Judiciary Branch Has Self-Abolished

The US no longer has a judiciary. This former branch of government has transitioned into an enabler of executive branch fascism.

Privacy is a civil liberty protected by the US Constitution. The Constitution relies on courts to enforce its prohibitions against intrusive government, but if the executive branch claims (no proof required) “national security,” courts kiss the Constitution good-bye.

Federal judges are chosen by the executive branch. The senate can refuse to confirm, but that is rare. The executive branch chooses judges who are friendly to executive power. This is especially the case for the appeals courts and the Supreme Court. The Justice (sic) Department keeps tabs on district court judges who rule against the government, and these judges don’t make it to the higher courts. The result over time is to erode civil liberty.

Recently a three-judge panel of the US Appeals Court for the District of Columbia ruled that the National Security Agency can continue its mass surveillance of the US population without showing cause. The panel avoided the constitutional question by ruling on procedural terms that NSA had a right to withhold the information that would prove the plaintiffs’ case.

By refusing to extend the section of the USA PATRIOT Act—a name that puts a patriotic sheen on Orwellian totalitarianism—that gave carte blanche to the NSA and by passing the USA Freedom Act, Congress attempted to give NSA’s spying a constitutional patina. The USA Freedom Act allows the telecom companies to spy on us and collect all of our communications data and for NSA to access the data by obtaining a warrant from the Foreign Intelligence Surveillance Act (FISA) Court. The Freedom Act protects constitutional procedures by requiring NSA to go through the motions, but it does not prevent telecom companies from invading our privacy in behalf of NSA.

No one has ever explained the supposed threat that American citizens pose to themselves that requires all of their communications to be collected and stored by Big Brother. If the US Constitution was respected by the executive branch, Congress, the judiciary, law schools and bar associations, there would have been a public discussion about whether Americans are most threatened by the supposed threat that requires universal surveillance or by the loss of their constitutional protections. We all know what our Founding Fathers’ answer would be.

CHICAGO: WHERE BLACK LIVES DON’T MATTER TO BLACKS SO MUCH

I’m sure Obama will be moving his family to the South Side of Chicago to be with his brothers after he exits the White House (racist). Imagine the hope and change he would bring by living amongst his diehard voting constituency. How come black thugs aren’t obeying the toughest gun laws in the nation? Don’t they know it’s a crime to illegally use a gun in Chicago? There should be a law. Why do black lives only matter in the rare incidence when a black man is killed by a white man? Why don’t they matter so much in the 93% of the incidences when a black man kills a black man?

Three killed, 31 wounded in weekend shootings across Chicago

Three people were killed and at least 31 others, including a 7-year-old girl, have been wounded in shootings across Chicago since late Friday.

The most recent fatal shooting happened about 1 a.m. Sunday in the Chatham neighborhood on the South Side.

Two boys, ages 16 and 17, were standing on the sidewalk in the 8200 block of South Ingleside when someone walked up and fired shots at them, according to Chicago Police.

The younger boy suffered a gunshot wound to the chest and was taken to Advocate Christ Medical Center in Oak Lawn, where he was pronounced dead at 2:05 a.m., according to police and the Cook County medical examiner’s office. His name was withheld Sunday pending family notification.

The older boy was shot in the leg and also taken to Christ Medical Center, where his condition stabilized. A police source said the 17-year-old is a known gang member.

About two hours earlier, a 44-year-old man was shot to death in the West Englewood neighborhood on the South Side.

Adrian Jeffries was standing on the sidewalk about 11:05 p.m. in the 6000 block of South Throop when someone got out of a black SUV and opened fire, authorities said. He was struck in the head and back and was taken to Mount Sinai Hospital, where he was pronounced dead at 2 a.m.

Got White Privilege? College Students Flunked for Using “Oppressive and Hateful Language”

Free speech has officially failed.

Reports are pouring in that the politically-correct politics surrounding the term ‘white privilege’ are gaining traction at many universities.

