Thank You for Your Service – You’re Evicted

Note: Petty Officer Joseph Worrell contacted me months ago – through the “Who’s Your Lender” thread posted on The Burning Platform. PO Worrell has very capable counsel and objected to each unlawful act committed by Emigrant Bank. Yet, Emigrant Bank was allowed to trample all over his rights and unlawfully seize his home.

PO Worrell and I came to the conclusion that the only strategy left – was to go national with the story. True to PO Worrell’s love of country and dedication to service, PO Worrell postponed the PR campaign until his return from deployment.

In his absence, while PO Worrell was serving his country, Emigrant Bank unlawfully evicted the Worrell’s from their home – violating a court ordered stay that was in place while the appeal was pending in federal court.

Emigrant Bank must be stopped. The madness must end. Please circulate this post and contact Eric Cantor and your members of congress and demand that they put an end to Emigrant Bank’s unlawful acts in violation of the SCRA.

Emigrant Bank Violates SCRA and unlawfully seizes active military home while he is deployed on missions in Afghanistan.

Petty Officer Worrell is a Reservist Navy SeaBee and combat veteran living in West Palm Beach who has served honorably for about 12 years. In 2009 he was deployed in the Persian Gulf when the home he built in Palm Beach Gardens was sold by the bank even though federal law (the SCRA) provides military members special protection from foreclosure. Unaware initially Emigrant Bank had in fact sold his house to themselves,  he returned home and continued to live in the home, and with help from a local attorney and military legal aid he started fighting to get the illegal sale overturned.

The Service members Civil Relief Act (“SCRA”, successor to the Soldiers and Sailors Relief Act) accords certain protections and rights to individuals who are either on active military duty or recently retired. The purpose of the Act is to allow the service members to perform their valuable duties without the worry of civil prosecution, foreclosure or eviction under most circumstances.

Before a court will permit such actions, the court will require certification that a military search has been conducted to confirm that the individual is not entitled to the protections of the Act. The proof may be required again later in the proceedings before certain collections or enforcement action is sought.  Proof of that verification is usually in the form of an affidavit which may be called a “military affidavit”, “non-military affidavit”, “nonmilitary affidavit”, “Active Duty Verification Affidavit”.
Petty Officer Worrell complied with all requirements under the SCRA. The Florida judiciary – in both state and Federal Bankruptcy Court ignored the law – and allowed Emigrant Bank to unlawfully foreclose on the property, vacate the bankruptcy stay and now violate a stay halting the sale of the home while the case is under appeal in the Federal Courts.PO Worrell was recently recalled to active duty and left his wife living in the home a PBSO agent showed up Monday May 6, 2013 and taped a 24 hour eviction notice to their front door. Worrell’s attorney filed an emergency motion requesting the court stop the eviction because Worrell was outside Florida on active duty, and the case was on appeal. But on Wednesday May 8, 2013, despite receiving via fax a court order halting the eviction, several PBSO agents and representatives of the bank, still showed up at the home in Palm Beach Gardens, broke the lock, and installed a new one. Mrs. Worrell had to flee their home and leave behind nearly all they own.

The Worrell’s say the bank involved, Emigrant Bank based in New York, is a predatory lender with a ton of political capital. Apparently Congressman Eric Cantor’s wife headed up one of their units, and he allegedly pressured Congressman Michael Grimm of Staten Island into introducing a banking bill that solely benefits Emigrant Bank to the tune of $300 million. See H.R.3128.

Worrell says: “It is very strange because we believe our courts are supposed to protect our rights, not just help banks step on them. Before I can even put down my seabag or checking at my local command – far less pack up and move out, here they come to taking our home to profit unfairly from all our sweat and hard work. We believe some local officials have bent over backwards so this bank can skirt important federal law – and it just wrong”.

Please send this story to everyone on your contact list. We need PO Worrell’s story to go national to embarrass members of Congress into intervening and calling Emigrant Bank off. I’m sending the post to contacts at the American Legion in the hope that retired military will rally behind the Worrell’s and exert their influence on a corrupt Congress.

Contact Congressman Eric Cantor and tell him you want his wife’s employer, Emigrant Bank to comply with the SCRA, follow the law and respect the stay a FL judge has placed on the sale of Worrell’s home.

The law needs to be followed – even by banks connected to his office. Congressman Cantor’s contact info:

I hate to be the party pooper here, but your story about Petty Officer Joseph Worrell is woefully one-sided. All these laws about protection of active duty service members aside, with which I agree and support, I gotta ask, “What the hell did this guy do to force the bank to proceed with foreclosure? What’s the other side of the story?” In other words, HOW and WHY did this happen?

Keep in mind that this query is coming from a retired member of the armed forces who would be more than ready to jump on the bandwagon against Emigrant Bank and support Worrell. I just gotta know the whole story of what I’m supporting.

