WTF POLICE SHOOTING VIDEO OF THE DAY

An unarmed behavioral therapist says he was shot by police in North Miami while lying on the ground with his arms up and trying to help his autistic patient, who had run away from a group home.

Charles Kinsey, 47, was shot once in the leg and is recovering in the hospital, he told WSVN-TV.

He was next to his 23-year-old patient, who was playing with a toy truck while sitting cross-legged in the middle of the road, a video of the moments before the shooting shows. You can watch the video above.

The head of the police union told the Miami Herald the officer thought Kinsey was in danger and was aiming at the autistic patient, and missed.

Police had responded to the area near Northeast 14th Avenue and Northeast 127th Street for a report of an armed man threatening suicide about 5 p.m. on July 18, WPLG-TV reports

But Kinsey says the “armed man” was his confused patient, who was holding a toy truck, not a gun.

“All he has is a toy truck. A toy truck. I am a behavioral therapist at a group home,” Kinsey can be heard saying to the officers before he was shot.

He told WSVN he asked the officer why he shot him, and the officer replied, “I don’t know.”

Kinsey said he was more concerned about his patient.

“I was thinking as long as I have my hands up, they’re not going to shoot me,” Kinsey told the news station. “This is what I’m thinking, ‘they’re not going to shoot me.’ Wow, was I wrong.”

The officer involved in the shooting, a 30-year-old Hispanic male, has not yet been named. The shooting itself was not caught on the cell phone camera.

Charles Kinsey told the officers he and the autistic patient were not armed, and asked them not to shoot them. The officers were armed with rifles.

“When I went to the ground, I’m going to the ground just like this here with my hands up,” Kinsey said told WSVN-TV, raising his arms while in his hospital bed. “And I am laying down here just like this, and I’m telling them again, ‘Sir, there is no need for firearms. I’m unarmed, he’s an autistic guy. He got a toy truck in his hand.’”

Police later said they had eyewitnesses telling them there was a gun at the scene, and a 911 caller also saying that. But no gun was found.

Kinsey told the news station the officer fired three times, hitting him once, in the leg.

“I’m like this right here, and when he shot me, it was so surprising,” said Kinsey. “I thought it was a mosquito bite, and when it hit me I had my hands in the air, and I’m thinking I just got shot! And I’m saying, ‘Sir, why did you shoot me?’ and his words to me were, ‘I don’t know.”

At a Thursday press conference the Miami-Dade Police Benevolent Association said the officer was a member of the SWAT team. PBA President John Rivera told reporters the officers were trying to help Kinsey:

There was a call about a suicidal man with a gun, the officers already heard that. When they arrived they saw two men, Mr. Kinsey and the other individual, the white male, and it appeared to the officers that the white male was trying to do harm to Mr. Kinsey. The officers, realizing and believing that there was a firearm, and many officers thought the white male had a firearm, only much later when we were able to Monday morning quarterback do we find out it was a toy. Only much later do we find out that the individual was autistic. The officers on the scene did not know that. And fearing for Mr. Kinsey’s life, the officer discharged his firearm, trying to save Mr. Kinsey’s life. And he missed, and accidentally struck Mr. Kinsey. He thought the white male and his actions were such that he felt Mr. Kinsey’s life was in danger.

Rivera also said the video from the scene “is being portrayed poorly.”

He said “many in the media are saying you can clearly hear Mr. Kinsey. Well if you can clearly hear Mr. Kinsey, why does every news outlet have to put subtitles. You can’t clearly hear Mr. Kinsey.”

Rivera said the officer couldn’t hear what Kinsey was saying.

He also said the person who filmed the incident did so at a different vantage point and from much closer than where the officers were.

“They flipped me over, and I’m faced down in the ground, with cuffs on, waiting on the rescue squad to come,” Kinsey told the news station. “I’d say about 20, about 20 minutes it took the rescue squad to get there. And I was like, bleeding — I mean bleeding and I was like, ‘Wow.’”