Plenty of professors at various colleges across the nation are confronting students with racial and ethnic issues, and decimating their grades if they aren’t sensitive enough to the use of delicate terminology.

Campus Reform reported on political correctness gone too far:

Multiple professors at Washington State University have explicitly told students their grades will suffer if they use terms such as “illegal alien,” “male,” and “female,” or if they fail to “defer” to non-white students.

According to the syllabus for Selena Lester Breikss’ “Women & Popular Culture” class, students risk a failing grade if they use any common descriptors that Breikss considers “oppressive and hateful language.”

At another school, a course in comparative ethnic cultures docks students who fail to recognize “white privilege” and use terms like “illegal alien” to describe people who circumvented immigration laws and came to this country without permission.

Economics 102: WalMart Cuts Worker Hours After Hiking Minimum Wages

This year, some American executives who heeded loud calls for across-the-board wage hikes for America’s lowest-paid workers received a complimentary refresher course in undergad economics courtesy of the free market.

Take Dan Price for instance, the 31-year old CEO of Seattle-based Gravity Payments Systems who found out the hard way that setting the pay floor at $70K comes with all manner of unintended consequences.

And then there’s Wal-Mart.

Earlier this year, the retail behemoth became one of several corporate heavyweights to raise wages for its meagerly compensated workers, around 500,000 of which are now set to receive at least $9/hour and $10/hour by Q1 2016. The move will cost somewhere around $1 billion this year. 

Now one thing that should have been abundantly clear from the start is that if ever there were an employer that could ill-afford a $1 billion across-the-board pay raise without immediately making up the difference by either firing some employees, cutting hours, or squeezing the supply chain it’s Wal-Mart. After all, they’re the “low price leader”, and you don’t hold on to that title by passing labor costs on to customers.

Predictably, the company moved to extract more “value” from its suppliers and when that didn’t prove sufficient, the folks in Bentonville brought in the “plumbers.”

But the story didn’t stop there. Late last month we highlighted an internal memo circulated at Arkansas recruiting firm Cameron Smith & Associates which looked to be an attempt to prepare the firm’s employees for layoffs at Wal-Mart’s home office. Then, not a week later, Bloomberg ran a story detailing the grievances of some senior Wal-Mart employees who suddenly realized that although they may still be making more than their subordinates, the wage hierarchy had been distorted and that distortion had nothing to do with merit. As we put it, “higher paid employees don’t understand why everyone under them in the corporate structure suddenly makes more money and if people who are higher up on the corporate ladder don’t receive raises that keep the hierarchy proportional they may simply quit which means that, for Wal-Mart, raising the minimum for the lowest paid workers to just $9/hour will end up costing the company around $1.5 billion if you include the additional raises the company will have to give to higher paid employees in order to retain their ‘talents’and avoid a mid-level management mutiny.”

Well, don’t look now, but undergrad economics is rearing its ugly again at Wal-Mart as the retailer cuts workers’ hours in a desperate attempt to offset wage hikes. Here’s Bloomberg with more:

It’s Time to Pile Back Into Gold Stocks

The blessing and curse of being a contrarian is this: an inevitable outcome is recognized well before it comes to fruition. Even though profitable opportunities may be identified well in advance, it can take so long for hallmark events such as capitulation to happen, that it gives ample time to second guess one’s convictions.

We’ve believed, even before the correction that has recently hit U.S. markets, that the bear market for gold was long in the tooth. With asset bubbles all over the place, it has seemed for awhile that gold and silver were the only assets that were reasonably priced. Then yesterday, our friends at Palisade Capital sent us over five charts on why they believe that gold stocks are the most undervalued that they have been in decades.

We tend to agree with that sentiment, which is why in last week’s chart of the week we predicted that gold had already bottomed and that it had nowhere to go but up. (We further predicted that other commodities such as base metals would continue to get routed for the time being, and that U.S. equities would not return to the same levels for awhile.)

