Speeding is a Capital Offense

It is something to think about as we head into the Farce of July and the sickly celebration of the freedoms we lost a long time ago. Among these, the right to not be shot to death in the streets over traffic offenses.

A couple of years ago, the nine Judge Dredds who quite literally are the law – by dint of decreeing what the law is, as opposed to what the Constitution actually says –  ruled (a most appropriate term) that if a speeding motorist flees from an enforcer of the law, that enforcer is empowered to execute him. (News story here.)

The case at issue was Plumhoff vs. Rickard.

Back in ’04, a Memphis, TN law enforcer named Vance Plumhoff tried to pull over a white Honda driven by the now-deceased (via-Plumhoff) Rickard for the egregious offense of driving with one headlight out. Rickard attempted to flee – a not unreasonable act these days, given forced enemas and anal probes (also ruled “constitutional” by The Nine Dredds), the planting of drugs and trumping-up of evidence, wood shampoos, Tazerings and so on.

A chase ensued.

Eventually, Rickard’s car was cornered – and even though all that had transpired thus far was some illegal high-speed driving – by both parties, it’s important to point out – when Rickard “refused to surrender,” Plumhoff fired his gun at him three times.

This frightened Rickard.

For unfathomable reasons, he imagined his life to be in danger. He thus hit the gas and attempted to get away – whereupon Plumhoff emptied his semi-automatic pistol’s magazine (12 more shots) into the bodies of both Rickard and his passenger, both of whom were rendered immediately “compliant” – and very dead. Of a piece with the summary execution of Miriam Carey – do you recall? – who was gunned down in living color and with her baby in the passenger seat, just a hop skip and a jump away from the den of the Nine.

And, of course, Philando Castile – executed by a law enforcer named Geronimo – who “feared for his safety” after Castile explained he had a legal firearm (and permit) on his person. Castile didn’t even commit a moving violation. He was pulled over because the enforcer thought he looked like another person who had apparently committed a robbery.

Postmortem, Rickard’s daughter sued Scharfuhrer (sergeant) Plumhoff for using excessive force. The Nine ruled not so. Scharfuhrer Plumhoff acted “reasonably,” they concluded.

Herewith the reasoning of The Nine, in the words of America’s very own Roland Freisler, Samuel Alito:

“It is beyond serious dispute that Rickard’s flight posed a grave public safety risk, and here the police acted reasonably in using deadly force to end that risk.”

But what constitutes a “grave public safety risk”? Pretty much whatever the law enforcer says – no, believes – it is.

We live in the Era of Officer Safety, an offshoot of the broader Safety Cult.

A moment’s hesitation or questioning of barked orders amounts to “resisting” and a “threat” to “officer safety.”

It is more like a challenge to their authority – which is the real issue, never spoken but understood by everyone.

This bears keeping in mind as we approach the Farce that is the Fourth – and the checkpoints that will be peppered across the land of the “free” to make sure everyone is “safe.”

Note that in this Plumhoff vs. Rickard case, as in so many similar cases, no one was harmed. Except of course for Rickard. According to Alito and the Nine,  the possibility (however theoretical) that “someone” might have gotten hurt constitutes sufficient justification to kill the offender.

This means you. And me.

Unless you are one of the Unicorns who never “speeds” – and so never “poses a grave public safety risk” – as all “speeders” do, we are constantly assured.

Yes?

In my own state of Virginia (and several others) it is “reckless” driving – by definition, under the law – to drive even 1 MPH faster than 79 MPH.  Even when the posted limit is 70, as it is on many Virginia highways.

And “reckless” driving surely qualifies as a “grave threat to public safety.” If not, words have no meaning. 

Of course, 81 on the highway (posted 70, everyone driving at least 75) is as “reckless” as Rachel Madow is feminine.

And yet, the hapless victim faces the Hobson’s choice of pulling over – and being cow-belled with what are arguably “excessive bails and fines” – forbidden by the Constitution but approved by the Nine – or doing the not-unreasonable thing and attempting to get away, per Rickard.

Either way, the sentence could very well be . . .  death.

There is a very real threat to our safety posed by law enforcement, which has all-but-been-given official license to kill for whenever they ululate the magic words, Officer Safety.

It is not merely tempting to hit the gas and make for the next exit ramp, it is arguably reasonable. But then you have become a “grave public safety risk.”

Catch 22.

