Can I get everyone’s attention please?

This article tells us how to make our public comments to OSHA on the vaccine mandate. Can we all do this? I’ve bolded, italicized and enlarged the 2 paragraphs showing a couple of links at the end on where to send said comments.

You can and should protest the OSHA mandate about workplace vaccines

With virtually every aspect of life under assault from progressives, Republican successes on Election Day were a much-needed shot in the arm. Let’s capitalize on that energy. Instead of sitting idly by waiting for lawsuits to make vaccine mandates go away, OSHA just handed us an opportunity to drive a stake through those very mandates.

On November 5, OSHA published its COVID-19 Vaccination and Testing ETS (Emergency Temporary Standard) in the Federal Register. It goes into effect immediately and companies with 100+ employees have 30 days to comply, plus 60 days for certain testing requirements.

However, because this ETS also functions as a proposed rule for a permanent standard, the public has 30 days to comment. Most of us have never commented on a proposed rulemaking for any agency, let alone OSHA. But if standing up to vaccine mandates is something you feel strongly about—and you should—this is another avenue of attack we should exploit in the vaccine wars.

Administrative agencies are creatures of the executive branch. They make copious rules and regulations that govern our lives but are not directly accountable to the people through elections. Requirements for public comment under the Administrative Procedure Act (APA) are a way to make fully unaccountable administrative agencies somewhat accountable to the people.

Since every American is affected by these vaccine mandates, we all have a right to comment, which is why I am asking every American Thinker reader to take some time in the next week or two to submit a comment to OSHA “on any aspect of the ETS” and “on any topics related to this rulemaking.” And then ask your like-minded friends to do the same.

What’s extremely important for you to know is that OSHA brazenly states its intention to expand the 100+ employee rule to include all businesses. If you have a small business, you must tell OSHA how such a regulation would affect you.

Last Tuesday, we just saw the power of participation, whether at school board meetings or the polls. There is no guarantee that we can change minds at Biden’s OSHA, but every comment is part of the public record and, in terms of future legal and political remedies, it is critical that we are heard in massive numbers with compelling arguments.

Although dozens of lawsuits have been filed challenging the mandate on myriad constitutional and statutory grounds, we cannot be lulled into a false sense of security that all will be resolved by courts laden with activist judges and a Supreme Court that is the ultimate crapshoot. We must first try to stop OSHA in its tracks from applying this mandate to all businesses while continuing to fight on all administrative, judicial, and political fronts in the hopes that something sticks.

In its summary of the mandate and fact sheet on participation, OSHA maintains that COVID poses a grave danger to the unvaccinated in the workplace and those who have been infected but are not vaccinated, completely ignoring natural immunity, tests for immunity, and data proving that the vaccinated also transmit and contract the infection. According to OSHA’s “fact” sheet, “Given scientific uncertainty and limitations in testing for infection and immunity, OSHA is concerned that it would be infeasible for employers to operationalize a standard that would permit or require an exception from vaccination” and asks for “additional scientific information on this topic that OSHA should consider.”

OSHA ignores that studies show natural immunity is at least as robust as vaccine immunity and up to 27 times more robust than vaccine immunity. Providing proof that you had an infection or getting results from one of several available tests for immunity easily refute OSHA’s argument.

OSHA also ignores that healthy, working-age people are at minimal risk from COVID. And it ignores the fact that vaccinated people giveget, and die from COVID. A significant factor in COVID deaths, whether vaccinated or unvaccinated, is comorbidities or advanced age.

Another thing OSHA ignores is that we now have treatments for COVID. A recent meta-analysis showed that Ivermectin use resulted in “large, statistically significant reductions in mortality, time to clinical recovery, and time to viral clearance.” Additionally, Pfizer has a promising pill that allegedly cuts the risks of serious illness and death by 90%. It’s up to laypeople to inform the experts.

You can also submit a comment to OSHA here. It’s easy to get overwhelmed trying to address every argument. Limit your comments to one or two points. Include supporting evidence. Alex Berenson’s books and his writings at Substack are helpful. This document, prepared by the Center for Renewing America, is also instructive.

