Stucky Q.O.T.D. —- Breaking Point

Literally not a day goes by whereby I’m not outraged at the shit-pile this country has become …. where I want to curse my parents for leaving Salzburg.

Today, I m upset about governmental-fuk interference with ……… dirty dishes.  These motherfuckers need to sleep with the fishes. Yea, read this … it is hard to believe, or stomach;

=====================================

“Let us inspect your dishes — or we’ll get a warrant,” city says.

A Minnesota city is asking a court for a warrant to enter a rental home in order to check to see if the place is clean. If the city wins the case, then inspectors apparently would be able to enter such a building anytime they wish.

The renters and tenants say they have nothing to hide but are opposing the city’s move based on principle. If they want to leave dirty dishes in the sink, they say, they it should be perfectly legal.

“Your home is your castle—irrespective of whether you rent it or own it,” said Anthony Sanders, an attorney for Institute for Justice, which is representing the renters and tenants. “What we do in our home is our business, not the government’s. The mere fact that someone rents a home, rather than owns it, should not give the government the right to disrupt their life, invade their privacy and search every nook and cranny of their home—all without providing a shred of evidence that anything is wrong. It is a fundamental violation of the Minnesota Constitution’s protection against illegal searches.”

Sanders is representing the renters as well as Jackie and Jason Wiebesick, the owners of the rental unit in Golden Valley, Minnesota.

The city of Golden Valley is asking the Minnesota Court of Appeals to grant the warrant even though there have been no allegations that ordinances have been violated. Instead, the city wants to see if the tenants are following minimal standards that include keeping the kitchen and toilet clean, the Institute said.

City Not Backing Down

The city tried to do an end-run around the Fourth Amendment’s ban on unreasonable searches and seizures by asking Hennepin County Judge Susan Robiner for an administrative warrant to search the duplex; the warrant was requested without the knowledge of the Wiebesicks. The city argued that no evidence of wrongdoing is required for the issuance of an administrative warrant.

Robiner turned down the warrant application, ruling that the city’s request violated the Fourth Amendment. The city appealed Robiner’s ruling to the court of appeals.

“Both the United States Constitution and the Minnesota Constitution provide that persons shall be free from unreasonable searches and seizures and impose a warrant requirement supported by probable cause,” Robiner wrote. “The privacy interest in one’s home is well-recognized as of greatest constitutional significance.”

The city had sought the administrative warrant after the Wiebesicks and their tenants refused to let an inspector into the duplex.

“What’s at stake is a simple matter of making sure we have safe housing that meets minimal standards,” Golden Valley Fire Chief John Crelly told CBS Local Minnesota. “In general, there are no unannounced inspections.”

But the Wiebesicks see it quite differently.

“Tenants should enjoy the same level of privacy in their homes as homeowners,” said Jason Wiebesick. “We’ve done nothing wrong and we have nothing to hide. The city of Golden Valley shouldn’t be allowed to force its way into innocent people’s homes.”

Said Institute for Justice attorney Meagan Forbes, “Golden Valley is doing what countless cities do: forcing their way into people’s homes without any suspicion they’ve done anything wrong. This has to stop.”

The ordinance in Golden Valley allows city inspectors to enter rental units to check on things like the cleanliness of kitchens and bathrooms. At least four other cities in Minnesota have similar ordinances.

The League of Minnesota Cities, an organization of municipal governments, has filed an amicus brief in support of Golden Valley’s petition request, CBS Local Minnesota reported.

=====================================

Everyone has a breaking point.  Some will go apeshit if they come for guns. Others will risk jail over not immunizing their chil’run. Others will kill if their property is threatened.  For me, apparently, it’s dishes.

Question:  What single event do you think will push you over the edge … your proverbial line in the sand … “this far and no further!!” ….. I’m talking about where you’re literally willing to double-tap a fuckin government goon?

For me, apparently, it’s dishes.

Secondary Question:  What the hell is wrong with shitfuk Minnesota?  It’s like someone combined the worst of Californication and the worst of Noo Stinkin Jersey, and stuck it in the middle of the country.