I have all his records, but do not want to provide any private information – that is really his prerogative.

But I will say that Emigrant’s actions in violating the SCRA in every step of the foreclosure process, while Joseph has been in training for and/or deployed overseas are breath-taking in their audacity and disdain for the law.

I’ve seen egregious acts from banks and financial institutions on a regular basis – IMHO this is the worst case I have seen. Emigrant’s bad acts go unchecked and unpunished.

Wells Fargo Foreclosing on Florida Man Who Made Mortgage Payments Early

Did you know you could make your mortgage payments early and still be foreclosed on? That’s exactly what happened to a Florida man who says he not only made his loan payments ahead of time, but even paid more than was required each month, and is still being foreclosed on by Wells Fargo.

According to Orlando station WFTV, Etienne Syldor was offered a loan modification by Wells Fargo last year. The bank told Syldor that as long as he made the payments during a four-month trial period, the modification would become permanent.

Still, despite court records that prove Syldor made his payments early, and even paid more than the amount he needed to, Wells Fargo stopped taking his payments and began the foreclosure process on his home.

The ridiculous reason Wells Fargo gave: because Syldor made his payments early, he didn’t follow the modification guidelines.

Wells Fargo representative Veronica Clemons said in a statement: “For some loans, completing trial payments is a significant step toward a permanent modification; however, in this instance, the loan was part of a mortgage-backed security and in a protected pool, with specific payment guidelines. We are working with Mr. Syldor to explain the guidelines and explore options that may help.”

WTF?!

Bank personnel should be bending over backward to help borrowers who go above and beyond to meet their mortgage payments each month. Instead, they’re “rewarding” him by trying to take his house away.

“When he came in and showed me all of the documents, it was just unbelievable,” LaMya Henry, Syldor’s attorney, told WFTV. “Who gets foreclosed on when they’ve made all payments on time?”

As Think Progress observed, this instance sadly fits into a broader pattern of past “shenanigans” by the big banks, some of which they were supposed to have ended as part of a multibillion dollar foreclosure settlement with the government last year.

Banks have been accused of similar shenanigans in the past, as many have lost track of paperwork, illegally foreclosed on military members, and refused to work with borrowers who scrounge up money on modifications. Major banks have been widely reported to use a process known as “dual tracking” in which they work with a borrower on a modification while also pursuing foreclosure. Some instructed borrowers to stop making payments to help enter the modification process only to foreclose on them anyway.

But banks were ordered to end dual tracking and other abusive practices as part of the $25 billion fraud settlement. They dragged their feet on ending this practice as homeowners continued to face foreclosure. Banks were also ordered to modify mortgages as part of the settlement but some have been slow to dole out the relief.

Frustration about the weak agreement, coupled with the slow trickle of settlement money, sparked a protest at the Department of Justice on Monday, where activists and foreclosed homeowners marched and some were arrested.

The U.S. armed forces act at the direction of the Commander-in-Chief, a duly elected CIVILIAN whose title is President of the United States. Furthermore, the day-to-day activities of the armed forces are managed by another CIVILIAN whose title is Secretary of Defense.

The armed forces do what those two national command authorities tell them to do. Nothing more, nothing less. If you’ve got a better way, let’s hear it.

SSS – how about no standing army, like the founders intended? How about a militia, along the lines of the Swiss model, whose whole purpose is defense, not world domination?

Now you’re talking some semblance of sense, instead of shitting all over Joseph Worrell and members of our armed forces as you did in your initial comments.

We already have a militia. It’s called the National Guard and Air National Guard, under the command (until they’re not) of the governors of the states in which they’re based.

As for your parallels to what happened to the Nazis (and Japanese, incidentally) in the war crimes trials after WWII, there’s a four word answer to that. We won. They lost.

@Admin, Many people don’t realize this, but about 75% of people in foreclosure were making their payments.

That’s why everyone needs to know that once a homeowner asks for or accepts a modification, they place themselves in the foreclosure bucket. Once in, it’s almost impossible to get out.

The alleged RMBS is not notified that the homeowners payments have been rejected, or even if a mod was accepted. The servicer is the middleman who puts the squeeze on the homeowner, without the knowledge or approval of the trustee and alleged RMBS/REMIC

The Pool Servicing Agreement requires nearly all subservicers to advance the monthly P&I.

Loans in default are supposed to be re-purchased by the servicer.

Well, that never happens. The servicer advances the P&I, even if the homeowner stops paying. Then, the servicer lowers the boom to foreclose so they can collect the insurance policy on the alleged defaulting mortgage, which can be up to 10 times the principal balance.

The servicer collects the insurance payment, and of course never shares that tidbit or the spoils with the investors in the trust.