It is interesting to note that it is never considered a “grave public safety risk” for the state’s praetorians to speed nor to let loose a fusillade of gunfire in public. Apparently, it is impossible for a law enforcer to drive too fast, or recklessly. And the state’s praetorians always hit what they’re shooting at. Yes?

Well, no.

Rickard’s hapless passenger, for instance.

Judge Dredd is no longer a comic book character. His signature line – “I am the law!” – is now our officially approved reality.

Times Nine.

I qualify this by saying up front I’m neither a cop hater nor a cop sucker. As I see it there are 3 primary reasons civilians will continue to be killed by cops.
1) Far and away the main reason cops can kill without being held accountable are wrongful death suits which can essentially bankrupt a municipality.
2) Qualified immunity which is related to reason one and is basically a license to shit in the street.
3) The brotherhood. A cop that outs another cop is shunned if not worse.

I’m not saying any of this is right. It’s not. But it’s also why nothing will change.

Peters doesn’t do his cause any justice by using an example such as this,nor by tying it to the Philando
Castile or Miriam Carey cases.
While “normal” drivers sometimes do panic & run when a cop attempts to pull them over,more often it is someone w/something to hide and they are using a multi ton weapon to get away-they need to be stopped.

Nothing is more normal than seeking to evade highway robbers, extra road taxes, higher insurance premiums. And panic has never had anything to do with it, my case.

“Where there’s smoke there’s fire” is shopworn sheepshorn-speak.

Which puts “need to be stopped,” by emptying multi-round mags in the general direction, into categories envy (who does that non-supplicant think he is?), vicarious highway robbery, or, as Peters refers to them (I don’t know why), “clovers.” There were plenty of tories, both sides, on the ground in 1776, too.

The context that’s not ever included in these devolution stories is that cops have been putting people under the jail, as my old man used to put it, forever. It is not a new thing. Internet, guys like recently departed William Norman Grigg, publicizing the “hither swarms of Officers to harass our people and eat out their substance” just make it seem like it’s new.

If your local cops kill people unreservedly, you really need to move elsewhere. What is your home / job / city worth if you have to die to live there?
Maybe you should start an “action”. Pick a day like May 25 (not a holiday, a work day) and stay home. Call it “Adult Right to Life Day”. Repeat as necessary (not just annually).
[If my life matters, then I must take steps to protect it. On May 25, I am …. staying home. Because police in my city are killing people just like me, for traffic infractions, collecting rainwater on my own property, or just because they can. On May 25 I will not be buying anything, selling anything or doing anything, just to make sure I can see the sunset that day. If you agree that your life is worth preserving, then please stay home that day too. And call your legislators to Remove Qualified Immunity for police who deliberately kill to punish minor crimes – because dead taxpayers can’t vote, pay taxes or lobby legislators. And they can’t love, support or raise their families either.
End Qualified Immunity for Cops who kill irresponsibly – while you still can.]

Here is my solution to cops killing innocent people: when the jurisdiction pays the family of the deceased to settle the lawsuit that always comes, the money should not come out of the municipal/county budget, i.e., taxpayers. Instead, the money should come from the police pension fund.

I suspect that would cause our men in blue to think twice before they unload their weapon on the next citizen.

I no longer celebrate July 4th in these fucked up states of america. Why would I, there is nothing to celebrate but a lot to regret. I consider ALL COPS as armed and dangerous and give them the respect they so richly deserve.

If the stupid sonofabitch had pulled over and acted courteously instead of acting out a death wish then he would still be alive today. Just for the record all tickets, levies, summons, taxes, and notices to appear are death sentences. If you don’t do as ordered, refuse to correct your behavior, resist arrest, and put up a physical fight then you will be killed. All government paperwork says is “Pay money or die.” That’s it. Howbeit though that you don’t give any mention to the police officers that forfeit their lives all too often around the country while protecting you and I? Howbeit you don’t mention the continual harm people like the deceased bring to our communities. Trash is trash and trash attracts flies. As far as I’m concerned, more power to the cops, and the sooner they are issued automatic weapons, wipe their asses with the Miranda Rights cards, and throw away their handcuffs and tasers then the safer our streets will be, and the better off us law abiding taxpaying citizens will be. If any snub nosed liberal out there gives me a dislike, I consider it all honor, and pray to Christ that the next cadaver spread eagled on the asphalt on the six o’clock news, while your flower child, rainbow significant other weeps their little third gender heart out, will hopefully be YOU! thanks
