Fixing The Problem

Whether you are a “law and order” type or otherwise. In fact, especially if you are a “law and order” type. Because, simply put, cops are not subject to the same law and order as the rest of us – and that is a problem.

For them as much as us.

For them, because it has created an arrogance – a recklessness – that encourages the extra-legal excesses that we’re seeing on video almost every day (these videos probably capturing only a small slice of what actually goes on every day).

For us, because we are increasingly threatened by these excesses.

It is worrisome and very dangerous – for everyone.

They fear and loathe us and we return the sentiment, with predictable results.heroes 2

They escalate, making retaliation as inevitable as fall coming after summer.

This is not to condone much less encourage but rather to explain. And – hopefully – fix.

People – not just “blacks” – are angry. With cause. It is not good.

How to dial it back?

One simple measure would be to apply the law equally to everyone. Especially to law enforcement. It is madness that this is currently not the case.

An example of which is this video, which shows the final moments of a chase. The man surrenders. He gets on his knees, then on the ground. He is totally submitting and obeying at this point; there is no Threat to Officer Safety. But two officers beat the man regardless while other officers stand and watch and do not arrest the officers perpetrating a physical assault in broad daylight. This was – as the ancient saying had it – a Kodak Moment.

Actually, a video moment.

Were it not for the video, the two cops administering the beatdown would probably never have been charged (as they subsequently were, no doubt with great reluctance by a DA who had no choice because of the video, which was shown on live TV). But that is not the take-home point. The take-home point is that if you or I had rained punches on some other person in plain view of a cop, we’d have been immediately arrested and handcuffed and taken to jail.

But because the two thugs happened to be wearing uniform, the others in uniform stood by and did …nothing.hero beat down

One example.

Here’s another:

If you, an ordinary Joe (or Jane) have a permit to carry a gun, you are aware (because it is hammered into you as part of the permitting process) that you will be held severely responsible both criminally and civilly in the event you handle your firearm in a criminal or reckless or legally unjustified manner.

If, for instance, you brandish your firearm in a threatening manner – such as lifting up your shirt to show someone you are packing and not in a friendly way – it is a criminal offense. You’ll be arrested for it. Your permit to carry a gun will be rescinded, at the very least. If you unholster your firearm and point it at someone without very demonstrable legal cause, it is more serious criminal offense. You will very likely be taken to jail.

If – god forbid – you pull the trigger and actually shoot someone with that gun (as here) you had better be able to substantiate that your life was in imminent danger from a clear and immediate threat and that (in most states) you literally had your back up against the wall and could not have simply run away.

We – Mere Ordinaries – have a legal obligation (in most states) to retreatshoot 'em in the back

If not, you will almost certainly be charged with – at minimum – felony manslaughter and very probably murder. You will be taken into custody right now. You will not be placed on paid vacation and allowed to go home. If it turns out you fired your weapon without legal justification –  that being an imminent actual threat to your life – you will be charged and prosecuted.

Claiming you “feared for your safety” won’t cut it.

In addition to being criminally prosecuted, you will also be personally sued by the victim or his family. You will pay for your mistake. Not the taxpayers. You will face losing your home and everything you and your family have. In addition to the prospect of spending many years in prison.

Can anyone come up with a legitimate/defensible reason why “trained” law enforcers should not, at the very least, be held to the same legal standard regarding the consequences of criminal/reckless conduct as ordinary people?

No one – we are told – is above the law. And yet, the plain fact is cops – law enforcers – are above the law. They are held to a much lower standard regarding conduct that would be considered criminal on the face of it if performed by you or me. Which – duh – gives them an incentive to be less circumspect than you or I would be regarding (among many other things) the use of force, including the use of deadly force.

It invites exactly the sort of person who ought to be actively discouraged from a career in law enforcement – viz, the bully who is looking for trouble; who wants to hurt people and just needs the excuse (and the legal cover).

