Tased Motorist to CBP Agent: ‘What the Fuck Is Wrong With You?’
Would-be CBP agent gets the full CBP treatment at an internal checkpoint.
Jessica Cooke, a 21-year-old from Ogdensburg, New York, recently graduated from SUNY Canton with a degree in law enforcement leadership and had already applied for a job as a U.S. Customs and Border Protection (CBP) agent when she was surprised by an impromptu final lesson at a CBP checkpoint on Route 37 in Waddington last week. What she learned—that people who insist on their constitutional rights in this setting run the risk of being roughed up and shot with a stun gun—should help make her a better CBP agent, although CBP may not see it that way.
Cooke was driving from Norfolk to her boyfriend’s house in Ogdensburg, the northern border of which is the St. Lawrence River. If you cross the river, you are in Canada, but Cooke was not crossing the river. She nevertheless became subject to the arbitrary orders of CBP agents by driving through one of the country’s many internal immigration checkpoints, which can be located anywhere within 100 miles of the border (a zone that includes two-thirds of the U.S. population). For some mysterious reason, she was instructed to pull into a secondary inspection area, where she used her cellphone to record a five-minute video of the stop (below).
After presenting her driver’s license, Cooke, who surely learned in college that police (and even CBP agents!) need “reasonable suspicion” to detain someone, asks why she was pulled over. “You guys have no reason to be holding me,” she says. A male agent who identifies himself as a supervisor has no explanation for the detention, but he says Cooke will have to wait for a drug-sniffing dog to inspect her car. “Well, they’d better be here soon, because if not, I’m calling 911, and this can all be figured out,” Cooke says. “You guys are holding me here against my will.” Eventually the female agent who first interacted with Cooke says she seemed nervous—an all-purpose excuse for detaining someone, since people tend to be nervous when confronted by armed government officials.
“Why do you want to get in my trunk when you have no right to?” Cooke asks. That question also reflects a potentially disquieting familiarity with Supreme Court decisions related to traffic stops. Just last month, the Court ruled that, in the absence of reasonable suspicion, police may not extend a traffic stop for the purpose of walking a drug-sniffing dog around the vehicle. But the Court also has said that if a dog alerts to a car (or, same thing, a cop claims that the dog alerted), that is enough by itself to supply probable cause for a search, even though there are lots of reasons (including a handler’s deliberate or subconscious cues) why a dog might alert to a car that contains no contraband.
“If they’re not here within 20 minutes, I’m gone,” Cooke says. “You can leave,” the male agent says. “You can walk down the road right now….Your car’s not going anywhere….I’ll spike the tires.” After Cooke refuses to comply with his order to “stand over there” instead of “here,” they have this exchange:
CBP agent: I’m going to tell you one more time, and then I’m going to move you.
Cooke: If you touch me, I will sue your ass. Do you understand me?
CBP agent: Go for it.
Cooke: Touch me then.
CBP agent: Move over there.
Cooke: Go ahead. Touch me.
CBP agent: I’m telling you to move over there.
At this point the agent seems to grab Cooke, and soon she is lying on the ground, screaming. According to a CBP spokeswoman, the agent “deployed an electronic control device.” Naturally, the government is considering assault charges—against Cooke.
While Cooke is rolling around on the ground, screaming in pain, the agent repeatedly orders her to “get on your stomach.” Her response: “What the fuck is wrong with you?” Also this: “Are you fucking retarded?” And this: “You fucking Tased me, you asshole!” These rejoinders do not have quite the same emotional impact as “I can’t breathe,” especially since Cooke survived the incident. Still, she asks good questions.
The video ends at this point. But according to Cooke, the dog finally arrived, sniffed around her car, and did not alert. The agents opened her trunk anyway. They found no contraband.
If that account is accurate, it is hard to see how the search could have been legal. While nervousness alone might be deemed enough for reasonable suspicion, SUNY Buffalo immigration law professor Rick Su told the local NPR station, “it is not sufficient” to justify a vehicle search, which requires probable cause to believe the vehicle contains evidence of a crime. Su notes that CBP is “starting to use these checkpoints beyond their intended goal”:
It’s an immigration checkpoint. But what it seems from the video is that the interest of the officials is not so much immigration at that point. It’s something else, maybe a drug violation, or other ordinary crimes that they were investigating….This belief actually sets up a very dangerous dichotomy between the exception that’s granted for immigration and the use of immigration checkpoints to [pursue] all sorts of other law enforcement priorities….
[A checkpoint stop] really should be relatively nonintrusive. Ask questions about identification, about residency, and, as long as they are satisfied that there is no reasonable suspicion that there is an immigration violation, most people should be waved through. It should be a relatively quick check.
But because “the exception is so broad,” Su says, the feds are “using immigration checkpoints to enforce other areas of federal law, including the war on drugs.” In other words, the Supreme Court, which has explicitly rejected drug interdiction as a rationale for randomly stopping cars, has effectively allowed such stops within 100 miles of any “external boundary,” as long as the feds claim to be looking for illegal immigrants.
Even though she was preparing for a career as a CBP agent, Cooke clearly was disturbed by this development. But the Watertown Daily Times found some local residents who think her objections are much ado about nothing. “I’m all for border patrol checks,” said one. “Look at the drugs seized weekly by these that would otherwise go right onto the streets. If you have nothing to hide, why be a jerk? Just cooperate.”

