POPO STOP OF THE WEEK

A civil rights investigation is underway after a woman claimed she was “brutally attacked” by a Richmond police officer during a traffic stop on Jan. 31.

Video recorded by the officer’s dashcam showed the officer pulling the driver out of her, pinning her against the vehicle and placing her in handcuffs. The video shows the officer, identified as Brady McNeal, and the female driver in a struggle before he pulls her out of the car.

McNeal has been placed on administrative leave. He has been employed with the department since June 2017. -The Richmond Police Department released the following statement:

“On March 22, 2019, The Richmond Police Department received a claim of a Civil Rights Violation from the attorney of an individual who was pulled over for a traffic violation on January 31, 2019. The complaint claims that the officer brutally attacked the individual during the stop. ”

Two days before receiving the formal complaint, on March 20, 2019, The District Attorney notified the Chief of Police regarding the incident. The Richmond Police Department immediately began an internal investigation regarding the alleged violation of the officer.

The officer, Bradley McNeal was placed on administrative leave at that time and will remain on administrative leave until the investigation is complete. Officer McNeal has been with the department since June of 2017.

“When the Richmond Police Department received the official complaint from the complainant’s attorney on March 22, Chief Gary Adams asked the Texas Rangers to conduct a separate investigation regarding the incident. Both the internal investigation and the investigation conducted by the Texas Rangers are ongoing. ”

The initial traffic stop occurred on January 31, 2019 at approximately 10:41 PM, in the 100 block of South Second Street in Richmond. Officer McNeal stopped the individual, later identified as Isaura Cecilia Moreno, 22 of Richmond for a defective passenger side brake lamp.

“Moreno was arrested for the following at the time of the stop: Assault on a Peace Officer – 3rd Degree Felony Resisting Arrest, Search and Seizure – Class A Misdemeanor Interfering with Public Duties – Class B Misdemeanor”

She was placed in the Fort Bend County Jail at the time of arrest. “Moreno’s Felony case went before the Fort Bend County Grand Jury on February, 18, 2019. The Grand Jury True Billed Moreno on the charge of Assault on a Peace Officer/Harassment of a Public Servant. This charge was dismissed on March 25, 2019.

“No further information regarding this incident will be available while the investigations are ongoing.”

I see this all the time. “why do I have to get out ?” ” Why you arresting me?”. The cops aren’t required to list and explain the charges before they arrest you.
I tell my kid if you’re stopped, don’t argue, do what your told , be respectfull but dont answer more than the most basic questions and then shut up, and if it was unjustified we’ll work all that out later in court.

Life is all about hazard or contingency. A police officer stops a young female driver for a defective tail light. Right away the driver becomes aware of contingency and freaks out which causes the police officer to become aware of contingency and he freaks out. As they become aware of contingency , they find themselves in Hamlet’s dilemma: whether to suffer or take arms. The dilemma evokes the quality of self-assertion which can be the masculine virtue of courage or the masculine vice of pugnacity. In any case, it placed them in conflict with nature and with themselves.

The police officer suffers from the vice of pugnacity and poor police training. All he had to do was give her a warning and move on.

It seems that most all our police suffer from the vice of pugnacity. They can’t handle hazard or contingency which is built into the very nature of our experience.

This leads me to question the very process of how persons going into law enforcement are evaluated for the job. Are we training the right people?

You do have to pick and choose your battles though . If she is clear , get the officers records file a complaint get a good attorney and go for a MILLON dollar score . You may get a six figure settlement and the cop gets fired

If this was all over a brake light it would seem a bit excessive, but at the tail end of the video, I was relieved to hear the cop smelled weed. Good thing he put her through all that chaos instead of just asking about the weed smell and proceeding from there. VA has already started exploring medicinal weed and de-criminalizing possession (never thought THAT would happen), so some day this may not even be a crime. Blacks in Richmond have a reputation for crazy and I bet the cop knows he can get the desired insane reaction based on how he pursues his duties. “See how insane these blacks are when I was just doing my job? It’s her, not me! Stop hitting yourself! Stop hitting yourself!” Yanking the woman out of her car like that was probably certain to get an irrational freak-out, where a white person might have been much more pliable and eager to avoid confrontation.

I think the cop in this instance knew his behavior was bound to evoke a crazy reaction, which would justify taking things further and further into crazy town. I bet he didn’t violate his rules of engagement one bit, still, I think there’s a nice way to go about your duties and the confrontational way that ensures you get a crazy suspect. It’s all at the cop(s) discretion. Remember the stories about how Baltimore PD likes to give hardasses a “rough ride” on the way to the station, just to hurt them without breaking the rules?

I don’t think the weed smell justified the approach the cop used. But there was weed smell, or so he claimed. He had the Probably Cause to investigate further, but his approach could have been less aggressive, which would have kept the interaction less excited, and probably wouldn’t have ended up with the driver being smacked around, cuffed, and charged with resisting and assaulting a cop.

At the same time, as a sometime VA resident, I can assure you, blacks in Richmond have a reputation for crazy. They do crazy, violent things. It’s not a surprise in VA to hear about them getting into trouble. And if you youtube it, you’ll find countless videos of blacks in general being crazy in routine interactions with cops. Seriously, they get nuts in even the simplest interactions. The most amusing ones are the total freakouts where the black person goes nuts when all the cop wanted to do was give them a warning or advise them to, say, step out of the road. That whole BLM shooting freakout in Ferguson wouldn’t have happened if the black dude wasn’t walking in the middle of the road. He probably never would have been caught, had he just walked on the sidewalk after his robbery.

