Obamacare Gutted: Core Provisions Ruled Unconstitutional By Texas Judge

Core provisions of the Affordable Care Act, also known as Obamacare, were ruled unconstitutional by a Texas judge on Friday following a lawsuit brought by a group of Republican attorneys general from 20 states against Democratic attorneys general from 14 states led by California’s Xavier Becerra.

According to court documents (below) US District Judge Reed O’Connor of Fort Worth agreed with the GOP coalition that he had to gut key provisions of the Affordable Care Act after Congress last year eliminated the individual mandate – a tax penalty for not buying insurance.

Friday’s decision which will undoubtedly be fought all the way to the Supreme Court, as California has already announced that they will appeal.

The Texas-led Republicans argued that they’ve been harmed by an explosion of people on state-supported insurance rolls – claiming that when Congress repealed the tax penalty last year it nullified the US Supreme Court’s rationale for deeming the ACA constitutional in 2012.

The Democratic attorneys general argued that overturning Obamacare would toss millions of people from health insurance rolls by reversing Medicaid expansion – which would end tax credits and allow insurers to start denying coverage for pre-existing conditions.

DOJ attorneys urged Judge O’Connor to strike down the individual mandate and pre-existing condition mandate, however they asked the judge to spare the rest of the law – including Medicaid expansion, health exchanges, the employer mandate, federal healthcare reimbursement rates for hospitals and premium subsidies.

On September 13, Maryland Attorney General Brian Frosh tried to save Obamacare, seeking a judgement that the Affordable Care Act is indeed constitutional, in the form of a court order barring the United States from taking any action inconsistent with that conclusion. Frosh sued then-Attorney General Jeff Sessions along with the DOJ and department of Health and Human Services.

I wonder what the repercussions will be to this event?

I’ve brought my side-hustle to the forefront, and have been running it full-time since October. So now, the side hustle has become the primary gig.

The biggest hurdle that I have yet to overcome is health insurance. My wife doesn’t fully support the move to run the business full-time, preferring to keep it as a side hobby. She said to me, “You’ll never find health insurance as good as you had at xyz Corp.” I thought if I devoted enough time and research to the matter, I’d be able to come up with something at least comparable.

NOPE. She’s right. The health insurance industry is a total fucked-up mess. There’s nothing comparable that isn’t orders of magnitude more expensive.

I think it’s so fucked up, so that ultimately, it will stifle the desire and creativity for solo entrepreneurs to go back to the fold and care of corporations.

I hope that this ruling will at least begin the process of dismantling this monstrosity.

Another stealth goal of the ACA – make it more difficult for small to medium-sized businesses to source healthcare which provides more power to the corporations.

Thanks, @Tampa. I am familiar with Medi-Share. As of right now, that option is in the lead for the family. However, I’m not familiar with Direct Primary Care, so I will definitely check that out.

Health insurance costs are so bad that many want a single-payer system. The false belief that the gov. can do anything well and at a reasonable cost!

Imagine if the clowns in gowns ever ruled that ANY AND ALL federal government intrusion into the medical and insurance marketplace is UNCONSTITUTIONAL (as of course it is). Of course that would upset most of the GOP leadership as well as they most definitely LOVE all the power and control they can exert over people’s lives in exchange for huge campaign contributions from bigPharma, the AMA, bigInsurance, and so many others.

Imagine if the GOP actually ran on a platform that promoted FREEDOM for a change, rather than just “government tyranny – lite.”

But gross economic ignorance, combined with a very, very long history of supporting the exact opposite of freedom and free markets once elected, will keep the GOP from ever promoting the cause of freedom and free markets. And that same ignorance and duplicity, will keep them from understanding how free markets, and free markets ALONE, can ever properly address the issues of limited supply, rising costs, consumer choice, and restoring consumer power in the market.