That’s why the servicers refuse to modify and prefer to drive the homes into foreclosure. If they modify, the servicer risks the insurance company finding out and demanding the insurance payments back.

Pretty diabolical, huh?

I don’t entirely disagree with Paul although I think he’s living in somewhat of a fantasy world, but I’ve always said if decent people did not join the military, police, and government we would be in a lot worse shape than we’re in now.

MERS and RMBS and ongoing bank fraud has well and truly fucked the land records system.

Imagine buying a house for cash and later, the bank discovers an error in conveyancing and summarily takes the house back. The renovations you paid for, well, too bad. True story, probably one of many such.

Or you buy a house on short sale, pay cash, and a month later, without any mortgage, you are foreclosed. WTF? Then you have to fight the bank and the courts at your expense. This true story from Florida, the poster child of robosigning. And it’s still going on. There are document services who will create any documents a bank wants for a modest fee. Too many judges in too many states will just rubber-stamp whatever a bank purports to claim, serves the speculators and deadbeats right!

Anyone who’s taken out a mortgage in the last few years could have a pig in a poke.

PO Worrell’s case baffles me. He has a dedicated and very smart attorney who is filing objections to Emigrants violation of the SCRA. All of the Fl courts, the Sheriff and Congress have been contacted about the violations. And Emigrant continues to snub its nose at the law and take active steps – like violating BK stay and now the stay upon appeal – and seize the home.

Emigrant’s actions are completely lawless.

The only explanation is Emigrant has political capital it is using to skirt the federal law.

Thanks for spreading the story – PO Worrell told me he is so thankful to all of you.

He and his wife are exhausted – they spent the past 2 days packing 10 years worth of possessions.

Members of the Wounded Warriors helped with the move.

Emigrant Bank reps broke into the home and removed possessions from the home, scattering the items, papers in the road and curb.

This is beyond awful as Rich says.

It needs to end – now. Please do what you can to help.

I’m baffled. Is not violating a court order a criminal act? Should not the thugs and the board of thug directors be held criminally liable? Can not the state police step in to enforce a court order? If the second court order is from the federal court would not the federal bureau of investigation be an appropriate government agency to enforce the law? WAKE UP!! History repeats itself. Read the history of Germany in the mid to late 1930’s. Are housing prices up 15% or is the dollar devaluing? Once the hyper-inflation hits and the interest rate sky rockets in a futile attempt to slow inflation it will be central Europe 1939. THIS MAN sacrificed a large piece of his time risking his life (and if his sacrifice had ended his life look at how the percentage of his time escalates) for this? Thank God we are still the home of the brave.

Wow. That’s about all I can say. And shame, shame on that jury that also went along with this!!! I wonder about the jury instructions prior to deliberation?
Well, as someone who deals with tenants and former owners post-foreclosure, I would like to add my two cents….
I am a real estate agent. I sell some foreclosures every year. Most of them are vacant by the time I get them, but sometimes they are not. I live in MA. MA is a VERY tenant-friendly state and it is very difficult to evict people. I understand why, but I would like to give the flip side to this issue.
About 2 years or so ago, another agent friend of mine got a 3 family foreclosure assigned to her (Wells Fargo). The first 2 floors were vacant but there was an occupant on the third floor. Mom, probably somewhere in her 20’s with I believe one young child. Agents are instructed to approach the occupant, find out if they are the former owner or not, if they have a lease (lease tenants are protected to the end of the term, as well as Section 8 recipients), etc. Generally, the bank wants you to make a ridiculous “Cash for Keys” offer to the occupant to get them to move out without eviction proceedings. It’s a joke, usually like 500-1000 bucks. The CHEAPEST places are still more than that a month. Of course, they occupant rejects it, as she did in this case. However, she proceeded to call the code enforcement department and complain that 1. there were no screens in her windows 2. she had bed bugs 3. There was trash in the hallway (it was hers. The city has “resident” bags for like a buck a piece, tenant, owners, everyone, buys these and then the city comes and picks them up. She didn’t want to pay.) Now, keep in mind she had been living there rent-free for about 6-9 months or so, and never called to complain until a face with a name and $$ signs showed up. So code enforcement goes out there and says the bank has to put screens in, take away the trash, and treat the bed bugs. Bed bugs are HARD to get rid of, and you generally have to replace mattresses, box springs, couches, and chairs. The bug guy came and found NO EVIDENCE of bed bugs. But code enforcement said they had to treat and replace her crappy stuff. so they did. NOW she faxes a letter (hand written, terrible grammar) alleging that the agent was racist and was “discriminizing” against her because she was ethnic. By-the-by, she was not. She was Caucasian but had a Latin last name due to a previous marriage. She also claimed she was disabled and was having a hard time going up and down the stairs. She had lived in the building for quite some time with no problem. Guess what? The bank CUT HER A CHECK FOR 7500 BUCKS TO MAKE HER SHUT UP AND GO AWAY. Not a lot, true, but it goes to the mindset of these people who play the system and win, and here we have a SOLDIER being illegally evicted and foreclosed one.
Currently, I have a condo foreclosure occupied by the former owner who has lived there rent free for about 18 months. The management company says she was a constant complainer and claimed she was “tricked” by the bank. Every time I have spoken with her she says she is not moving because she is waiting for “someone to buy this back for her”. I have no idea what she is talking about, but she seems to think a cash buyer is going to keep her there, who knows.
Then, of course, I have the truly victimized tenants who do not even know the place has been foreclosed on and keep paying rent to the former owner who threatens them, screaming, yelling, nut job. I tell them DO NOT PAY THEM ANOTHER DIME he doesn’t own the place, the money needs to go to the bank. So, the owner, prior to moving out of his unit, decides to fill the shut-off fridge with fish carcasses and spreads porn mags (I mean the really nasty ones) and what appears to be used women’s underwear and condoms all over his unit. A real class act.
I could go on and on, I have so many more bizarre and amazing tales, you can’t make this shit up.