I can bet you if I were the person in the stop, it wouldn’t have gone that way. 1. I don’t argue with the cops. As someone smarter than I said, “You can beat the charge, but you can’t beat the ride. 2. I’m always polite and keep my hand on the wheel where they’re visible and I don’t move without instructions. 3. I’m not smoking weed in my car. Or anything else for that matter. 4. I pull over as soon as I know it’s happening. When I was blazing over 80 down a VA highway near Sussex, and blew right past the cop in the median, I didn’t waste time pretending he wasn’t going to be on my tail. I was on the side of the road, waiting, before he pulled onto the highway.

I might be a massive pussy, but my interactions with cops don’t involve threats, beatings, tazings, lots of charges, and I have even been downgraded from the maximum available punishment or even released with a warning. I have been arrested once and that was one of the worst things that I ever underwent- but they all treated me pretty well, despite the perp walk of shame with cuffs, 6 escorts, being searched, stuck in a cell, etc. I don’t know about you, but I’ve seen judges ask the cops if their suspects had resisted or were disrespectful. Nobody ever had that to say about me and the wheels of justice were somewhat more gentle with me than the folks who freak out, try to run, argue, refuse to sign the ticket, etc.

Times are changing and so are people. More cops than ever are getting shot when pulling someone over. I suspect this will only increase as time goes by.

Cops are no longer peace officers; they are law enforcement officers which means conflict. Administrative laws are making people into criminals. We are now a nation of criminals thanks to the rule of law. This is not a good situation for the citizen or the cop which has the duty to enforce the laws.

People really need to question the law, the courts, and the judges. Administrative law is an abomination to the ethics and morals of the people.

The cop smelled weed so this gave him the right to act as he did? And the other cops that came at the end walking around like a pack of German shepherds; do you call this descent human behavior?

The police state is a product of the rule of law. This form of law has no values.

The rule of law need not devolve into a police state; police states evolve to collect unfair taxes.

A cop’s job is capture, not enforcement. There’s no such thing as “Law Enforcement”. The entire system is geared toward fines and punishment, and more fines. The only time a cop is “enforcing” a law is when he handcuffs you for (maybe) breaking it.

In days of old, bad behavior was settled between the families involved, unless it was treason against the King. The aggrieved family named the terms of retribution, usually with some thought toward avoiding generational enmity. The king never thought to notice domestic squabbles.

Then Kings found it profitable to confiscate the property of lawbreakers, so they needed “police” to take the property. The only thing that can stop overreaching confiscation is a well-armed populace.

We have one and soon enough, the enforcement of universally hated laws will make cops targets wherever they go, and their parents will advise them to always be polite.

Yes and No. Like I just wrote above- I think that cop knew exactly how to behave in such a way to cause the driver to get nuts without actually violating his rules of engagement. He knew what buttons to push without actually doing anything that would stick out as irregular. He exercised his discretion to be a dick. And the driver played right into it. A lot of blacks seem to go nuts in cop encounters that are otherwise perfectly normal. Go youtubing, you’ll see them start freaking out, refusing to sign the ticket, refusing to comply with demands, and just acting crazy, frequently in dealing with cops who seem full of self restraint. If the driver hadn’t resisted or started yelling and just complied, he wouldn’t have had his fun and the story would have been different. I kind of fault both sides in this. The cop is, I assume, part of the community, and owes it to their home community to interact well, since those people are their neighbors and being a hard-ass occupier, as if Richmond is Iraq, does nothing to actually maintain good relations with the community. Criminal studies textbooks are full of examples that show police who work to keep on a good relationship with their community actually see a higher success rate. I believe the term was Community-Oriented Policing, in which the cops are actually there in the neighborhood, not bracing people and pulling occupation duty, but just interacting.
I recently heard about this Kansas City SWAT team cop who hit upon the unusual realization that he didn’t need to be a dickhead with the community. He brought in behavioral people to try and change his team’s way of interacting with the public and they saw huge results in complaints and lawsuits and successfully-closed case stats. They even started gaining the trust of the locals and started getting tips and informants from the locals.

Horseshit. Always tell someone what the fuck is going on and why. The officer is an agent of the government and acting in that capacity. The officer decided to stop this car and it’s occupants. There is a responsibility not to act like a dick when doing that. Inform someone when they are being detained, and that they are not free to leave. Then, if the traffic stop goes to shit….immediately tell the person that they are under arrest, and why.

If an officer encounters this type of verbal resistance, a answer to her question might have diffused the whole situation, or she was stoned out of her mind an an explanation would not work regardless of what the cop said. At least the situation would be crystal clear to anyone viewing the video later. This is the problem with moving from peace officers to law enforcement officers.

i suspect that the reason he did not tell her why she was being cuffed was because there was a passenger in the car who could have become involved,he only wanted to have to deal w/one person at a time–
the broken taillight was the reason he needed to pull over a vehicle late at night so he could check for alcohol or drugs–
if he had smelled alcohol but there was none in the car but she later blew alcohol breath would you guys be saying anything different?
