Arizona Cop Acquitted for Killing Man Crawling Down Hotel Hallway While Begging for His Life

A true copfuck hero. We should honor these brave thugs in blue? How could a fucking jury acquit this motherfucker?

Arizona jurors watched the video below, which shows former Mesa, Arizona, police officer Philip Mitchell Brailsford shooting and killing a man who was begging for his life and attempting to follow the officer’s orders to crawl down a hotel hallway.

Yesterday, the jurors found Brailsford not guilty of second-degree murder and reckless manslaughter. Do you agree? (Warning: The video is pretty graphic.)

The incident occurred in January 2016. Daniel Shaver apparently was showing off a pellet gun, and it was visible through the hotel room window. This promped somebody to call to the hotel front desk, which prompted a call to the police.

So it wasn’t unreasonable for police to approach the hotel room thinking the encounter might be dangerous. They knew there was a gun there, and they didn’t know it was a pellet gun. But that video shows some truly baffling decisions by Brailsford that escalated the situation to make it even scarier, not the least of which was that Brailsford’s bluster and open threats of violence made him appear as terrified as Shaver.

The contents of the body camera footage had been described to the public before, when Brailsford was first charged, but the video itself was withheld until this morning. NBC notes:

The detective investigating the shooting had agreed Shaver’s movement was similar to reaching for a pistol, but has said it also looked as though Shaver was pulling up his loose-fitting basketball shorts that had fallen down as he was ordered to crawl.

The investigator noted he did not see anything that would have prevented officers from simply handcuffing Shaver as he was on the floor.

Forcing Shaver to crawl toward the police like this increased the likelihood that Shaver would lose balance and make wild movements, and Brailsford’s bizarre orders were probably confusing even to a sober person.

Oh, and here’s an interesting detail from the Arizona Republic:

The judge did not allow jurors to hear about an etching on the dust cover of the rifle Brailsford used to shoot Shaver, which said “You’re f–ked,” because he felt it was prejudicial.

Shaver’s parents have filed a wrongful death lawsuit against the city of Mesa. Brailsford was fired for poor performance two months after the shooting. Would anybody care to bet that he tries either to get his job back in Mesa or to get a job with another law enforcement agency elsewhere?

I jumped to the article and apparently he’s already been fired for policy violations and unsatisfactory performance. Odd, if I read that right that the police seemed supportive of his feeling threatened by that poor man’s confused swinging of arms.

But, I believe I just saw what living in a police state is actually going to look like. FOR SOME OF YOU.

My stomach really hurts now. I expect that former policeman to be dead soon after this goes viral.

Unlike this poor guy, I was a bit arrogant with the copfuk who insisted I needed to be given a ride in his cop car. I told him it was a free country and I could walk.

When I was surrounded by several police cars and down on the ground in handcuffs with my husband demanding I be released to go to the hospital, I realized knocking a chip off the shoulder of the bully when the bully has backup and a gun and handcuffs is stupid.

I wish the dead guy’s family would stalk the cop and kill him. If the courts are incapable of doling out justice, people need to take matters into their own hands. If I were on a jury deciding the fate of whoever kills this cop, I’d stand firm on acquittal. The guy needs killing.

