Rand Paul to oppose Trump’s emergency declaration, giving resolution votes needed to pass

Sen. Rand Paul of Kentucky says he will back a resolution that blocks President Trump’s declaration of an emergency at the southern U.S. border, giving it the votes needed to pass but not enough to turn back a presidential veto.

Mr. Paul, a Republican, announced his decision during a Saturday speech at Western Kentucky University, according to the Bowling Green Daily News.

“I can’t vote to give the president the power to spend money that hasn’t been appropriated by Congress,” Mr. Paul said. “We may want more money for border security, but Congress didn’t authorize it. If we take away those checks and balances, it’s a dangerous thing.”

He joins Republican Sens. Susan Collins of Maine, Lisa Murkowski of Alaska and Thom Tillis of North Carolina and 47 Democrats in backing the disapproval measure, giving it majority support.

The House already moved to overturn Mr. Trump’s declaration. The 245-182 vote was a major rebuke of the president, though there was there’s more than enough GOP support to sustain his veto.

A similar scenario is now set to play out when the Senate votes this month.

Mr. Trump declared an emergency to shift around federal funds and build his U.S.-Mexico border wall, after Congress didn’t give him the amount he wanted. He says the wall is needed to thwart drugs and deter illegal immigrants.

Democrats and some Republicans say it’s a power grab that skirts Congress‘ constitutional power over the nation’s purse strings.

Rand Paul is of course right in spirit, but he’s quixotically tilting at Constitutional windmills. That document has long since been abrogated and he is falling into the Alinsky trap: “Make the enemy live up to its own book of rules.” This is for all of the marbles and he’d best realize it soon.

What those who disagree with Paul are saying is, “If Trump does it, it’s okay to shit all over the Constitution, but if the Democrats do it, that’s terrible!” If you think a wall is more important than the US Constitution, you need to check your priorities.

Trump’s not spending money that hasn’t been appropriated. He’s redirecting money within the defense budget that HAS been appropriated, in accordance with the rules established by the duly-passed National Emergencies Act of 1976. Rand Paul is just flat-out wrong.

Trump has the authority. Congress gave it to him and they can’t take it away without changing the laws. That’s not going to happen.

Trump also has quite a few actions available to him that he doesn’t need Congresses approval for as part of the Executive Branch functions. Just because Paul says something is unconstitutional does not make that so. He is conflating spending with emergency executive action. Won’t fly.

He doesn’t have to spend money that hasn’t been appropriated.(“Allocating” is an almost meaningless process, it’s appropriating that matters.) The money has been appropriated. Trump is just shifting it around – as allowed by the law passed by Congress. Plus he’ll first use the $1.3B that was specifically appropriated two weeks ago while the court challenges to the “emergency” are working their way through the courts.

late last spring or early summer my congressman had a blurb in his weekly e newsletter–
there was approximately $12 b in appropriated but unspent $ in the budget & it was being redirected to this or that to do all these wonderful things–
everyone should call their republican congressman & ask why that $ wasn’t spent on the wall–

Congress absolutely gave the President the authority to declare a National emergency. That is not in dispute. Under that declaration, the President may take the steps that he outlined. That is very well spelled out in the law. Paul simply does not agree with the law and is using Pelosi’s flawed argument to justify his vote. It doesn’t. He is doing a John McCain and we all know it. Just like with McCain’s vote, it is not going to mean anything in the end. Obamacare will die and the emergency declaration will stand. Also, in both cases, people will not forget. Never Trumper Republicans are just as dangerous as radical Dems. Vote them out. Their grandstanding does not keep us safe, it harms all of us.
