Senate to Consider American Job-Busting Bill; Crunch Time for U.S. Workers

Shortly before Congress adjourned for its summer break, what it aggrandizingly likes to refer to as “constituent work days,” the House of Representatives passed a horrible immigration bill, the Fairness for High-Skilled Immigrants Act. U.S. Rep. Zoe Lofgren (D-CA), who never met a bill to expand the foreign-born labor pool at American workers’ expense she didn’t lovingly embrace, championed H.R. 1044, urging her colleagues to vote for the bill which she claimed would make a “modest, but important change to our immigration laws.”

In short, the Fairness for High-Skilled Immigrants Act will prioritize for employment-based Green Cards nationals from one country, India. Over the next decade, and assuming the bill which will end country caps becomes law, an estimated 600,000 Indian nationals will receive their Green Cards. Other nationals hoping to work in the U.S. will be shut out. Lofgren and other supporters argue that the “fairness” from the bill’s title is required because of the huge backlog of Indians awaiting their Green Cards.

But why is the backlog so long for India? The H-1B visa, originally temporary for three years with a quasi-automatic three-year renewal, is now dual intent, meaning that the visa offers the path to a Green Card. For a long-term perspective on how the H-1B has changed over the decades, in the early 1990s, “60 Minutes” correspondent Lesley Stahl in her segment titled “North of the Border” laughed out loud at the suggestion that a six-year visa could be considered temporary. But now the H-1B all but guarantees permanent residency. And Indian multinationals, such as Infosys, Tata and Wipro, have long dominated the H-1B visa.

When Congress returns after Labor Day, the Senate will take up S. 386. In the Upper Chamber, the bill will receive more resistance, although not necessarily enough to kill it, than it did in the House. The bill, originally sponsored by senators Mike Lee (R-UT) and Kamala Harris (D-CA), has 34 cosponsors, including 19 Republicans. The 34 are cravenly indifferent to the U.S. job loss that Americans have suffered because of the harmful H-1B. Not only has cheap labor displaced Americans from their well-paid jobs, they have had to suffer the indignity of training their less-qualified replacements, and then have to try to put their lives back together, no small task for someone who is unemployed and middle age in a country where it now seems acceptable to openly discriminate against those over the age of 50.

Advocates on both sides of the bill are gearing up for an intense fight once Congress reconvenes. The pro side is extraordinarily well-funded, and plugged in, while the groups fighting to protect U.S. workers are counting on a grassroots uprising, the kind that defeated the 2013 “Gang of Eight” amnesty and employment-based visa giveaway.

But while the advocates that hope to defeat the misnamed Fairness for High-Skilled Immigration have focused their attention almost exclusively on retaining the country cap guidelines, a larger threat looms. Immigration Voice, one the deepest pockets pro-H.R. 1044/S. 386 advocates, is considering expanding its goal to include the tens of thousands of Chinese nationals also in line for their Green Cards. H.R. 1044 does little for the Chinese employment-based visa holders, an injustice, according to Immigration Voice and its ally “Support All of Us,” that should also be corrected. As Support All of Us expressed its concerns to Immigration Voice: “A pie doesn’t get bigger when anyone gets a larger slice.” Green Cards all around for foreign nationals and let U.S. workers try to survive as best they can.

The threat is real. A Washington Examiner op-ed supported Senator Rand Paul’s radical bill, the BELIEVE Act, to more than double employment-based visas. This is an American job-busting idea so far off the rails that it’s impossible to digest. Paul proposes that the total number of employment-based visas allotted increase to 270,000 from 140,000, and would also grant work permission to foreign nationals’ spouses and their teenage children.

For American workers, the post-Labor Day legislative session represents crunch time; it’s well-heeled lobbyists and their compliant congressional friends versus citizens who repeatedly have expressed a desire for less immigration. The outcome is uncertain, but crucial to the nation’s future.

Where has the uproar been over how good paying transportation jobs being farmed out to low skilled (illegal) aliens over the last 30 years. In the 70’s a hard working over the road truck damn near made $100,00 a year. Walmart comes fairly close today advertising for drivers that can potentially make $89,000 a year. I’m not feeling the angst about “American” coders and programmers not being able to compete against Microsoft subsidized Indians. Had it good while it lasted. Tough shit. Learn to drive a truck and go to work for Walmart.

