That would simply prove her point—that men don’t have any baseline control of themselves.
Men control themselves partially out of conscience and partially out of fear of repercussions. Removing the repercussions – by treating all men the same – removes the disincentive to rape. Btw, that’s also why rape shouldn’t be a capital crime – because it removes any reason not to kill your rape victim.

So, by extension, it would seem that you’re arguing that capital punishment prevents people from murder. I don’t believe that’s the case (though I’m not against the death penalty for other reasons besides supposed deterrence).
