Supreme Court Overrules California Judge; Grants Asylum Restrictions At Southern Border

The Supreme Court handed the Trump administration a big win Wednesday afternoon, after two injunctions against asylum restrictions were struck down. The ruling means that US Customs and Border Protection can immediately begin denying migrants asylum at the southern border if they haven’t first applied for safe haven in a “third country” while the greater legal battle over the issue plays out in the lower courts.

Dissenting from Wednesday’s decision were Justices Ruth Bader Ginsburg and Sonia Sotomayor.

San Francisco Federal Judge Jon Tigar issued a preliminary injunction in July blocking the policy after a coalition of migrant and civil rights groups represented by the American Civil Liberties Union challenged the rules in court, while the 9th US Circuit Court of Appeals narrowed Tigar’s injunction – relegating it to within the 9th Circuit’s jurisdiction. According to the Daily Wire‘s Kevin Daley, “That meant that the third-country transit bar could be applied to migrants intercepted in New Mexico or Texas, but not Arizona and California,” adding that “the 9th Circuit also said Tigar could reimpose a nationwide injunction if he made additional factual findings supporting such a move. Tigar did so and restored a nationwide injunction against the contested rule Monday.”

The ACLU styled Trump’s rules an “asylum ban” before the Supreme Court. The organization claims it violates two federal laws: the Immigration and Nationality Act (INA) and the Administrative Procedure Act (APA).

The INA establishes a general rule that all-comers may apply for asylum, the ACLU argued. Though there are narrow circumstances in which asylum can be denied based on the availability of a third-party alternative, the ACLU believes those conditions are not met here. The plaintiffs also say the new rules should have been subject to a public notice and comment period. –Daily Wire

Approximately 350,000 asylum-seekers have been arrested year-to-date, hailing primarily from El Salvador, Guatemala and Honduras.

This is absolute common sense. How can a refugee be a refugee when they have traipsed through safe country after safe country all the way to the US. International convention is they have to apply at the first port of call.

They are not refugees – they are economic migrants trying to pass themselves off as refugees.

Mexico will hate this. They will now go into overdrive trying to stop the floods hitting their border, as they can no longer wave them through to the US.

The problems caused by dumbing down American citizens knowledge of the History of Civilization* are daunting.

When I was in middle school in the olden days, there was an obvious assimilation process in elementary schools. Teacher decorum was a societal expectation and impropriety with any cbildren was severely disdained. It happened but a whole lot less.

What does this have to do with refugee laws?the same idea that any old cultural tradition is as good as the next is the same as lasttrying to teach children in 3 languages at the same time.

Those Big Birds from Sesame Street are now trying to organize the Real World in their own imagination.

BTW…I was told the refugees are being shuffled to Memphis TN and Little Rock Arkansas to get them distributed in Red regions. I do not know if it is widespread but it is how “realignment” of political ideology is forced into a population. Covertly.

Yup. It’s taken too long for this to happen but at least the Supreme Court undid what activist judges started. What is amazing is how the ACLU stepped in the fray and worked against the American citizens to protect illegals. I don’t call border jumpers migrants, they aren’t. Migrants came to become citizens, illegals come to hover up bennies and escape from their countries that they allowed to become shitholes.
I hope you’re correct about Mexico, Tijuana was overrun and the mayor was going ape over how much the illegals were destroying the area and draining the city coffers. Sauce for the goose….

With SanFranNan in control of the House and Little Jerry running the Judiciary committee, there is ZERO chance of any impeachment charges against a left wing judge.

Barr needs to pick one of these district court rulings and claim the district court cannot issue a nationwide injunction for something that occurs outside of their district. Most of these injunctions are coming from the Northern district of CA, far from any land border.

true that impeachment proceedings wouldn’t go anywhere today but they could be used to show the ludicrousness of the democrat’s position on immigration,along w/being a shot across the bow of leftist & activist judges–
if trump got behind it & appeared at rallies 4 house candidates who pledged to help impeach these judges & senate candidates who pledged to vote no on confirmation votes 4 all but the most conservative nominees,it could arouse the republican base the way they were aroused in 2016–

Back when FDR was pres, he wanted to salt the Supreme Court with several judges who would follow his political bent. Forget how many but it was a large number. What is happening is the color of the court is being altered away from liberalism and more towards conservatism. That’s why the democrats hope Ruth is immortal, they don’t stomach the idea of another conservative justice.