He said his life flashed before his eyes when he was shot, and he thought about his family. His wife was at his bedside Wednesday.

“Right now, I am just grateful that he is alive, and he is able to tell his story,” she told WSVN.

According to the Miami Herald, Kinsey is likely to be released from the hospital Thursday and is expected to fully recover.

The Dade County Police Benevolent Association said at a press conference that they wish the best for Kinsey and the officer involved in the shooting is praying for his “speedy recovery.”

The police union head also read a statement from the officer, in which he said, “I took this job to save lives and help people. I did what I had to do in a split-second to accomplish that. And hate to hear others paint me as something I am not.”

By this time you think the cops would have figured out that if you shoot someone, that is not extremely violent/armed – that you are going to lose your job, you are going to have to go to court, maybe to jail, and you are going to go through hell. Have these morons ever heard of binoculars? Maybe you then could see it was a toy truck. These bastards seem impatient. What’s the rush? Like the situation must be over immediately. Very poor thinking – maybe no thinking taking place at all.

Here the cop wounds an innocent person (I hope he sue’s the shit out of the cop), and then they handcuff him. Why? Just because he was there?

These guy’s are security guard quality, not law enforcement quality.

I’m longtime buddies with the head of the cop union. I like to get his take on these things, he is usually in the know, and he turns out to be right literally every single time. This has been leading on the local news for a couple of days, yet my calls have been unreturned so far. The silence is deafening.

Silence leads me to believe the facts on this one might be worse than what they seem. Thank god the guy will be ok, and very well compensated. If this is what it seems, cop should get fired and do some time. He fucked up in a big way. I’m sure north miami has liability insurance, just like any employer, the guy should get paid. I would be very suprised if the cop keeps his job. And doesn’t get charged criminally. Looks inexcusable. And my usual backchannels of information are still silent. That’s pretty damning. This is what happens when you train police officers that every encounter with the public is a threat to their life or safety. If cops believe that, then they are going to act consistent with those beliefs and unintended shooting will happen. Victim, “Why’d you shoot me?” Cop, “I don’t know!”

I wonder how much discussion between the officers occurred on how to handle this situation. None I bet. They were a bunch of cowboys with guns drawn waiting for a shootout.

Sad for all involved. Some lawyer’s going to get rich off this and regrettably some more cops, somewhere, are possibly going to die by retaliatory hotheads. I hope not.

This story chilled me to the marrow of my bones, since I have a child, no, he is now a young adult, with mild Autism/Asbergers. He is going out into the world, going to a local community college and trips with friends.

My son does not drive (although he is capable of it) precisely because if he got stopped, he is almost 100% likely to be shot and killed as he might not comply FAST ENOUGH with the cops. We have rehearsed extensively with him what to do if stopped by the police. Just like I guess black parents give to their kids, weird.

The story now is that the cop was actually aiming at the kid with the Autism and hit his freaking therapist!!!!! Who was lying on the ground with his hands up, trying to defuse the situation!!!!!

My Grandson is autistic as well. Very disturbing to think that when he grows up, he is ten, he might need to be protected from those who should be protecting him. There needs to be an investigation for sure but if story holds this Cop should go to jail for ten to twenty. It will be only way to stop this. A badge doesn’t make you above the law.

When I shoot my long-range rifle, I usually use a 4x scope. Presumably the police have an even better scope than I do.

I think I could distinguish a toy truck from a grenade or a bomb through my scope. The actions of the police here are just baffling to me. I would like to give them the benefit of the doubt in a confusing, nervy situation. But this is a head-scratcher.

More importantly, I would love to see the equivalent of an “Amber Alert” for autistic people. This would alert the cops to an emergency with an autistic person so proper precautions could be taken.

Pretty sure the guy was shot by some random patrolman using a handgun. Although the patrolman was supposedly on the SWAT team. That gives me negative confidence in the SWAT team.