Here are some important things to remember: Do not include any private information such as your SSN or birth date, as these comments become part of the permanent public record. Also, avoid snark and inappropriate language, which weaken your position. Make your points with logic, facts, stats, and common sense.

Conservatives are being silenced on so many fronts. Let’s not give the authoritarians the upper hand by ignoring this unique opportunity to be heard. This is another Let’s Go Brandon moment. Don’t let it slip through your fingers because of apathy or indifference.

I guess for those who still have hope in the system can try. I’ve just been down this road on the state level signing all kinds of petitions only to have the assholes laugh in our faces. It was all a show to make us feel like we had a voice. I believe this to be the same thing.

Sorry…not attacking you at all. Just incredibly fed up with all the games these lunatics are playing with us. It only delays the real solution.

Wip – if you have no idea whether it will have any “effect”, then you are deluding yourself. It almost certainly will have no effect whatsoever. That doesn’t mean it should not be done. But don’t kid yourself – the chances of this having any effect whatsoever are slim and none.

I expect some sort of anarchy/strongman military dictatorship fragmentation of society is most likely if things keep heading as they are. I don’t see a movement where there is a plan anywhere. Yogi said something to the effect if you don’t know where you are going, you just might get there. I think things are headed there.

The single greatest thing in human history, in my opinion – the US Constitution- has failed or is in serious jeopardy, and I see nothing worthy of taking its place.

Many will accept slavery, but only if they are kept comfortable enough. I am sure there are people who would spend a lot of money figuring out how to adjust that last part to fit their needs.

I have been saying no for decades and today I find myself comfortable with my decisions. I don’t associate with people who hate freedom, God and beer. Not necessarily in that order. I have become accustomed to standing alone yet am not afraid to take a tormentor down with me if need be. The words do not comply are very important today and have to followed.

Alright, I did it. I just argued that that to not exclude the “recovered” is illogical and capricious. I left off the other myriad reasons, like it’s fucked up and bullshit, mark of the beast, luciferase, etc. I’m convinced that roughly half of the population has had Covid. Exempting them from the OSHA mandate would be enough to make it unworkable.

I also said that anyone subject to the rule should be able to demand Comirnaty -the FDA-approved vaccine that is not actually available.

I’m convinced that roughly half of the population has had Covid.

CDC estimated 1/3 of the population back in February.
Remember when people were saying that Covid deaths would increase exponentially? That was always nonsense that implied we should have ALL been dead by last Thanksgiving.

The spread of an airborne virus, however; now, that’s another matter.

It would be next to impossible to stop it from spreading exponentially. Remember “two weeks to flatten the curve”? That was an attempt to stop the exponential spread. That’s obviously a dead issue.

Temporarily accepting the b.s. involved in measuring cases via positive PCR test, there was a surge in cases in the U.S. in recent months. So, given the following analogy:

Exponential Growth:

A lily pond starts with a single lily leaf. Each day the number of leaves will double: 2 leaves on the second day; 4 leaves on the third day; etc.
If the pond is fully covered on the 30th day; on which day is the pond half-covered?

Almost everyone has “had Covid” by now.

All that remains is for some people who have “had Covid” to occasionally come down with different strains (like having two different strains of flu in consecutive years) from time to time. And for the “vaccinated” to keep on “having Covid” … over, and over, and over again because of “original antigenic sin” … and possibly A.D.E.

In other words, for the unvaxxed, the “pandemic” is over.

one of my tenants told me today that she is about to lose her job b/c she has refused the jab & filed a religious exemption–additionally,she told them that if they want to test her on an ongoing basis it will have to be on their dime & on company time–

i’m doing well,thanks 4 asking–i’m mostly over it but i’vebeen very busy w/my work so i’ve been staying away–
i haven’t been on here enough to comment about mark–he’s a great guy so i hope he & his wife are ok–
maybe i’ll write up a short post about the covid–the wuflu is definitely real,in that it somewhat resembled the flu but it was also definitely different,but as anyone who has been reading about covid outside the corporate media knows,it was not that bad–

Ok. This is all progressing much as I predicted. I have being thinking of posting a follow up to my original article, but haven’t got to it.

