On the other hand, if the perp appeared to make “a furtive movement toward his waist,” the threat was not over, and there was still a need for action.
Others say the perp was leaving the restaurant, and so was no longer a threat. From what I’ve seen, he had not yet robbed the till, the waitress, or the owner, and still had his gun up in a threatening position. No way was he done with the robbery and leaving.
I’d never convict. I’d get the guy a paint job for his truck.

I was referring to the crazy person waving what turned out to be a “handgun” that don’t shoot bullets. And yes it is relevant the fact at a distance that BB gun or plastic probably looks similar to the real McCoy. Not certain what cops have to do with this. At any rate, good thing the robber did not have bullets or he may have “accidentally” shot one of the patrons.
The article above indicated other patrons were present then split. Seems the cops would be able to interview at least one of them. For what reason? Probably none.
