That would be an interesting twist, but Kyle did appear to be telling someone over his cell phone that he just shot someone. Some think he said “I just killed someone”. The cops will of course depose whoever he called. Kyle shouldn’t have exposed his face, shouldn’t have been interviewed earlier in the night and shouldn’t have been carrying a cellphone – aka a tracking device. I agree but the DA is an idiot. Initially it sounds great to the screeching mob but proving 1st degree is a tall wall. One unlikely to be met. If the DA had a brain he’d go for 2nd degree with a much higher success rate. I’d say thanks for charging 1st degree and good luck with that- success ain’t gonna happen.
