LIBERTY WINS ONE FOR THE FOUNDERS
On a 6-3 vote, with conservatives John Roberts and Antonin Scalia joining the 4 liberal judges, the Supreme Court just ruled that a routine traffic cop stop in Nebraska resulted in an illegal search.
Driver (Hispanic) pulled over on a traffic violation. License and registration are legit. Cop issues a warning, then asks to search the car. Driver says no. Cop tells driver to remain in place until another cop with drug-sniffing dog arrives. Dog alerts to drugs. Cops search car, find bag of meth, and arrest driver.
So sorry, said the Supreme Court, that was an illegal search and violated the 4th Amendment. Cop had NO REASONABLE SUSPICION TO CONDUCT THE SEARCH.
You might think that’s a minor victory, but it isn’t. “Driving while black (or Hispanic, or young)” will get a lot easier on minorities and youths who get pulled over for minor traffic violations and end up being further detained while cops conduct an illegal search, which most of the time comes up empty anyway. All that just went bye-bye.