One hysterical woman suggested a city-wide curfew throughout the summer, presumably for adults as well as juveniles, between 10 pm and daylight the next morning. HUH???? What’s worse, she was seconded by a large number of people of both sexes and all races. Good grief- are the denizens of a major city with a fairly educated and sophisticated citizenry are ready to lie down on their backs to be treated like 10 year olds when most of them live nowhere near the neighborhoods where this mayhem occurs, what will they accept if and when the social fabric truly unravels?
The craving for some “strong man” type authority always manifests itself in eras of upheaval and transition such as is underway at this time, and is usually accompanied by nostalgia for lost golden ages that never were, a yen for simple minded old-time religions, and worship of the military.
How can a free society based on personal responsibility, and libertarian principles endure when this is how most people seemed to be made? It increasingly seems to me that human nature will have to change on the cellular level to make it possible for a truly free society to sustain itself more than a couple of hundred years.. and when you study our country’s history, you can see that only in a few places for a few minutes at a time, historically speaking, has it been truly free… or truly great.
When I first saw this video a week or so ago, I posted it on my FB page with a bit of a rant about how people should memorize their rights and go en masse to checkpoints like this young woman and immediately, I drew the anger of an old (former) friend who retired from the police department in a semi-large town (at least large enough to have a criminal neighborhood, so he thinks he “understands.”)
Well, after thanking him for his opinion, I suggested he share the video to his page and continue his support of the Border Patrolman’s behavior there, because while I respected his right to his opinion, I disagreed that the young woman had any obligation to move “over there” just because he told her to.
He came back at me with the old “Well, I hope you never need a cop…” to which I politely told him I was friends with the deputy down the road here, and had entertained both the former county sheriff and the present county sheriffs of this and the neighboring county here at the log home for brief visits. I told him that when I get stopped for speeding, which is frequently, having a lead foot… I am polite and courteous, unless the policeman/woman is NOT. Then, I get their badge number. And that I have gotten one police officer reprimanded for being an insolent jerk when there was no reason to do so.
I again asked him to take his one sided discussion to his page, since I’d only posted the video to give people something to think about and that while he thought she should respect their authority and just obey them because they had a job to do, I disagreed because I believed she was doing exactly what she was supposed to do: Questioning their authority.. He couldn’t let it go… until finally, he got the last word in and unfriended me.
So, I continued the discussion for one more comment because, after all, it WAS my page:

First, it is of no benefit to argue with authority. Every time I see some “innocent” person that does this it gets them into trouble. I certainly was not impressed with this “innocent” woman’s behavior. She should have never stepped out of the car and confront the agents with her kind of attitude. You need to show some respect for authority even if you do not feel like it. If she would have complied she never would have been physically treated that way. The Border Patrol appears to have had the right to detain her.

If it’s “yes” then demand a reason why. I hope this young lady sues the shit out of them, if that’s even possible in these dreadful times.

@ Bea… No kidding! A babysitter indeed! I actually have a community page attached to my personal page that is public where I share old photos and memories sent to me in a variety of ways because of who my father is/was (remember that the WWII Veteran (Japan POW) passed in November at age 93) and so I have a large number of friends who are really more acquaintance than friends, but who, due to a great respect for my father, wish to maintain a FB friendship with me. I’ve tried to explain to people that because the community page is “public” it doesn’t matter if I am actually their “friend” or not, but with the generational technology gap we are talking about here, some of them were calling my mother to tell on me if I did not “confirm” their friendship immediately, so I finally just gave in and accepted anyone who claimed connection to my community page for fear that my father’s POW buddy’s cousin’s nephew from Nebraska might get overlooked and I’d get put in timeout. In reality though, when my father passed away, the enormous outpouring of sympathy and respect from his old POW family there (on FB) was enough to make it worth while.
However, my interest in “running” the page has waned somewhat since he’s passed. I did set it up mostly to give him some connection to his old friends since he could no long attend reunions for many years. In that way, it was a good thing. Now? There’s a constant notification alert with folks asking when I’ll post some more photos/stories/etc. Apparently, people get accustomed to being entertained pretty quickly…
The former friend from high school who was a cop? He wasn’t that good of a friend then and really, I was not that sorry to see him go. He only wanted connection to my page because a lot of people “show” up to discuss the photos I post from time to time and I suppose he wanted to claim connection to me… I saw that a lot of his comments referenced our friendship “back in the day.”
So, I was almost famous… and now, I’m not.