I expect the executive ordered vaccine mandate by Biden to fail in the courts. However, OSHA is a different kettle of fish. I would expect a high chance that it will succeed in one form or another.

Employers have the legal obligation to provide a safe workplace. OSHA will be able to cite reams of “evidence” that the virus is dangerous, and it will likely thus “make the legal case” that by allowing unvaccinated employees, and/or customers, that the employer is not meeting its legal requirements. It is very much as I expected.

I made the point previously that employers would legally be better covered for risk if they require employees be vaccinated. Note that I am not commenting about the ethics or morality, only the risks associated with requiring, or not, that employees be vaccinated. I am reading where many legal professionals are saying that if employers do not require that employees be vaccinated, it is likely that employees who catch the virus at work will be able to sue for damages owing to employer negligence. This is happening in Australia, too. Again, that was my prediction. And given OSHA seems to be indemnifying employers against injuries associated with the vaccine, it really is a no brainer with respect to risk – employers are far less at risk if they require all employees to be vaccinated.

There will be ongoing pressure on employers, and employees, to get vaccinated. It is a certainty.

The biggest hope that this can be successfully fought is if 1) millions upon millions of employees across all industries refuse to cave in, or 2) if a single critical industry is crippled by an ongoing strike done in the name of all workers (ie if truckers strike and blockade and refuse to restart work until all mandates are lifted nationally.

I do not think that either of these things will happen. First, too many workers are financially incapable of missing even a single pay check. Second, a great many workers agree with the vaccines. Third, self-interest will likely preclude a group such as truckers from striking on behalf of all workers, and 4th, so far, most employees caught in this visa have caved.

So, my expectation is that slowly but surely, maybe even rapidly, workers will be forced to be vaccinated if they want jobs, especially with larger companies. Again, this is not an evaluation of right or wrong. It is simply a prediction as to what is likely going to happen. And so far I have been quite accurate in this.

I have no words of hope, as I really do not see much hope. People must resist these things, but a willingness to resist does not always result in a successful outcome.

Well, given the large numbers of folks that said I had no idea what I was talking about ( in fact the majority were of that opinion)it seems that it either is rocket science or that even on TBP most people were asleep.

I find it improbable that you would have any clue as to employer risk analysis, employment law, OSHA regs, etc. When I posted my predictions I was a line wolf. It is easier to see things now, but far less so when I originally posted.

Neither do I. And for the reasons you listed, but these globalists have concentrated ownership of near everything into just a hand full, and I wonder if it matters to them if a single industry is left. The fewer the better for them.

My wife’s place has let it be known that the cost of the testing will be on the employee, and the group ins. coverage won’t pay for them…..supposedly, the costs cannot even be applied to the deductible.

Yes, ordo, things are looking bad. Seems that folks here now see the reality as opposed to what they had hoped would happen a few months back. They hoped I was wrong, but now they are seeing what the reality of it all is.

The base issue is that about half the population is crazy, about 40% is not crazy, but is too apathetic or desperate to act, and that 10% of the population is awake, not apathetic, and would love to do something about this stuff, but do not know what that something is.

I have thought that the only thing that will change things is if/when people start going hungry. A nation wide truck strike might cause that to happen. But short of mass hunger, I imagine things will keep spiralling down. Hell, even hunger did not cause the people to act in Venezuela.

I really do not know what, if anything, can be done. It is like a slow motion car wreck.

yea, llpoh. A slow motion car wreck that hasn’t even jumped the curb yet. My position is simpatico, except I have anticipated an event horizon, if you will, for a long time……and it’s from the ‘bible thumper crowd’.

