Thats it in a nutshell. Shaver was lying stomach-down, face to the floor, hands behind his back. Instead of cuffing him then and there the cops screamed a long series of confusing, unnecessary, and often contradictory, commands. The police could have neutralized him as a potential threat and resolved that specific situation by simply cuffing him when he was stomach-down, face to the floor, hands behind his back. Instead they -the police – with their screaming of multiple contradictory commands, chose to escalate the situation, drag it out, increase the chance of a tragedy.

On his stomach, fingers interlaced behind his head, legs crossed at the ankles.
It should have ended there, all nice and harmless. If they’d done that, it would have been a textbook demonstration of how to cuff someone.
As it turned out, it was a textbook demonstration of the decision making and problem solving ability of the government.

This is example #3486 of how STUPID is the lower end of the Cop Bell Curve. They’re like slavering, rabid dogs, some of them, and it seems that some departments put getting the mad dogs out of uniform as a very, very low priority.

I think the meat grinder idea is great, except that the jury needs some of that also as they are the morons that set the copfuk free.

IMO – the problem isn’t the jury. The jury was instructed to focus only on what Shaver was doing in the instant before the fatal shots were fired. The defense focused on Shaver’s hand moving towards his pants in the second before he was shot. The jury was instructed that this was the only portion of the video that impacted the guilt or innocence of Brailsford. If Brailsford had reason to believe his life was in danger in that isolated instant then he was justified to use lethal force is what the jury was instructed.

These instructions are problematic for many reasons. In this case they are problematic because the police CREATED A SITUATION where the victim/suspect’s odds of performing an action which would make the police fear for their well-being was raised.

Cuff the guy as soon as he is on the floor like the cops should have and… presto – no reasonable chance he is going to be able to inflict harm on a cop. Problem solved, no cop hurt, no civilian dead.

Spend 5 or 6 minutes screaming confusing, contradictory, pointless commands to him… any surprise he eventually did something one of those 5 cops felt threatened by?

The cops CREATED a situation where it was much more likely the suspect would perform an action that would under the current legal doctrine justify lethal force.

The standard of justification for police lethal use of force needs to be re-visited. If the only justification is an officer fear harm to himself then all cops need to do is what they did to Dan Shaver. Scream, threaten, and bark confusing, contradictory orders until eventually the victim makes a mistake. Then fire away.

IMHO, what needs to be revisited is Jury Nullification, (specifically, of instructions from court ‘ossifers’.)

We are free men, living in a free country, serving on a jury of our own free will. What part does “jury instructions” serve in that scenario? How are your instructions even important? If We the Jury do not agree WITH THE LAW we are empowered to DISREGARD it. In any case, we are here to render OUR VERDICT on whether or not what happened was JUST, LEGAL and PERMISSIBLE and IF WE DISAGREE WITH THE LAW then the LAW is wrong!
If more juries nullified more laws then more reasonable laws would be written, and fewer bad ones would still be on the books.

Lawyers on both sides get to question all the potential jury members and get rid of the ones that are too smart. Lawyers and judges don’t want jurors that can reason. IMO the cops shouting contradictory orders was by design. There is an industry of trainers that go to all L.E. departments giving training on how to do this to ensure the cops are always within the law of “I had fear for my safety/life”. Just look into how your town and county spend money on law enforcement training.

Last time I was ‘called’ for jury, there was a notice given about providing reasons of excuse not to ‘serve’.
I informed the judge in no uncertain terms that if the trial had anything to do with a criminal conviction by a popo’s testimony, I would vote not guilty.
She was nonplussed.
Then, and this was/is a blatant lie, that I listened to R. Limbaugh every day.
That seemed to get her attention. (wtf?)
I was dismissed.