I maintain a Facebook page to stay in touch with Air Force friends and then, a few years ago, when my father became housebound, I set up a community page to share photos and stories with his elderly friends around the world (POW from WWII with many brothers and kids met at reunions), and it was a great success that generated a large audience and several hundred people wanting to be my friends. Well, usually it was no big deal to ignore those requests from people I didn’t know (since it was a public page, they did not have to be my friend to see the photos or comment on the posts.) As page manager, I didn’t allow just anyone to post, but I did allow posts to ME where they could submit photos and stories. If I liked them, I gave them posting authority… There are about a dozen people who can post there now.
Well, it didn’t take LONG for me to ignore some elderly person who called and told on me, generating a phone call from Dad that went something like this…
“Uh, now, you know I don’t usually try to tell you what you should or should not do in your personal affairs, but Max Miller’s sister just called and told your Momma that you have not responded to her friend request in over a week. Now, I appreciate you sending me the stories and letters that people send to you on the Internet for me to read but if you are going to be rude to people, I think you need to rethink what you are doing on that Facebook thing of yours.” (Explanation: I printed the responses out for my Father… he was stubborn about the Internet, refused to have his computer ONLINE at all. So, while he really enjoyed the printed photos, comments and dialogue that I showed him and even wrote me a few little snippets to type up and post with a few of his photos, he refused to be involved in that Facebook nonsense. And if you asked him about it, he would tell you it was a complete waste of time. But truly, he enjoyed seeing some of his old friend’s comments and photos, so if he thought I got them via email or on a web page instead of on that Facebook thing? Hey, I explained what the community page was… I explained how it shared my facebook page with me, but was not actually part of it and he said he thought the whole thing was gonna ruin the country and so…I hope you can understand why I just DID IT ANYWAY…)
Since he passed away, I’ve not been quite as active with that page, but man oh man… the notifications continue, asking when I’m going to start posting again. And I really do enjoy that community of people… whether they are/were the greatest generation or not, I can tell you that the outpouring of sympathy and respect for my father’s passing was unsurpassed by anyone who actually lived around him. When they say Semper Fi, they mean it.
Hmmm… What was my point??? Oh, yeah… the cop idiot. And my former friend who was another cop.
My son is here and I asked him what he thought about this video… He said “Well, Mom, it is wrong that you have to obey idiot cops who don’t know the law telling you to do things that they have no reason or right to tell you to do, but that is the times we live in. The choice is to get tased or worse. I’m just a college student, so I have a lot to lose by fighting back. My security clearance might not come through, my car might be ruined by the cops and how could I prove it, they might plant drugs on me and I’d be arrested…” and I realized that my son was right. They have taught him what he needs to learn out of these checkpoint altercations.
And now, I’m really sad because my son is right. He told me that he knows that I fought back several times in “my day.” He saw it… He went with me to protests and he even went with me to the National Labor Board when I gave my sworn statement against the company that suspended me when I was a union steward and stood up to them. He was very proud of me… but he also knows how stressful it was and that even though I “won” my back pay and won on principle? The workers where I once worked have NEVER filed another complaint. Seeing me get suspended taught everyone the lesson it was meant to teach. And the cops tasing people who question their authority is teaching more and more people to just shut up and do what they say, no matter what it is and even if it is illegal… Because if you haven’t got anything to hide, you will just shut up and let them do it.

I admit that the owners can get change here in America by strong arming the population and I admit that I might weigh the benefit of bowing to their authority or suffering the punishment they can inflict to a point. I watched my father protest against bigotry in the 1960s and grew up being the daughter of a “niggerlover”. I think that some things really do matter. I am sad that my son is right about his security clearance issues… he is going to be working in a classified environment this summer as an intern and I worry about what sort of brainwashing he’s going to be exposed to… He was supposed to go to electrical engineering school to learn how to make batteries smaller to get us off the grid, but now he’s gone and done it… got a job where “Big Brother” is going to know his name.

She failed to follow the basic rules in her situation:
1) do not get out of the fucking car. Preferably hang your ID out the window in a bag, and exercise your right to silence, which you can include in the bag. Do not open the fucking window lest they smell marijuana, or alcohol on your breath.
2) the only things you say are, time and again, “am I being detained”, “am I free to go”, or “why am I being detained” if they say you are.
If they say you are being detained, then you must comply.
But they will be very reluctant to answer those questions directly. They will say things like “we need to search your car”, etc., otherwise they can get there asses in a sling if they do not have valid reason for detaining you. If you have not gotten out of the car, you have not rolled down the window, you have not spoken to them, it is hard for them to determine any false reason for detaining you.
It also pays to be rich enough to sue the fuck out of them if they pull this shit.
Australia has fewer enumerated rights, which is outrageous. But they treat citizens a hell of a lot better, best I can tell.

Oh, and do not pull over anywhere unless they specifically tell you you are being detained. “I need you to pull over here.” “No thanks, am I being detained?”. They will do all possible to not answer that question. You do not have to pull over or obey orders unless they say you are being detained.
By the way, it is illegal to lie to a federal officer. Be careful of that. You can lie your ass off to local or state po po, but not to a fed. That means FBI, IRS, Border Agents, etc. That is what got Martha Stewart sent to jail, by memory.

It looks as if we actually are moving into this little log house, so I actually may be back online for good. There will be a hiatus while we sand the flood (can’t help thinking about Karate Kid) and move back into the treehouse for a few days to avoid black lung, but otherwise, we are back in the 21st century.