Apologies for the long post, but in light of this unjustified police criminal behavior acquittal…
Here are changes that can help reduce police-induced violence:
1. Get rid of police unions. Police unions (fraternities) protect the guilty, and are responsible for the massive whitewashing of questionable police behavior that is presently being committed.
2. Eliminate both “absolute” and “qualified” immunity for all public officials. This includes, prosecutors and judges, police and firefighters, code enforcement and child protective services officials, and others who deal with the citizenry. The threat of being sued personally would encourage them to behave themselves. Require police officers to be “bonded” by an insurance company, with their own funds. No bond= no job. You can bet that insurance companies would be more diligent in weeding out the “bad apples” than our present system…
3. Any public funds disbursed to citizens as a result of police misconduct should come out of police pension funds–NOT from the taxpayers.
4. Regular drug-testing of police officers as well as incident-based drug testing should take place whenever an officer is involved in a violent situation with a citizen–no exceptions.
5. Testing for steroid use should be a part of the drug testing program. You know damn well, many police officers “bulk up” with the “help” of steroids. Steroids also affect users mentally as well, making them more aggressive. The potential for abuse of citizens increases greatly with steroid use.
6. Internal affairs should only be used for disagreements between individual officers–NOT for investigations involving citizen abuse. State-level investigations should be mandatory for all suspected abuses involving citizens.
7. Prosecutors should be charged with malfeasance IF any evidence implicating police officer misconduct is not presented to the grand jury.
8. A national or state-by-state database of abusive individuals who should NEVER be allowed to perform police work should be established–a “blacklist” of abusive (former) police officers.
9. Most people are unaware that police have special “rules” that prohibit them from being questioned from 48 to 72 hours. This allows them to “get their stories straight” and makes it easier to “cover up” bad police behavior. Police must be subject to the same laws as civilians.
10. All police should be required to wear bodycams and utilize dashcams that cannot be turned off. Any police officers who causes a dash or body cam to be turned off should be summarily fired–no excuses. Today’s body and dash cams are reliable enough to withstand harsh treatment. Body and dashcam footage should be uploaded to a public channel “on the cloud” for public perusal.
11. All interrogations must be video and audio recorded. Police should be prohibited from lying or fabricating stories in order to get suspects to confess. False confessions ARE a problem in many departments. Unknown to most people, police can lie with impunity while civilians can be charged with lying to police…fair? I think not…
12. Any legislation passed that restricts the rights of ordinary citizens, such as firearms magazine capacity limits, types of weapons allowed, or restrictive concealed-carry laws should apply equally to police. No special exemptions to be given to police. Laws must be equally applied.
13 “Asset forfeiture” is a form of “legalized robbery under color of law” and must be abolished. We must return to Constitutional principles when it comes to “crimefighting”. The so-called “war on drugs” is actually a “war on the citizenry” and has had an extremely corrosive effect on the Constitutional principles that our country is (supposed to be) founded on.
14. “No-knock” raids must be abolished as they put both police and (especially citizens) in harms way. Even the Nazis “knocked on the door” before gaining entry.
15. SWAT teams must be reigned in on their “dynamic entry techniques”. Utilizing SWAT teams for routine situations is dangerous to both police and citizens. Smashing everything in sight “just because they can”, blaming it on an “adrenaline rush” must end. There is NEVER a reason for destroying property.
16. The “21 foot rule” must be modified or abolished. American police training assumes that ANYONE that gets within 21 feet of a police officer and is deemed a threat, even a non-life-threatening situation is “fair game” for the use of lethal force. Persons with rakes, sticks, knives, or even their fists have been executed, even when non-lethal means would have been more appropriate. Police hide behind the “21 foot rule” in order to justify questionable police shootings. Their “excuse”, when brought before a prosecutor or grand jury is “that is the way they are trained”. THAT has to change. Police have a greater responsibility NOT to use deadly force against those that they could easily subdue by other means.
Police work is not inherently dangerous…there are many other professions that are much more dangerous.
A little “Andy Taylor” could go a long way in allaying fears that citizens have of police.
That being said, I have no problem with police officers who do their job in a fair, conscientious manner…however, it is time to call to task those police officers who only “protect and serve” themselves.

If anything, police should be held to a higher standard than that of the public…As it stands now, police can commit crimes with impunity because, in most situations, they investigate themselves…Behavior that would get an ordinary citizen charged, convicted and incarcerated is routinely ignored by “the powers that be” because police are considered to be “above the law” as the “law” is whatever they say it is, the Constitution be damned…
Police officers are the only group that can murder someone by falsely claiming that “they feared for their lives”, have 48 to 72 hours to “get their stories straight”, and have a union lawyer and compliant prosecutor-steered “grand jury” absolve them of responsibility.
Police demand immediate compliance (Israeli-style)–with two or three cops issuing and yelling out conflicting commands, it is easy to see how a person under police control could lose his life for merely attempting to follow conflicting directions.
Ever notice that police unions are “fraternal”? This should tell you something. The “thin-blue-line” is a gang, little different than street gangs–at least when it comes to “covering-up” their questionable and quite often, illegal and criminal behavior.
In today’s day and age, “officer safety” trumps de-escalation of force. This, in part, is due to the militarization of the police along with training in Israeli police tactics. This becomes a problem, with the “us vs. them” attitude that is fosters, along with the fact that Israel is a very different place, being on a constant “war footing”, its police tactics are very different.
There are too many instances of police being “given a pass”, even when incontrovertible video and audio evidence is presented. Grand juries, guided by police-friendly prosecutors, quite often refuse to charge those police officers who abuse their authority.
Police officers, who want to do the right thing, are quite often marginalized and put into harms way, by their own brethren…When a police officer is beating on someone that is already restrained while yelling, “stop resisting” THAT is but one reason police have a “bad name” in many instances…this makes the “good cops” who are standing around, witnessing their “brethren in blue” beating on a restrained suspect, culpable as well…

When I was a little kid growing up in Seattle, there was a police outreach program. They had a guy going by the name of “Officer Friendly” appear on local TV, visiting schools and so on.