Our neighboring city was fighting the proliferation of Section 8ers. They came up with the brilliant idea to tie in Sheriff deputies with Social Services inspections on all rentals. They threw in room rentals just for good measure. That way, if you rented an extra room to some fuck, you were liable to get inspected. These are the same brainiacs who were pro-drone surveillance for whatever reason they had. My old boss did not have a great opinion of Hizzoner, the mayor who also preemptively denied hotel rooms to biker clubs seeking to PowWow in the AV. He might make a good president one day.

If the city has a cause, then try to get a search warrant; otherwise FOAD commie MF’s. Feds want to arrest 65 protesters in Oregon, a preacher can’t discuss what spreads AIDS just off UT campus; what’s next: no notice inspections to see if my guns are kept safely, trash and laundry meet city codes, my shoes polished and free of any doggy material, and I don’t have any Politically Incorrect Subversive materials like a Bible or a copy of the Constitution; forced mental evaluations for gun owners and Christians…? Welcome to Bad Old Russia Comrades.

Well, an ass wipe check would definitely be way over the edge. And it’s cheeedrin, not chil’run. And no, I don’t immunize mine and would risk jail for not doing so.

People -average people, not liberals- have had just about enough.

Things will start changing soon, one way or the other.

I doubt it will be a pleasant process and I expect only one side will be left at the when it’s over.

What was that saying in that Highlander movie, “In the end there can be only one”?

First, to answer the QOTD:

My kids. Period. You fuck with my kids. You Die. Period. I might (probably will) serve time or die myself, but you die. Period. That’s one of the central reasons we home school: to keep our kids out of the clutches of evil government fucks. No vaccinations, no sex education, no indoctrination, no political correctness or any other government agenda. We’ve gone Galt to the best of our ability in this interconnected world, and any government interference will meet with armed resistance. Especially regarding the kids.

Second, regarding this story: One small bit of encouragement is that at least this judge made the right call. This time. The overall trend is towards tyranny, but at least once in a while it is forestalled. Be thankful for that.

The first question, meh, too paranoid to answer. But, I am a patient and mostly rational person, so, fortunately (or unfortunately) Im a lot less prone to a complete shitstorm than most others. I will not allow harm to come to my family, but the knowledge that if I get in trouble for reacting to someone stepping over my line in the sand, I either get killed or wind up spending a long time in prison keeps me in check. Why? Because I have promises to keep. The thought of not being able to take care of my wife and two kids scares me more than anything else. If I go apeshit and decide to “teach someone a lesson” and the S really does HTF I will be helpless to take care of those I love if I’m dead or in prison.

Look on the bright side. If government intrudes too quickly, all incentives for people to work, save money, buy homes, invest, and follow the rules will quickly disappear.

In keeping with my resolve to “keep the bastards guessing” I cannot reveal my proverbial line in the sand because it’s always subject to change based on an unknowable set of variables. I’ll likely be as surprised by the trigger as those around me if that day ever comes. 🙂

Like Michael Douglas’s character in Falling Down……….he probably never expected that not being able to see his daughter on her birthday would be that trigger that made him break bad.

Unsurprisingly to people her, for me its my pews.

And with scalia passing on obama’s watch and him likely being able to pick some lib-fuk it looks like things are generally pointing down.

The minute they start loading people on trains bound for detention camps. Whether they’re “different” from me or not. If we let that happen, it will happen to any or all of us.

The mass incarceration of Americans for minor drug offenses was a test. The next time, they’ll mean it.

When I have the hypothetical conversation in the future , where my kids , who adore me, ask why didn’t you do something?
My answer will be self evident . I did .

