If they elevate her, the senate will be 50-50 with no tie breaker until a new VP is confirmed, so I am guessing not until the new Congress is seated.
That’s an interesting conundrum for the democrats: If they don’t elevate her until Jan 22nd, 2023 (so that she could at least theoretically have 10 years in office), the Republicans (who will probably control the senate by then) would have veto power over the VP pick.
I doubt the senate changes, as the only competitive races are in the same states that Biden “won” while counting was suspended. I’m guessing rep pick up GA and dem pick up PA, so still a 50-50 split. The house will be a disaster for the Dems, maybe 60 seat loss.