Senseless. Absolutely. But don’t forget that these senseless shootings are not the norm. We do not see nor hear of the countless everyday encounters that do not result in harm, but are resolved fairly and peacefully. Copfucks are out there, but not all cops are copfucks. I’ve known both the good and the bad in peace officers, fortunately much more good than bad. Of course that doesn’t address the alarming militarization of law enforcement agencies, nor the arming of the various three letter agencies. So, getting on a high horse and spouting off serves no purpose…the Donald may make a difference, hope so. The police need our support, and the police need to gain our respect back. How and when…who knows?

Good call. After spending 23 years in the Marines I can no longer drink the kool-aid of military excellence. Not that the individual servicemen are lacking, rather the leadership of our nation has strayed from honor and excellence. While many of my comrades have traded green for blue, the proud swagger of a combat vet doesn’t have a place in the thin blue line. Many positive traits learned in military service translates well to public service. Yet we do not need nor want a combative police force, we need and want a police force that seeks peace and harmony in our community. Can we go back to peace officers rather than law enforcement officers?

I agree with last part 100 percent! Cops should not enforce laws, they should maintain the peace. The motto for RCMP in Canada is “Maintiens le droit”. Seems to have somewhere along the way changed to “Maintiens la loi”. Maybe I didn’t get memo. The war on the public has to stop. Will it? I can’t see it happening. It is too profitable and mentality too entrenched. Like HSF somewhere else, this has been bought, paid for and agreed to by vast majority of the public.

I would think that this must be offensive to a Marine to see a bunch of whannabees dressed up like soldiers. If those guys want to shoot people they should volunteer and go to a place where the locals are guaranteed to shoot back.

That’s true enough, but I know a lot of combat vets, both in my family and outside it. I’ve never seen any swagger whatsoever among them. Swagger usually accompanies the tall tales told by REMFs who skated around in the rear, with the gear, where there ain’t no fear, or by wannabes who became cops instead of joining the military.

I see the problem as one of militarizing police forces. There can be a military for defending the whole country from invasion and attack, and there can be local police forces to protect citizens from criminals. This country doesn’t have either one, instead there’s a military used by politicians as a global police force and a domestic police force used as an occupying army against the citizens.

It’s kinda fucked up, ain’t it?

Policing along with courts and the udiciary should be provided by the free market and removed from the state. Competition and reputation insure a quality product which a government monopoly need not concern itself with.
Like any other service or product consumers can willingly purchase whatever security and policing they feel best serves their needs. It’s quite obvious that like everything else the state touches it taints and corrupts.

I made an allegory about a developer showing up at a pristine stand of woodland and then turning the heavy equipment loose on it. Eventually everything is cut down and paved over and the result is a parking lot. The rest of the piece was a discussion by a panel of experts about what went wrong with the woodlands preservation project.

Joel Salatin is the real deal, accomplished writer, motivational speaker, fearless critic of progressive farming and the FEDGOV imprimatur. He’s raised his younger generation to take over for him and now he feels his best efforts are in helping the new agrarians understand not only how to do things in the way that best benefits the environment, livestock and bottom line, but to understand WHY it is so important.

I credit him with getting me into farming so if I am the only person who ever benefited from his tutelage, he’s done a solid for myself, my family and our land and I know I am not alone.

I hope he profits wildly for what he does, he’s sure worth more than a Blankfein or a Soros.

One simple measure would be to apply the law equally to everyone. Especially to law enforcement.

If the cop was shooting to protect him, then he already knew he was not the perpetrator.
So why cuff him when he’s bleeding out.
Hoping he dies and can’t tell his story?

To go back to the offending cop’s answer when asked by the victim why he shot him, the cop responded ,”I don’t know.” It’s just my opinion, but what he should have said and what he knew in his mind I’ll bet, but couldn’t or wouldn’t say was: “I don’t know because I choked under pressure.” If in fact that is the case, then it is decidedly obvious that this man is in the wrong business, and questions should be asked about why he was ever issued a gun and a badge in the first place. Hopefully, the people asking those questions will get a different response than that that was given by the cop who shot the poor guy.