I remember quite clearly when Officer Friendly came to our school. He gave a little spiel about the po-po, and at the end we could ask questions. Well, kids being kids, somebody asked how many bad guys he had shot. He replied that in 30 years on the job, he had never so much as taken his revolver out of the holster.

Nothing surprises me anymore but that pig’s behavior was inexplicable. He had a partner who could, and should have immediately handcuffed both where lying face down on the carpet. He showed absolutely no remorse for the shooting and did nothing to aid the man once shot. He should be publicly executed.

This unfortunately is going to be what starts to happen more and more. When the Just Us system no longer works for the victims of crimes (committed by people in magic blue uniforms or not) you will see extra-system justice. Think Paul Kersey in Deathwish, but against ALL thugs. Not just the ones on subways and non uniformed.

Picture how angry you would be if this was your son in this situation. Now imagine the slap in the face that you just got by a jury, that through procedural maneuvers, was somehow conned in to acquitting this piece of human garbage.

I suspect that this LEO who is no longer a LEO, is going to have to watch his back rather carefully.
When justice only works for some, but not others, people have a funny way of equalizing the playing field. We no longer live in a country governed by laws, and when that happens, justice becomes swift, just not civil.

The Mesa police department got this right at least. Fire this bully and charged him with murder. How 12 jurors could find him innocent is baffling.

The police were called because this idiot was pointing a rifle with a scope on it out his 5th floor hotel window. There are extended versions of the body cam footage on the internet, where they try to coax this guy out of the room for quite a while, he does not respond. The cops did not move forward to cuff him because they were not sure there was not a guy with the rifle still in the room. About 10 seconds before the guy gets shot the cop explicitly tells him if you go for the small of your back again, I will shoot you, after giving him a pass the first time. Sure enough, the guy went back for the small of his back again, while crawling. If I had been in that guy’s situation, there’s almost no chance that the cop would have shot me. I would have done exactly what he asked me to do , and that would have been that . Play dumb games, win dumb prizes.

You have got to be kidding. Please tell me you’re kidding. This is far and away the most egregiously messed up cop shooting I have ever read about or seen on video. Whatever actions by the victim which led to the cops being called to the hotel are absolutely irrelevant to what happened subsequently. This kid was on his face with his hands laced over his head and his ankles crossed exactly as the officer ordered. There were at least two officers on site. What was to stop them from handcuffing the kid at that point. If they were worried about someone in the room (the door was shut), then why could not one officer watch the door while the other handcuffs the kid. This kid was obviously scared shitless as officer Brailsford barked orders. The more this cop barked, the more scared and confused Daniel Shaver became. By the time that officer was ordering him to crawl, the kid was completely freaked out. Daniel Shaver was murdered. The truly disturbing thing is that a jury acquitted the officer. What sort of slavish deference to authority blinds people to what happened here.

I don’t know what was in the mind of officer Brailsford any more than what was in the mind of Daniel Shaver. My guess is that Brailsford is an arrogant, borderline sociopath with a “comply or die” mentality all too common among police in this country. Common sense or restraint did not come into play here. Where was the fellow officer who could say to Brailsford, “Come on buddy, calm down. The kid is on the ground. Let’s just all calm down. You watch the door, I’ll cuff the kid.” That didn’t happen. The video seems pretty clear on what did happen. Officer Brailsford murdered Daniel Shaver and got away with it.