But the fundamental point is that the laws should apply equally – and to the same extent – to everyone. Whether it’s “speeding” or firing a gun at someone. Cops should be just as fearful of the consequences of pulling the trigger as anyone else.

The fact that at the moment they are not as fearful is precisely why we have the problem we have.

A second inducement to good behavior – or at least, responsible behavior – would be (and should be) the prospect of being ruined financially for reckless/criminal conduct. Again, just as you or I would be, in the event we did something like drive a car 100 MPH in a 35 MPH zone and ended up T-boning some poor innocent who happened to be in the wrong place at the wrong time making a legal left turn, say –  and as a result is now in a place six feet under the grass.thug cop

When a cop does something like this – even when there is no debate whatever about the recklessness or even the criminality of his actions – he is not personally ruined. The county – the taxpayers – are. They foot the bill for his defense as well as the eventual payout.

This, too, is both outrageous and dangerous.

If it were proposed that you or I or any other ordinary person not be held personally financially responsible for causing horrendous damage to someone else or their property, or even causing their death, and that instead the county – that is, the taxpayers – pick up the tab not just for the damages but also for the lawyers, what do you suppose the reaction to such a proposal would be?

The bottom line is that sometimes, counting on people’s good behavior and good sense is not enough. There must be consequences for bad behavior – both as an incentive to prevent it and as way to deal with it justly when it happens.

It is not just for some people to be held to a lesser standard – nor for them to be able to shirk responsibility for their actions onto  the backs of others who had nothing to do with it.

If anyone can give me a sane reason why the doctrine of equality under the law ought not to be applied to cops as much as it applies to anyone else, I’d love to hear it.

What we are seeing on the streets is the result of the female equality movement -introduction of less physically capable women in the traditional role of men- and the changes in training that have been instituted to try to make them equal to male police officers in confrontational situations by using weapon enhanced force.
I recall one report from back in the 70’s where a female officer tried to stop a strong armed robbery of a convenience store by overpowering the robber the way a man would and the perp just laughed at her, picked her up and threw her threw the front window of the store. Today she would have shot him (or he would have since they receive the same weaponized training).

There is far more reliance on weapon enhanced force, including deadly force, and the use of weapons to force compliance with orders now than there was before. Used to be a robbery suspect that resisted got whacked with a billy club, now he gets shot.

There are other causes as well such as changes in our legal approach and social attitudes, of course, but this is/was the basis of the problem.

You can see the same things happening in everything from fire departments to the military if you look for them.

Eric,
All true, but not really. The Attorney General of the USA
gave the police the power to inflict civil forfeiture on the
people. The basis? The police have a “feeling” about the
person, so fast forward to theft. That alone inspires fear
and loathing…throw in some videos of physical abuse of
citizens and murder of citizens (selling single cigarettes)
and the police forces can become victims of violence. Remember,
the local cops and the fed gov. split the proceeds of their theft.
“Police state” at it’s worst…and I know it can be even worse than
it is.

Eric. Grow up, dude. Being a cop is a man’s job. Let them do it. There’s a reason we have cops. Someone has to deal with the bad guys. I’ve never been a cop, but i’ve been a bouncer and worked concert security. Someone has to protect ordinary law abiding folk. It can be a thankless job. But remember this, eric, you weenie. If it wasn’t for cops, you would have nothing. Stronger, meaner dudes would take everything you’ve got. Show a little gratitude for the people that make your existence possible.

It’s not the stronger, meaner “dudes” that I see getting thumped in videos. I was a cop. The training they receive in academy’s now is all about officer safety. While this is important, the current mindset of police has a tendency to escalate situations (though we don’t get to see the situations when a true “man” actually deescalates and all are treated with respect). Add to this mix their gang mentality, prior kick in the door in Iraq military training, steroid use and it becomes a dangerous mix that has little to do with being a peace officer – now commonly known as Law ENFORCEMENT officer. I suspect in the first video the cops were punishing the the guy for running from the LAW. They decided they would be judge and jury to “teach him a lesson” as to who is boss. I have to agree with Eric because these aren’t “men” protecting and serving. If there is a real threat, SWAT is called out in overwhelming numbers to deal with the “stronger, meaner dudes”- whoever that is.