What is that line in the sand? Unknowable at present .
But I would rather they look up to me for trying , then look down at me in shame for bending so much that I was not worthy of them .
When they ask my wife why im not here anymore , her answer will be he died protecting you .
I can think of nothing more pertinent .
F/u Stucky for asking the hard questions, but they are needed sir . to define parameters .
No disrespect intended

I used to have some review authority over city, county, state and OSHA inspections.
The inspections were for safety and code compliance matters.
The inspections were always on a regularly scheduled basis – like once a year – or when there was a public complaint – failing septic tank, unsafe working conditions, or something similar.
Occasionally a landlord or businessman would figure he could ignore the health and safely codes and tell the inspectors to take a hike. Then the inspectors had to go to a judge to get a warrant.
In over thirty years of dealing with matters like this I never saw one instance of the government inspectors then believing, saying, or acting as if they “would be able to enter such a building anytime they wish.”

Government needs to be held accountable, Stucky, for violations of the Geneva and Torture conventions (both part of the US Code), a multitude of crimes against American citizens from murder to theft, frequently ignoring the Constitution, abuse of police powers, and many other outrages. Enforcement of health and safety codes by city and state officials in the manner described in the article doesn’t make the list even though it’s a captivating story.

Stucky –

I was hoping Dutchman would chime in as this is reasonably close to where he resides if I have read his past posts properly. I would like to think that there is something more going on here than the story reveals meaning the PTB have a hard on for these renters or landlords for some reason. Regardless this is just another one of the fucked up bullshit that is is Minneapolis. A few months ago my wife and I were awoken by a disturbance prior to 6 AM the likes of which I have never heard ( loudspeakers, drums, etc) and it lasted over 1/2 hour. It was idiots marching to protest getting a $15 per hour minimum wage. To top it off they had a police escort!! If a bunch of us TBP’ers were to make a ruckus before 6AM and block a major city road we would be arrested at a minimum by the cities finest not escorted and protected for our shenanigans. Yet another benefit of being a middle aged tax slave – I just have to put up with FSA running around disturbing the general peace and destroying my ability to enjoy my day to sleep in an extra hour because they feel entitled to get $15/hr to flip burgers. Don’t even get me started on the castrated local police and the BLM protests where they let them deface the police station and block a major road for weeks.

All that said this seems to be a microcosm of the country in general where the govt does not listen to or represent the majority. The city is going full on libtard and discussing mandatory paid leave, $15 per hour wage, destroying several major roads by taking away traffic lanes to allow bicycles and the latest folly is they want to outlaw drive throughs in the city. Seriously if you have lived in Minnesota it is not really conducive to bike riding 4-6 months per year due to the cold and ice. I work day in and day out with the people who make the economy go – the small and medium business owners and while for now they put up with the crap there certainly is a John Galt attitude brewing amongst them. Though when push comes to shove to date money talks and the business interests have been able to shut down most foolishness when it gets down to the wire.

All this bullshit aside it still is a pretty good place to live. Good economy, aside from heart of the city very conservative nordic folk, fairly liberal gun laws, beautiful scenery, I have certainly lived in worse places.

Interesting times we live in to say the least.

Now that we are living out in the midst of nowhere, it has become routine to expect our privacy to be honored. I made a trip back to Oklahoma City where I was reminded in every way that Big Brother is growing more intrusive by the day. When driving onto the Air Force Base there, a contract security guard asked me several questions about the luggage and boxes I was carrying in my car. Thankfully, I did NOT have any canned food with me for my son. But I did have to show my Missouri driver’s license and explain that I was on a trip back to pick up a few things from a friend’s house to avoid an invasive search. I do make a special stop to leave any weapons at a friend’s home before entering the gate, but boxes of dishes and towels, etc., should NOT warrant an interrogation from a “rent a cop” at the gate. (Heaven forbid that the military actually assign someone in uniform to stand guard when they can pay a contractor $20 an hour to check IDs.)

I think if anyone comes to our gate here and announces they have the right to come onto our land and see what we have stored here or what we are building here will be the straw that broke someone’s back.

By the way, I was banned this morning. Really. I tried to log in to post a picture I took on the way home and put the wrong username in (Maggie120) and got locked out, so when I realized that I’d used the wrong username, I requested a password reset and got automatically banned.

I barely was able to prove I was me to the man with no name who has put the measures in place to prevent hackers from using someone’s account maliciously. It was a lonely feeling to be banned from you guys.

By the way,