Of course it’s relevant. There are an unknown number of people in that hotel room, and one of them has a rifle, and has been pointing it out the window. You’re starting with a bunch of really stupid assumptions that you only know to be fact, after the fact. He’s the only guy in the room . He doesn’t have a gun on him. Those cops certainly can’t start with those assumptions. It could get them killed. That’s hardly irrelevant. I don’t want to see anybody shot by cops. It’s incredibly sad and unnecessary. That being said, stop and think for a second. Those 5 cops went there on a mission. To disarm somebody waving a rifle out of 5th floor window. Not for the faint of heart. That’s serious stuff. Were they jacked up? You bet your ass they were. Was the most important thing to those cops making sure they went home to their families? You bet your ass it was. Start reaching for your waistband repeatedly around a cop with a gun trained on you, who is starting with the premise that you might be dangerous, there’s a real good chance you might die. Everytime I watch one of these shootings, as unnecessary as it might be, I always look for what is the cop reacting to. Think about this case. The guy turns out to be unarmed. Was that an assumption that the cops could safely make? Of course not. Sane people don’t wave rifles out the 5th floor window of their hotel. When you start the sequence of events in motion by waving a rifle out of a fifth floor hotel room window, whatever happens to you subsequently is your own goddamn fault. Philip Brailsford has a wife and two small children and he deserves to go home to them every night. It’s not part of his job description to take a bullet from some idiot who refuses to follow instructions. Brailsford’s finger was never on the trigger until the suspect reached behind his back. He was never out of control, and he certainly didn’t started his day hoping to shoot someone

Look, I’m willing to give police the benefit of the doubt in confusing or menacing situations. I posted a video below of just that. This situation was neither. This ‘police officer’ escalated a situation that was not known to be dangerous or even criminal. No criminal offense had taken place and even the weapon was not confirmed. Just a goddamned citizen report that someone had a rifle in a hotel room ( and this was pre Las Vegas).

Anyone could find themselves in this situation. I could report you were standing in the window with a ‘rifle’ and there but for the grace of God you would have been staring down the barrel of a M-16 with this snarling and demented “police officer” screaming threats and itching to pull the trigger over a putative weapon he had no evidence even existed!

Unit, we are looking at this in hindsight. Trust me, I see the same thing as everybody else. Some drunken idiot who f***** up a little bit, and was scared out of his mind when confronted with an aggressive cop. The dude obviously didn’t want to die. But his inability to grasp the gravity of the situation he created, and his inability to do the things necessary to survive the situation he created, doesn’t make that murder. In hindsight, after looking at all the facts, anyone who views this, wishes that it would have been handled differently. But that’s in hindsight. Look at the 3 videos I posted above. In hindsight, I bet all three of those cops wish they had been far more aggressive, because they paid a huge price for giving someone the benefit of the doubt. Being a cop in today’s world is no game. There are some really bad people out there.

We are not looking at this in ‘hindsight’! We are looking at it in real time as it occurred. The couple was being compliant even though no crime had been committed. Being in possession of a ‘rifle’ in a hotel room is not a crime yet this was treated as a felony arrest of a violent criminal.

There was no evidence or report of a ‘handgun’ so while the officers had a right to be cautious assuming every person police encounter is ‘armed and dangerous’ is crazy.

Consider this. If you saw this tattooed cop emerging from a hotel room in civilian clothes or Mr. Shaver and his girlfriend who would you consider the more dangerous people?

Perhaps the standard should be that cops should do their flippin jobs with the goal that everyone goes home to their families, or is that standard no good for a drooling authority-loving future helot like yourself. Reason.com starts with intentionally bad information. And I don’t think any of you have an understanding about what Officer Brailsford’s job on that jump team was. That was five cops. Officer Brailsford never said a word. Another officer’s job was to control the situation verbally, providing the instructions to the suspects. Brailsford’s job, his only job, was to cover the suspects. Nothing indicates he was excited or homicidal. His finger wasn’t on the trigger, and he only reacted to the suspect not following instructions. Police have procedures, designed to safeguard themselves and the public-at-large. A suspect is no longer safeguarded when they fail to follow instructions. In almost every one of these cases, the catalyst for the suspect getting shot was failure to follow instructions. Cops don’t shoot you for mouthing off. Cops don’t shoot you for running. Cops shoot you for fighting with them, or reaching for things when they tell you expressly not to. Want to live around a cop? Don’t fight them, follow instructions and keep your hands visible. It’s really simple.

