I wonder if people who use the Constitution to shield their attempts to undermine it deserve to be protected by it.

Depends on what they did to undermine it. As long as it didn’t include trafficking children, stealing from desperately poor Haitians, attempting a coup on the elected president, conducting wars all over the planet, carrying out false flag attacks on the innocent, etc, then yes, constitutional protections should apply since everyone is equal under the law. I imagine, however, if the constitution actually still applied, most of the above abuses wouldn’t have taken place, or if they had, the guilty wouldn’t be sipping Mai Tais on their yachts.

The usual justification for not torturing criminal prisoners is that “we don’t want to become the monsters that they are”. If that is valid then you give your opponents Constitutional protections because you don’t want to become the monsters they are.
Then again, if you execute your opponents …?
