The Government Must Respond to Social Media’s Anti-Free Speech Blitzkrieg

The Twitterati and the court of social media are second-guessing world-renowned lawyer, Alan Dershowitz on the concept of the 1st Amendment, going so far as to claim he should stick to criminal law and not comment on Constitutional law.

can and will comment on Constitutional law; The First Amendment, like the 2nd, is a right, a God-given right, that is guaranteed by the Constitution, period. Facebook and especially Twitter have shredded and stomped on those guarantees, claiming they are exempt because they, you know, ‘feel’ they are.

In days gone by, monopolistic news sources couldn’t get away with having the only platform in a particular space and box out all others who wanted to express an opinion, whether it was ‘The Boston Commons leaflet’ or the New York Times. Competition could spring up and express their own opinion, whether the same or diametrically opposed, there was a space for that opinion guaranteed. And any company that tried to thwart those freedoms either overtly or covertly were brought to heel by the law and the courts.

That is, in a sense, what happened to AT&T in 1982 when it was split up by the government into regional units, which stopped it from controlling all telecommunications and keeping other companies from competing and innovating. Even the gargantuan entity that was ‘Ma Bell’ was subject to antitrust laws and after a 10-year legal fight, the Bell monopoly was stopped.

Twitter and Facebook want the benefits of being a private company, being able to control what is seen and heard in their space but also want to be able to use their monopoly, and first in space position that was facilitated by the government making laws to help the new communication platform to grow and to keep others services from gaining a foothold in that space.

With both of those objectives having been met, the laws need to be changed to reflect the new reality in which the companies, to wit, Facebook and Twitter need their power and influence checked by the removal of ‘section 230’ protection and possibly a new law being enacted to protect the 1st Amendment from these corporate telecommunication behemoths, like was done in the case of AT&T 37 years ago, to punish them for their violation of the free speech protections of millions of Americans up to and including the President of the United States.

This is so Orwellian that it should not have to be explained but the education monopoly is such that these days if you even reference ‘1984’ the social media generation are dumbfounded as to what you are talking about and are so immersed in totalitarian dogma that understanding the concept of free speech is beyond their imagination; like explaining drowning to fish.

If Jack Dorsey and Mark Zuckerberg and made to relearn the meaning of free speech we will be able to once again be able to rely on the marketplace of ideas to sort out the good from the bad regardless, or maybe because of, the pronoun you identify as.

Government? The US government? I think you misunderstand the role of government. It isn’t what the constitution says. It has three primary functions now:
1. Assume debts from the central bank that the taxpayers are obligated to pay.
2. Collect the interest on the debts in the form of taxes and pass it on to the central banks owners.
3. Run a myriad of scams to vacuum up any other loose wealth.
Big tech, big pharma, big money, big government and big NGO are all on the same team, and it isn’t the team you and I are on. Don’t count on them doing anything about anything that might influence the money suction games.

Yes, Mista you’re exactly right. It’s laughable that people can’t see this! Also, the fed is printing monopoly money and handing it to their friends to buy up tangible assets. The msm, all levels of gov., sec. agencies, etc are all in cahoots running their own little fiefdoms against us serfs. If people can’t see that by now (and many can’t) they’ll never see it. It’s not enough we are already tax slaves. “They want it all, and they’ll get it.” They truly want most of us dead and those left alive as true slaves.

Ultimately it’s all about the slavery, just like it always was. Under the current slave system, most of us think we are free, because we think taxation and government management is necessary and just. As slavery goes, it’s not a bad system. Unfortunately it has a fatal flaw – it requires infinite debt forever, which means infinite resources and infinite suckers. It requires lots of governments and overseers to keep the slaves in line.

The evil ones know they have to transition soon to a new system that doesn’t require infinite growth. The ‘Great Reset’ is the new slavery. Fewer people, one government (cut out the middleman), technocratic control ( no need to listen to the slaves ) and feudalism (winners take all).

The primary cause of legal system problems in the USA is the US Constitution and the fact that no legal system was fleshed out in it. It has a bare outline of a judicial branch and makes no explicit demands of a court system (not the same thing). Both of those were a mistake. I suspect the founding generation never even got to the arguments over what was in (or especially not in) Article III. They were too busy arguing about the rest of it. It was not popular. Popular constitutions don’t get rammed through against major public opposition. Our foundation myth is a foundation myth like any other. Had our nation lasted more than a hundred years, maybe that would be important, but it didn’t It lasted until 1861 and everything since then has been a slow motion train wreck that would have already ended without massive amounts of unoccupied land and resources.

The whole Article III reads”

The judicial power of the United States, shall be vested in one Supreme Court, and in such inferior courts as the Congress may from time to time ordain and establish. The judges, both of the supreme and inferior courts, shall hold their offices during good behaviour, and shall, at stated times, receive for their services, a compensation, which shall not be diminished during their continuance in office.

Section 2.
The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;–to all cases affecting ambassadors, other public ministers and consuls;–to all cases of admiralty and maritime jurisdiction;–to controversies to which the United States shall be a party;–to controversies between two or more states;–between a state and citizens of another state;–between citizens of different states;–between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.

The trial of all crimes, except in cases of impeachment, shall be by jury; and such trial shall be held in the state where the said crimes shall have been committed; but when not committed within any state, the trial shall be at such place or places as the Congress may by law have directed.

Section 3.
Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.

The Congress shall have power to declare the punishment of treason, but no attainder of treason shall work corruption of blood, or forfeiture except during the life of the person attainted.

That is it. That is how important the judicial branch and legal system was to the delegates. One could argue the wisdom of being minimalist, but why? History has shown it to be a mistake from the very first congress.

Marbury vs. Madison should have been enough to convene a constitutional convention. I guess everyone was already too weary to fix this obvious fatal flaw. Maybe the oligarchs didn’t expect to win the coming war, so didn’t feel any pressure. It demonstrates the absolute failure of the convention system.

I don’t disagree with the principles of the constitution, just with most details of its execution. Any fledgling nation without explicit mechanism to protect its blood and soil is not a nation with a future. The American nation has already been replaced.

Maybe Free Masons are not the right people to try and safeguard liberty.

In fact, if you dig too far into the details of the case, you discover the manipulation of the SCOTUS by POTUS was Jefferson’s reply to Marbury.

You are so correct that the judicial branch has failed us again and again and again. I’m from Missouri and you only have to show me Dred Scot and I realize just how politicized the SCOTUS decisions have been in times of crisis.

Now, they just punt by declaring the lack of jurisdiction.

GenZeeCon artist. I have no Idea where you studied if you even did study. Ma Bell was not broken up or “Punished” by the Government for being bad or a monopoly.
But that’s not what bothers me about your bundle of misinformation.

We have no rights that we cannot take by force or persuasion. None. God did not give you any amendments much less a constitution.
He gave us all the choice to serve and worship him day and night or pay the price.
We do not even have the choice to believe in Him or not. We can practice clever forms of ignoring or avoiding him but we all have the concept of God instilled in us and will one day be forced to admit He is indeed God.

Meanwhile we bloviate about trivial topics or discuss covid ad nauseum while outright Feudalism is at the gates.
