The prosecution wants 3rd degree as an option. The defense doesn’t. Defense is appealing to MN Supreme Court to keep 3rd degree off the table. Third degree allows for conviction based on reckless disregard (not the exact term). If Floyd was in the process of dying from fentanyl and Chauvin paid zero attention to Floyd’s condition, that would be third degree murder. No wonder the defense doesn’t want that as an option, since that seems the most appropriate outcome.

I see parallels between this trial and George Zimmerman’s. In the latter, the prosecution’s case imploded gradually, to the extent they wanted to add child abuse charges after they realized a conviction on murder was unlikely. Here, if the defense adopts a sound strategy, it will focus relentlessly on the fentanyl levels in Floyd’s bloodstream; that its request to have the trial televised was granted by the judge over strenuous prosecution protests is a good sign.
