Attorney General Kathleen Kane has signed a contract hiring a private law firm to review and prosecute potential cases arising from emails uncovered as part of the ‘Porngate’ investigation.

The contract does not place a cap on legal fees or expenses although Kane’s pick for special deputy attorney general, Douglas Gansler, has said he plans to use the expired independent counsel law’s $2 million threshold as an upper limit.

Kane spokesman Chuck Ardo said Friday that Gansler’s contract is still in the works. Gansler will receive a similar contract instead of previous plans to hire him as an employee of the office, Ardo said.

Several legal experts have raised questions about whether Kane’s authority to prosecute could be extended to Gansler, who will need to be moved into the case pro hac vice due to his not having a Pennsylvania law license.

“They’re hammering out all the fine points of the contract and, whatever challenges there may be, there’ll be a legal solution found,” Ardo said.

Questions about how Attorney General Kathleen Kane’s appointment of special prosecutors will work remain, more than a week after she announced the hiring of former Maryland Attorney General Doug Gansler.

The contract with Gansler’s firm, the Washington, D.C.-based BuckleySandler, was signed by Kane on Dec. 8. On Thursday, the Attorney General’s Office comptroller Douglas Ottenberg signed the contract, certifying that $750,000 had been made available for the expenditure.

Five individuals are listed in the contract’s fee structure, with a note that the firm has discounted their normal hourly rate by 15 percent:

  • Elizabeth R. Bailey, $480
  • Caitlin Kasmar, $740
  • Benjamin B. Klubes, $880
  • Leah Kuo, $205
  • Antonio Reynolds, $685

According to the contract, other attorneys at the firm may be brought in at Gansler’s discretion. The firm will be paid for “reasonable costs incurred in the course of performing the services” as well as expenses for any necessary court reporter services and lodging, meals and travel.

The description of services calls for an independent investigation and prosecution of any crimes arising from the state’s email system, including “tens of thousands of emails.” It also includes “any related acts that may include evidence of improper collusion, lack of impartiality and independence, or obstruction of court proceedings or other government functions.

Those emails have already prompted a series of resignations and retirements, including state Supreme Court Justice Seamus McCaffery. Another justice, J. Michael Eakin, faces possible suspension.

You’re telling me they don’t have administrative systems in place already that automatically log and flag visits to such sites? They sure do. Why not use they systems already in place? Probably because the administrators and managers use the sites too and really they’d like to just target particular individuals.

I would much prefer the tax auditors and property assessors to be jerking off all day instead of actually getting out and doing their official duties…

Just making sure that someone owes her for if she gets tossed out of office. This way the law firm can turn around and rebate some to her in consulting fees or whatever. Sort of a two bit version of the Wall Street scam with Lew, Geithner, etc.

Strangely enough, where I work (NSW healthcare) almost “everything” is blocked, including sites that I NEED to use in order to do my job effectively!

HOWEVER, any machine can access ZeroHedge with no restriction. Maybe this is just an oversight, maybe the IT people also have a thing about ZH, but it means that I can have my daily dose of Doom Porn whilst enjoying a quick teabreak, on ANY machine close by.