I get angry when I see the wounded warrior commercial and wonder why people even sign up when its known that you wont get the needed support and the war has no known goal or limit.

I don’t doubt the validity of your experiences and anecdotes but I will trump that with:

“75% of people in foreclosure were making their payments. ” — MM

Add in all those who were suckered by ‘the bank / servicers / anyone who claims standing … ‘ stop paying your mortgage payments so you can apply for modification.” This is followed by regular instances of “the dog ate your documents”, rinse and repeat until you can find the right judge.

@Novista Some people refuse to believe the enormity of the MBS fraud. I understand it can be difficult to wrap one’s head around the concept that people who are paying their mortgages are in foreclosure.

It’s like 9-11 – another Black Swan. The enormity of the fraud and all of its implications are too big for most to handle.

But thanks to Jim Quinn for giving us this platform and you for continuing to make the case – the message is breaking thru.

I hear from a number of homeowners across the country – who are paying their mortgages but are about to be placed in the foreclosure bucket for a variety of reasons – everything from change in servicer who “looses” their monthly payments to force placed insurance levied on homeowners who paid their hazard insurance premiums.

It is pure chaos.

Chaos reins when the rule of law is ignored.

Have you ever considered contacting Drudge? No matter what you may think of him, there is considerable coverage from that site. I have contacted him before with a cancer case and he was ready to run it before it suddenly settled.

I just received this email from PO Worrell. It breaks my heart. I am so ashamed of my country right now.

Good afternoon,

Since noon on Wednesday May 29 when we were unlawfully dispossessed of our home, unable to move everything, yet ordered not to return to the place we built with thousands of man-hours, our sweat, and very very hard work, we have watched as the outlaw bank seize endless personal files including medical, academic, and financial records of our family and carelessly scatter them in the rain onto the main street (Caloosa Boulevard), exposed for anyone who wants to go through our personal records and stuff for any reason.

I documented this outrage and injustice by video phone feeling maybe we could return to my native Barbados, or even to Japan (if our marriage survives) and start over, having at least shown to ourselves that there was no real justice available here for us. Emigrant and the local authorities committing the traitorous acts against us act under color of law. If section 1983 or the SCRA, or any other federal statute lies powerless on the books for us, then how can we serve in our military, or encourage others to serve under these conditions. Why not just join the other 99%, or like emigrant serve only ourselves.

As I tried to salvage my kid’s medical records and a few other papers from the rain and roadside where emigrant cast them out, and put them in storage, I also sadly concluded my citizenship and service now feels completely useless. Obviously this is the purely vindictive actions of this bank to further punish our courage to fight. Otherwise they could act reasonably and safeguard our valuable, and contact our attorney of record for a decent or civil recovery of our belongings which are obviously important. This bank has fast-tracked its crews and all efforts to sell the home, so that even a successful appeal means we cannot get back our home. Today I am changed in my citizenship and faith in country. I’ve already asked the attorney to seek a federal injunction to stop further violation of important laws established especially to protect those who choose to serve in our armed forces.

This is indeed a day unlike any other since I arrived to this country two and a half decades ago. This weekend sometime I will write our Commander in chief – the President and his attorney general, letting them know that the cheque and promise signed by them and Congress to me and my dependents bounced when we relied on it. Honestly, for the first time in decades, my citizenship, military uniforms, belief and faith in our country appears deeply discounted and of little use. I have worn the Country’s cloth with a special honor and pride for many years both in and outside out borders, but today, its value has fallen because my family was indeed lynched as our Country looked on, either unable or unwilling to prevent the injustices. The message we hear is that you will be publicly destroyed, regardless of federal law, when you challenge us.