Wallmart pay is low, but the benefits are ok. I am going by what wall mart truck drivers have told me. I delivered to the distribution centers a lot in the past. Trucking pay is shit. If you add up the hours you work you’re lucky to make minimum wage. Not to mention the damage the job does to your health.

After reading this last post, I am giving up the hope that the US can be saved in some form. The constant barrage of actions taken by our own Congress to destroy citizen workers, the endless MSM harassment of patriots, and the strain of hearing things that are patently false spoken as the truth has worn down my faith in our ability to prevail.

Gave up on truck driving after 25 years. Pay increase is hardly measureable and foreigners are here to stay! Make more money now escorting oversized loads and we’re all deplorably deplorable !

I was having a discussion re this very issue last night.

1) I think the US, or any nation, should take all the high-skilled people they can get, particularly from the science, tech, etc. fields, so long as the immigrants commit to assimilate into the US culture. Why would a country not do this?

2) The US simultaneously needs to enact measures to force the almost 40% of working age non-workers back into the workforce – ie. by eliminating welfare. Unskilled migrant numbers need to be taken to zero.

3) despite what some say, there is a shortage of very top level IT people – ie top level software engineers. Sure there are great swathes of unemployed or underemployed software folks – but they are not top level. And hence why the Googles, Amazons, Microsofts, et all pay young people massive salaries – some companies are paying new grads $100k signing bonuses. They cannot get enough top level employees, and search for them world-wide.

Currently, the average tenure for software engineers at top level firms is under two years, as firms continually bid up the market, and engineers move to where the highest salaries are.

4) the software/tech mills should be starved out of the business by eliminating the H1B visas – ie those firms that are hiring average skill types and paying under the going rate. Instead, the number of permanent, not H1B slots, should be virtually unlimited for skilled migrants. The H1B system is more like indentured servitude for those labor mills, and should be eliminated. By making the employees permanent immigrants, it will put US workers back in competition for those jobs, which are not being filled by the very best. Plus there will be flow through benefits such as increased entrepreneurial activity owing to ever increasing numbers of skilled migrants.

Who said cheap labor? I said high skilled. Countries need all of that they can get. I also said no unskilled.

I also said there are not enough extremely skilled to fill the openings that exist. That is the fact of it. If you do not let them – the cutting edge tech companies – fill those roles, they will offshore the work, thereby creating competition for the US.

Unclear thinking. What are you doing to other countries taking their skilled workers? Don’t THEY need them? The idea used to be people came to the U.S. from other countries to get a great education and RETURN HOME with skills they could apply to improve their countries.

I don’t see how a brain drain of other countries helps the world overall.

And the message I get from your post is that there aren’t enough smart people in this country. That’s just flat-out wrong. With a population of 330 million, there’s plenty of talent here!

To import cheap labor to displace Americans is just capitalism. Then the displaced workers will get on welfare or another government dole, that will be paid for by the displacing Indians tax dollars. Sounds like progress is being made. Get used to it. And if it makes the stock market pump some that’s all that matters. I suggest that we all vote harder than before. Because we know from experience that voting changes everything.

This has been going on for decades . Our illustrious alleged representatives do not give a shit about you me or the man behind the tree ! They don’t care about economic realities for working Americans ! All they give a shit about is their circle jerk of wealthy contributors and assuring deals for friends and family and as for Mr & Mrs Joe six pack Fuck Them dry !
It happened to the steel industry and shipbuilding in the 80’s and the auto industry has been hobbling along down sizing and getting bailed out here and there !
Wow now it’s the white collar jobs taking the shit ! The industrial jobs were exported intentionally for what as a nation is a short term gain that the true detriments are surfacing in every population center in America .
Now it is different now it’s in your face fuck you we will import someone to take your place for way less than you get paid . Any wonder why every construction site and home improvement contractor has 5 foot nothing brown employees 20 to 30 MILLON roaming our nation and who is fighting to protect them ?

Fact is, the little brown fellas are taking over because the homegrowns have no desire to work like that because they can’t work under the table like many of the little brown fellas do.