If you look, you will see my comment above, replying to rdawg’s accurate memory of my own strange interaction with local law enforcement last spring. For those who remember and wondered? I ended up face-down in a concrete parking lot of a car wash on KingsHighway if you’ve driven by there. There were at least a half dozen cop cars and suvs around me. Handcuffed and being either shocked or pinched with those cuffs while in a lovely denim housedress and tights (as a matter of fact…. not unsimilar to THIS outfit I’m wearing right NOW, but I will have to edit to upload the photo link in a bit.) I do NOT always need to include photos of me, but in this case, I think it supports my point. I am a middle-aged semi-retired housewife who worked long enough to save a nice chunk of retirement change by paying off the home loan in ten years instead of thirty and continuing to put that monthly amount away another ten years and whah lah… early retirement in a log home in paradise. I’m not a small woman, but no longer extra-large with style, as my friends and I liked to think of ourselves. We were never cottage cheesy blubber types all in all, but I did shop in the Women’s section to make myself feel small. Hey, buying a 1X off a rack that goes to 3XL makes a gal feel absolutely tiny. Having lost another 30 pounds since then and realizing the panicked state I was in due to the rapid fire events that led to my getting out of a vehicle to walk away from a traffic jam/stop/accident has altered many things about my life and my health.

It has also affected my point of view in a profound way I haven’t been able to discuss until recently. But, in the many months since then, I have come full circle and am ready to talk about that day a bit and hopefully, to resolve the confused images I have in my mind from that experience. I am proof positive that an eyewitness in a panicked state is worthless as a witness. I am lucky my husband convinced them I needed immediate medical attention, whether that was true or not. In my naiveté and lack of experience interacting with law enforcement outside a military environment of which I was PART (a military ID in a military industrial complex is a really good tool to try to seize some authority… local and state police don’t like to get into it with military people on the evening news), I assumed a haughty tone. I tried to talk to that cop and others with the same tone I used when talking as a Program Management Team member for someone important. That was a bad mistake. Even my retired military ID, along with my lawyer’s address on Kingshighway to prove I knew where I was heading, would not get the badged bastards off my case. In spite of my being a pleasant, relatively rational, if a bit beligerent, well-spoken woman with no evidence of inebriation who claimed she was tired of sitting in the car and decided to walk through a neighborhood, the cops only grew more and more suspicious and insistent that I needed to be escorted. Can you imagine how panicked I grew, walking through a residential neighborhood near a college with several police cars following and passing me? I had some idea about telling you all here at TBP that all it takes is a little bravado to stop an obviously unconstitutional action by police. 1. If there are stopped cars and a cop is walking along looking in the windows to see what might seem suspicious, THAT is not reasonable expectation of privacy. 2. You have a right to get out of your car and walk away for whatever reason you want to if you are not driving.

I think those two things (above) are true. I had a few notes in my hand which were LOST when I was tossed to the ground by Jerkwad 55 (I found out later all the police cars in Cape are numbered on license plates and badges. No names. Just numbers.) I was planning to explain to you all here how it was that the common citizen (in this case, ME) rises up to what is a tyrannical act (illegal search and seizure and a line of stopped cars for dubious reason) and demands the tyranny STOP.

Well, I was so shocked I couldn’t even process what happened that day. In the end, we think my cousin’s neighbor’s Vietnam Veteran buddy might have slipped me a mickey in my coffee that morning when I dropped off eggs on my way to town, meaning my panicked reaction was chemical in addition to fear-induced. But, I was not only demanding my rights as a citizen, I was beligerent to the cops. I really must blame Stucky’s and Admin’s bad attitudes about the police and other government mercenaries (military contractor types included… I don’t ride for free) for my overboard reaction that day. I was on a One Woman Mission to prove that KNOWING I was within my rights was the same thing as being right. I discovered that the guy with the gun is right.

As I said, I’m just an average older woman who is living a healthier lifestyle than before. I certainly think I turn a few more heads now than I did the last twenty years. I was sort of wearing a drudge of a office worker costume with almost an extra person (60+ lbs) wrapped around me. That is why I include the photo… I am just trying to prove a point about what constitutes a nice-looking woman without having to show boobage or buttcrack or navel rings to prove she has them. I think I was dressed then, as now, in a way that says I look like a “nice lady” as rdawg said the other day. And, after the snarky remark about saggy boobs from that cad razzle, I will make sure I NEVER show any cleavage here. It is why I can communicate with a bunch of preverted monkeys like you here on TBP without MOST of you getting nasty. I can be Maggie, the lady on TBP, without having to be a physical tease. I am good at that.

