacated the property, stated that the truck would be ticketed, possibly confiscated, if ever found overnight, or for an “extended” time.

The very first night I realized I moved to Nanny Hell.

As for regulated because of the possibility of a future event. Are you all kidding me? Nearly every freaking law, fine, regulation, from beauty school licensing to building codes and mandatory vaccinations are to attempt to control future events that nay not ever happen.

With drug laws we mandate the destruction of a person’s life to prevent the destruction drugs
MAY, or may not, cause.

Control over others is the real problem. And the truth is we all support it in one form or another.

This ticket is just the ultimate proof of where ALL such systems and bureaucracies eventually end up.

Peace all

Dang autocorrect, Detroit ‘burb, not burn.

And Roseville is adjacent to the East side of Detroit, which has the highest crime rates in the city.

Roseville used to be very Italian Catholic, started going Arab in the late ’90s and was always used as the Detroit criminals personal candy store.

I, once, ran a seasonal cart at the Roseville Mall. Found out then that big city cops could be as worthless as small town ones.

Sheriff:
“This is a good law, it will ensure that drivers are cold and miserable and will be fumbling with the heater controls, and we can get them for distracted driving on that, Plus the engines will not be lubricated properly before use, so my brother Earl will finally get some good engine work, these damn imports never break down”

Deputy:
“we gotta save them from themselves”

And this is just another example of why these states keep showing up on top lists of the most citizens leaving for western states. This is nothing more than revenue collecting. Pure and simple.
IF the PD in this city is not just a revenue collection arm of the local government or make work program for “officers”, they should promote some of these officers to Homicide or Burglary and have them investigating real crime. The beat cops should be out meeting citizens, and concentrating on crime prevention, not revenue collection. I am a lot more concerned about the negrow with a knife than about the commuter that may be exceeding the speed limit to get to a meeting on time. However, and here is where the rubber meets the road; the risk to reward equation for the cops, AND the officials is far better in pursuing revenue collecting than trying to stop real crime. Cops get shot when they deal with bad guys, or confronting an actual criminal. They rarely get shot doing a drive-by-ticketing like above, or pulling over a white guy in a Camry. When the government turns from an organization that serves the people, to an organization that serves itself, all of the above and worst manifest.