As I watched the proliferation of surveillance video cameras and cel phone cameras I remember thinking that the upside would be that a lot of fringe beliefs or paranormal events could be proven. If something is real there should be terabytes of proof by now. I realize that new data comes in all the time but so far……

I continue to focus on the spiritual aspects of world events. I understand the video of police aggression (actual ‘in-your-face’ hate at the sovereign individual level; many such videos of aggression by sovereign individuals (and various sized groups of sovereign individuals for various reasons) are free to watch on youtube and liveleak) to be the visible end result of spiritual degradation at a sovereign individual level which originates at the highest levels of human governmental organization (obviously, human governments are made up of sovereign individuals).

Some sovereign individuals will always seek control (by various means) over other sovereign individuals (either alone or in groups) in direct contradiction of Almighty God as stated by His only begotten son, Jesus Christ, and recorded in His Word:

“Neither be called ‘leaders,’ for your Leader is one, the Christ.” -Matthew 23:10

Since all humans are currently under Messianic Law, as described in the New Testament, we can expect some repercussions for breaking Messianic Law. But first, we must understand what law is being broken. Sovereign individuals who willingly choose to seek positions of authority over other sovereign individuals refuse to accept the clearly written ‘law’ as expressed in Matthew 23:10 as being from Almighty God. At the same time, a sovereign individual also rejects Jesus Christ as being the only begotten son of Almighty God since these words are recorded as being stated by Jesus Christ in the Holy Scriptures.

Adam and Eve could not follow one clear request or law. How could the Israelites follow a whole bunch of them? How can Christians follow all the laws our ‘leaders’ have written? Now people who have willingly chosen to be called ‘leaders’ don’t even need to follow their own clearly written laws?

If you, a sovereign individual, ‘feel’ any remorse, or righteous anger, over any aspect of ‘crime’ against ‘creation’ you ARE blessed by Almighty God. Now pick up the Holy Scriptures, ask Almighty God for understanding and start reading the New Testament.

Only Almighty God knows what you, a sovereign individual, need (physically or spiritually) before you even ask. Only Almighty God can grant you, a sovereign individual, the understanding of His Word that you, a sovereign individual, needs at the proper time.

All honor, praise and glory belongs to Almighty God. May the peace and love of our king and savior, Jesus Christ, be with you.

Personal responsibility is just that, _personal_ responsibility. In order to keep the jackboots following orders, immunity is granted; individual jackboots would not stay in ranks if they thought their actions might land THEM in jail. UnConstitutional orders would go unobeyed; theft, lies and “sting” operations would cease, as those who performed them would be incarcerated and possibly destroyed in prison. In order to keep control of their jackboots, immunity from personal responsibility is granted by the corrupt, depraved leadership. The fools in power think that will ensure they stay in power.
Once the citizens decide the current corrupt leadership no longer has their best interests at heart (they never did, but illusions die hard) then there is no support for the leadership – just ask the GOPe squad. The illusion of control and power then disappears like the morning dew – and will not return.
The settling of scores will be epic, and take quite some time.

When I was young a long time ago in another America, I believe the Rural Cops and Judges obeyed the Law. Their job was to be sure both sides in court were treated fairly; the lawyers could lie and try to cheat but the Judge would throw a flag (bang a gavel). Then about 1960, Liberals who didn’t like most (Conservative) laws gained office and started selecting Judges to change the Laws that Lawmakers wouldn’t change. Judges could hid behind a black robe (were legally immune from the many resulting justified complaints). When Crooks and Cops saw the Lawmaking and Courts were now crooked, they took advantage. Then in 2008, the POTUS turned the demons loose. We need a new Sheriff; vote Trump. And make Activist Judges liable (can be sued) when they violate the Laws and Justice for all; treat Judges like any other professional that doesn’t do his job to standards.