However, this set of black leggings is the exact pair I wore that day, covered by a knee length dress. I was sober, though the strange behavior and reaction I had to seeing a few of the faces in the crowd was over the top. It was as if there were a powerful release of terror enzyme all at once. The experience, all in all, changed the way I looked at the coming police action. It made me want to stay as far from it as possible.

It’s not baffling at all…cops get off because they routinely “watch” grand jurors and other jurors who are on juries in cop cases. You see, cops have all the time in the world, access to various government and civilian databases and can easily convince jurors to let their “brothers in blue” off. There are (unproven) cases of jurors being harassed by police, if they don’t vote to acquit…

The inscription on the weapon should have been enough to prove intent to murder. There have been civilians involved in legal self-defense situations that have been brought up on charges and prosecuted for merely stating that they would use lethal force to defend themselves and their families. If a civilian had such an inscription on his weapon, even being used in legal self-defense, a prosecutor would have a field day and could even have a “slam-dunk” conviction…
That cop was a sick f#ck who should have never been allowed to do police work. It is clear that he wanted to kill someone.

Two years and one day too long. To be blunt this tattooed cop looked more like a criminal than Shaver and his girlfriend. Tattoos maybe pretty common these days but big flashy ones are more commonly found on drug abusers, ex cons and gang members than decent citizens.

You can’t even grow tomato plants without being subjected to a swat raid. This couple were subjected to swat terror after tea leaves were found in their trash and the home owner was seen leaving a hydroponic shop with a grow light. They sued the county sheriff and lost but an appeals court reinstated the law suit. The couples two children were home at the time and were not allowed to leave during the entire 2 1/2 hours they were searching the house. Leawood is a very well off city on the Kansas side of the Kansas City Metro area. It cost the couple $25,ooo just to get the evidence released from the county to file their suit. If you were not well off, you would have no recourse at all.

I will admit to being so shocked when I saw it the first time last night, I refused to watch again. I am probably remembering wrongly, but the shock of seeing those shots entering his body made me really ill. As VV said… my stomach hurt thinking of my own Attention Deficit Disorderly Son, who actually BLAMES me for not allowing his ADD to be treated as a preschooler. I told the doctor “no” to Ritlin and stayed home to raise him myself, with the help of private school where parents are allowed to be parents.

I am sure my own 24-year-old computer nerd might do something stupid in his apartment and be like his mother, all haughty and in the cop’s face, not realizing the cop is allowed to view him as threat just because he CAN.

Maggie, it’s horrifying. And when Reason primes the pump by lying about what happened, it’s really easy at fired up. But if you watch the extended video, with the before and after, it tells a little bit different of a tale than what Reason is telling you. The cop who shot the guy never uttered a word. The cop doing the talking was a Sergeant Charles Langley. The cop who shot the guy was doing exactly his job. It’s a grim job, I don’t know why people here think he’s bloodthirsty, but it’s a job somebody has to do. I don’t kill my own meat. You and Hardscrabble do. I get that. I don’t find that job pleasant. But I know it gets done, and that doesn’t bother me. Somebody has to do the unpleasant jobs.

Actually, I was talking about my own son. He’s never actually been diagnosed with ADD or ADHD but he was one hyperactive little toddler and he used to run circles around the doctors table and office equipment while she and I talked. She asked me if he ever stopped and I said “so far, no.” He was about four years old and I was enrolling him in preschool at a private school. (He hadn’t been vaccinated yet and I had to get him a series of shots, so was FORCED to take him to a doctor.)

She asked if I’d like to have him tested and treated for ADD. I said NO.

About two years ago, my son learned about Adderal and Ritlin and how it helps young people with Attention deficit issues focus. I told him the side effects were catastrophic for young people. I believe that is part of what is wrong with your younger adults. Most were overmedicated with some pretty powerful psychotropic drugs throughout their lives.

So, it was MY son giving me a hard time.

As one who has had a 9mm placed to my temple by a young, over zealous cop I have to say that following instructions EXACTLY, keeping your mouth shut and staying calm is the key to survival. As soon as I was cuffed and brought to my feet, the same cop said thanks for following orders and making it easy.