Say Goodbye to Normal

The tremors rattling markets are not exactly what they seem to be. A meme prevails that these movements represent a kind of financial peristalsis — regular wavelike workings of eternal progress toward an epic more of everything, especially profits! You can forget the supposedly “normal” cycles of the techno-industrial arrangement, which means, in particular, the business cycle of the standard economics textbooks. Those cycle are dying.

They’re dying because there really are Limits to Growth and we are now solidly in grips of those limits. Only we can’t recognize the way it is expressing itself, especially in political terms. What’s afoot is a not “recession” but a permanent contraction of what has been normal for a little over two hundred years. There is not going to be more of everything, especially profits, and the stock buyback orgy that has animated the corporate executive suites will be recognized shortly for what it is: an assest-stripping operation.

What’s happening now is a permanent contraction. Well, of course, nothing lasts forever, and the contraction is one phase of a greater transition. The cornucopians and techno-narcissists would like to think that we are transitioning into an even more lavish era of techno-wonderama — life in a padded recliner tapping on a tablet for everything! I don’t think so. Rather, we’re going medieval, and we’re doing it the hard way because there’s just not enough to go around and the swollen populations of the world are going to be fighting over what’s left.

It’s official: the Left has gone insane. We don’t mean metaphorically insane – we mean true foaming at the mouth, howling at the moon, hibbity-bibbity-bibbity lip-burbling, farting in the bathtub and snapping at the bubbles while giggling insane. And they’re running around loose!

Consider these factoids from just the past few days: Hillary Clinton compared the GOP to terrorists because they don’t support the killing, dissection, and sale of dismembered infants. Not certifiable enough? Then how about her claim that any GOP candidate who supports enforcement of our border and immigration laws is essentially a Nazi who plans to “unleash a massive law enforcement effort– including perhaps National Guard and others–to go and literally pull people out of their homes and their workplaces, round them up…put them in boxcars.”

•In another class, students will lose one point every time they use the words “illegal alien” or “illegals” rather than the preferred terms of “‘undocumented’ migrants/immigrants/persons.”

Multiple professors at Washington State University have explicitly told students their grades will suffer if they use terms such as “illegal alien,” “male,” and “female,” or if they fail to “defer” to non-white students.

According to the syllabus for Selena Lester Breikss’ “Women & Popular Culture” class, students risk a failing grade if they use any common descriptors that Breikss considers “oppressive and hateful language.”

The punishment for repeatedly using the banned words, Breikss warns, includes “but [is] not limited to removal from the class without attendance or participation points, failure of the assignment, and— in extreme cases— failure for the semester.”

THE HOUSE I LIVE IN …. (or, why can’t we all get along?)

Newark was a relatively nice place when we first moved there around 1958. It was clean and it smelled nice. You had a Portuguese section (still there), Pollacks, Dago’s, Irish, Krauts, Russians, and Jews all in close proximity, and getting along just swell. Sure, some of the kids didn’t like me, the nazi Kraut, but that was usually after their parents told them I was evil. Five year old kids, left to themselves, are generally not political and/or racist. We were happy just to get a team together for stick-ball (in the streets), or even for a good game of hide&seek … nationality or color really didn’t cross our young minds. Anyway, the choices of various ethnic foods from all the tiny mom&pop deli’s was simply astounding, and delicious. Not many kids have an amusement park a stone’s throw from their house! It was a nice way to grow up, considering Newark is a big city.

By 1968, all those shops were gone, the blacks rioted and burned down nearby Springfield Avenue, and other areas … and they ruined everything. The lovely ethnic diversity never recovered, as Newark today is a one or two color shithole. Oh, noes … you’re a raayccisss prick! Bite me! That’s exactly what happened. I was there, saw it with my own eyes. To answer my own question, I think I could get along with any group of people, except blacks. They really need their own state. In another thread I proposed we give them New Jersey …. and throw in Connecticut, if necessary.