I feel sure that nothing will stop what’s coming, but in my community (small)I have been in direct contact with local governing and health ‘authorities’, beginning with a couple of pages of hand written notes from a very long phone conversation. Next, the same evening, I contacted my district county commish, I looked back this evening, and the first I sent written warning to (may, 2020) was a city commissioner and hospital administrator, and the most recent was yesterday a.m.

The local fb (meta) thread I kinda monitor under my wife’s acct, is either looking for a lost cat, or local beauty pageant results. On the occasional serious threads about school closings (which just started back up in the elementary school across from us-announced in a big ‘breaking news’ banner when I checked the local rag (hits online at midnite), comments like “my three kids can’t wait to get their shot”……

I just can’t see this as anything short of biblical, but only the embryonic stages for what’s coming.

Back to OSHA….I thought you would lay out the economic advantage for the corporations…what a win, huh. Of course, I believe the Davos boys have initiated their global corporate technocratic rule

I wanted to post that….I’ve had more experience with NRC and KDHE, the first in a couple different nuke plants out east during refueling outages, and the second under a municipal utilities crew. The state one was weird because it was straight up osha rules, but the state gov. was the agency-idk why.

The NRC exceeded even osha on sign off tags and personnel for different confined space; permit required c.s.; scba, fme areas, etc…..sometimes the different packets hangin on the scaffold leg looked like a book-each trade and inspection crews had to zip tie their packets….and nrc made constant rounds. I sure you know the drills.

The school closing I mentioned, is still listing positive ‘cases’, and the faulty rt-pcr tests are to end 12/31……because too many false positives.

As it appears now, its looking like an ordered destruction, with the speed slowing or accelerating, depending on how quickly the general public swallows the latest lies.

It even seems some of the small victories are also managed by the same group, to keep the level of despair in check until the whole enchilada can be launched.

Who to turn to, where to run? No one and no where on this earth.

To think OSHA actually has the gall to solicit public comment when obviously a huge segment of the population is opposed is shocking. Even more shocking is that so many online activist at tbp have made comments to the effect that “I’m not going to do it… I made comments other places.”

Anyway, here’s what I had to say to them: “None of the COVID 19 *vaccines” have been approved by the FDA except maybe Comirnaty. The approval was written so vague it seems legitimately questionable as to whether even Comirnaty was approved. Irregardless, Comirnaty is not available to the public. Thus it would appear OSHA is involved with enforcing a mandate requiring people to take EUA medication. Coercing people to take EUA medication is an apparent violation on Nuremberg Code, US law and stare laws. These so called *vaccines” also contain aborted baby fetus material that was taken from a living aborted human baby fetus. Shame on you for your crimes against humanity and God Himself. With God’s help you will be held to account for your egregious crimes against both God and Humanity.”

I hope my comment was in large part an accurate accounting of the facts. Last I heard only Comirnaty had been approved by the FDA and some legal scholars were claiming that only the name “comirnaty” has actually been approved but not the drug itself. In any event, no other cv 19 vaccines have yet been approved. If the FDA approved the other so called “vaccines” the why did they not state that they had approved them?

I had no idea I could sue employers and schools in the event I catch a communicable disease. I have missed out on a lot of money over the many years as I feel certain I have caught many flus and colds from coworkers and fellow students.

There is no precedent for it. What is the Cause of Action to do this? It’s never been done; but that won’t stop TPTB from doing it now, specifically for Covid.

It seems there’ll be no need for proof, scientific or otherwise, and that cases will be ruled upon as a matter of res ipsa.

Just remember to sue your employer or any business if you ever acquire t.b., hepatitis, influenza, or even the common cold. Sue, sue, SUE!!!

I suspect the decision to make the rule permanent has already been made by those with the proper pay grade, regardless of how many comments are made by the public. Besides, what makes you think they cannot produce twice as many comments supporting their rule as those opposing it?

THEY DO NOT CARE.

It’s not just this case. They never care. It’s been twenty years since any public comments have been taken seriously by any regulatory agency.
You won’t be driving a stake through anything; but if venting makes you feel good, have at it.