My question to those of you saying that the directions were so hard to follow, why was the female suspect able to comply without being injured? She was given the same instructions. Was it because she stayed calm, didn’t talk back and didn’t make any furtive movements? Unfortunately for Daniel, he was unable to stay calm and in control of his movements. I’ve watched the video about a dozen times now and the instructions seem pretty cut and dry to me. And if you reach behind your back when there’s an agitated cop standing 10 feet away drawing down on you with an assault rifle, well then, Darwin.

As far as those here calling for a virtual lynch mob for the cop, then you are just as guilty of ignoring the rule of law as any of the BLM types and seem to be advocating for anarchy. While you may not like the verdict, the case went through the justice system as it’s set up,imperfect as it is.

While this is definitely a tragic incident and my heart truly goes out to Daniels family, it was a predictable outcome.

Ok, I’ve been following this site for a decade before deciding to make a comment so what better way to pop my cherry than disagreeing with almost everyone on this thread. Ironically, I’m in agreement with most everyone most of the time on pretty much all of the issues and topics raised.

Yeah, go fuck yourself. What the fuck kind of system is it where just because a guy has a blue costume on, he gets to bark orders at you and if you somehow fail to comply fully, perfectly and immediately he gets to shoot you dead and be exonerated? I’m sure the fact that your heart goes out to his family makes a big difference to them. A tragedy is if your kid gets struck by lightning. This was a murder. This case went through the justice system as it’s set up, alright. It’s set up so that cops almost always get off. If it takes a little vigilantism to make cops think twice before they murder a guy so be it.

What an absolute bastard. Set my already low opinion of law enforcement back another decade.On a professional note, I am a decorated veteran of the Iraq War and was the ranking security NCO on a base with over 7,000 personnel. I never had to discharge my weapon, although I chambered a round occasionally. Watching this video, I knew from the first few seconds that this “officer” intended to kill that suspect. I learned to “read” people in Iraq, and that officer is a cold blooded murderer.

That is correct. The purpose as I see it to have one cop shouting the orders, and the other drawing down is to have the one making the life and death decision NOT be all pumped up, but OBSERVING every move, and assessing risk with laser tight focus on the suspect. As I watch, I am putting myself in the situation, as the supposed calm and focused party. What I see is MANY opportunities to observe and WAIT before making a kill decision.

Lets game theory this. OK, so you see this kid reach for his back side. Alright. Do you think, if he indeed DID pull a 9mm or other gun out of some place in his rear, that you could not pelt him dead before he could turn the 9mm up towards you, or any other copfuck in that situation. If he pulled a gun, and shot right away in the position he was in, he would shoot his own rear end! If the gun was somehow aiming – from his shorts – towards the copfuck, do you think he could pull the trigger from that position? Would the gun just magically aim and fire on the kids touch? In that position, just seeing a gun does NOT mean immediately shoot dead. In that situation, seeing the gun means CAUTION and prepare to fire, put hand on trigger from trigger guard and wait for a movement that constitutes GRABBING and attempting to aim and use.

The copfuck, whose JOB it is to be the precision shooter, or as Starfckr states has the “dirty job” should be exceptionally trained in weapons, and the PHYSICS of them, for the very reason that HE / SHE can be the final judge in a situation with the gravity of this.

We need to start with SMARTER humans becoming cops, and SMARTER humans making life and death decisions. Period. We also need to start with COMPASSIONATE cops. This is not a case, in my view of too much fear, this is a case of too much lack of empathy for a fellow human being, and the lack of understanding the serious nature of the job that these people have been given. They should be held to a MUCH higher standard than the rest of us. As I mentioned above, justice will happen, it always does, and will be by their fellow citizens, it just will eventually be in a way not expressly intended by the founders of this nation, through the rule of law.

I don’t disagree that cops have a drastically lower conviction rate than the general public when a death is involved but what else is new? Cops have always gotten away with that for as long as there have been cops.

There’s nothing I’ve said to indicate that I think that the cop is better than anyone else. On the contrary, he’s clearly an egomaniac who wants to dominate people just taking into account the fact that he would stencil “you’re fucked” on his weapon. But that aside, my point is that if you find yourself in a situation where someone is holding a gun on you, especially a cop with an assault rifle, and you reach behind your back, it’s probably not going to end well.

The guy should have been shot at about 3:50 when he put his hands behind his back. He could have been going for a gun and was not following instructions. Those instructions were given to prevent him from doing anything that might be considered threatening not just for the sake of obeying the police.
