Will the Supreme Court’s Conservatives Extinct Themselves?

The state of Texas has filed suit against four states where the presidential election results are in dispute: Michigan, Wisconsin, Georgia, and Pennsylvania. The Constitution gives the Supreme Court original jurisdiction for suits between states (Article III, Section 2). The court ordered the four states to submit their responses yesterday. A number of states have filed amicus, or friend of the court, briefs both in support of and in opposition to Texas.

Suppose the court either refuses to take the case or it rules against Texas. Suppose also that the Democrats win the two contested Georgia Senate races January 5. With the apparent cheating demonstrated in the presidential election and Georgia’s RINO governor and secretary of state, nobody should assume the runoffs will be fair or that challenges to an unfair election will have any chance of success.

Biden would be president and Democrats would control the House of Representatives and the Senate (it would be 50-50, but vice president Harris would break ties). They could and probably would carry out their plans to expand the Supreme Court and “pack” it with a unstoppable liberal majority. In either refusing to hear the Texas suit or accepting the suit but ruling against Texas, the Supreme Court’s five conservative justices will have contributed to their own demises as consequential jurists—collective judicial suicide.

On the other hand, the court could take the case and rule in favor of Texas. It helps that Texas has a strong legal case. Article I, Section 4 states: The Times, Places, and Manner of holding Elections for Senators and Representatives, shall be proscribed in each State by the Legislature thereof; but the Congress at any time may at any time by Law make or alter such regulations, except to the Places of chusing Senators. This clause apparently has been extended to presidential elections, which are held concurrently with Congressional elections.

What this means is the state legislatures have exclusive control of how elections for senators, representatives, and the president are held within their state. Robert Madsen at AmericanThinker.com has done a good job of summarizing how the four states violated the procedures their legislatures enacted in those states’ own election laws (“A Summary of the Texas Election Lawsuit,” December 10, 2020), and how those violations could have changed the outcome. Many of the violations are changes in procedures implemented before the election by state secretary of states or other officials. Covid-19 has been the usual rationale. Some of the violations stem from the alleged vote counting shenanigans on the night of November 3 and the morning of November 4.

The two-fold Constitutional argument is straightforward. Changes by any person or entity other than the states’ legislatures are unconstitutional violations of Article I, Section 4. Furthermore, as Texas argues, they treat the citizens of Texas and other states who played by their own rules differently, and unequally, from the four swing states that violated their own rules. This is a violation of the Equal Protection clause in Section 1 of the 14th Amendment.

These arguments give the court’s judicial conservatives ample reason to rule for Texas. The ruling would comport with the plain language of the Constitution—always important to judicial conservatives and Constitutional literalists—and established precedent concerning legislative control of the time, manner, and place of presidential elections. The Covid-19 rationale is weak and Justice Gorsuch recently poured water on it in a concurring opinion invalidating New York Governor Andrew Cuomo’s Covid-19 restrictions shutting down religious institutions.

Government is not free to disregard the First Amendment in times of crisis.

It looks like Gorsuch will vote to hear the Texas case and then, if the case is heard, rule for Texas. The question is will the other four conservative justices join him? (Chief Justice Roberts is an emasculated weenie who may or may not join.) They can decline to hear the case or hear it but then rule against Texas. However, they’d run the risks that a potentially rigged Georgia run-off election puts two more Democrats in the Senate and makes that body effectively Democrat-controlled, Democrats then pack the Supreme Court with an unstoppable liberal majority, and the conservatives spend their careers writing irrelevant dissents. That would be an especially ugly prospect for the court’s younger conservatives, Kavanaugh, Gorsuch, and Barrett.

Or they can rule for Texas, keep themselves relevant, and have an opportunity to shape Constitutional law and the course of the United States for many decades.

A win for Texas throws selection of electors for the electoral college into the the four states’ legislatures, which are all controlled by Republicans, presumably handing the election to Trump. Even if the Republicans lost both Georgia Senate seats, Trump would stop any court-packing scheme. On a non-judicial note, the conservative justices can’t be too happy with Democrat and leftist “initiatives” the last four years: Russiagate, the impeachment, Covid-19 totalitarianism, this summer’s riots, and the election shenanigans. So they have a choice: Trump, or risk their own extinction. The first choice looks like the better bet, although one never knows how deeply corruption and cowardice runs in the nation’s capital.

Maybe not. The 9-0 decision regarding lack of standing would make sense if the foreign interference did take place and the Supreme Court was aware of this foreign interference. EO 13848 (link below) had 2020 US election under a national emergency and any foreign interference would therefore be under military jurisdiction, not Supreme Court. We’ll see.

Demo charges are a lot more effective and easily mixed from commonly available chemicals. Fougasse, EFP, TATP and a shit load of other IEDs are made with relative ease as we learned in some courses and Field Manuals as well as Iraq and A-Stan. Copper is pretty easy to come by.

I used to live in Taos, NM. That was back in the early 80’s. The local Mexicans didn’t like the Texans and other white folk moving in so they would burn them out. Set fire to their homes, barns and what not. They would also stalk white folk, you didn’t go into the forest alone or unarmed. We fought fire with fire, once, a pickup full of the little shites pulled up in the driveway of our business and proceeded to piss over the side. They quit that right quick when our shotguns and other armaments came out. Lots of pee soaked pants as that truck pulled out right quick.

Without going into specifics here, the reality is that we know what to do…movies like Fight Club and books like the Monkey Wrench gang are out there, along with Bracken tales and so on. I will make a prediction that may be wishful thinking but I think the SCOTUS will rule unanimously in favor of Texas. In addition to the reasons you suggest, it is a slam dunk case if you follow the constitution and the members of the court are smart enough to know that the vote was a fraud and will continue to remain so and get worse under the Democrats. Unanimity gives the court the cover it needs to help protect the nation from self destruction. Yes it is lancing an ever growing ugly boil that is today’s politics but if not today, then when. It is not going to get any better, just worse. Let Trump take his rightful place as president and let him deal with the mobs. At this point, no matter how a president handles it, it is going to look like tyranny. Trump will no doubt not make the same mistakes he has made in the past but he knows the outcome is what matters.

The fact is: even hearing a lawsuit by one state to unseat electors for another state is opening a huge can of worms.
The actual wording of the Constitution is clear: every state decides how its elections are run. If they want to flip coins or throw darts, that’s fine so long as said state’s legislature approves it.
Federal election laws are more specific but still largely govern issues like campaign finance, specific types of voter suppression etc. There are no federal election laws governing precisely how any given state runs its elections, with the exception of the anti-discrimination laws.

You just cut to the heart of the Texas argument and apparently aren’t aware of that fact. The Plaintiff argues that the defendant states acted unconstitutionally by bypassing or ignoring their state legislatures when determining election procedures. The plaintiff states that as a result of ignoring the state legislature’s election rules the defendant states have unfairly cheated the plaintiff of electoral votes.

Yes, in fact, fraud is irrelevant since it is a function of viewpoint.
The United States used to count slaves as 3/5ths of a person – how do you think those electors were voted? They were chosen by governors and/or legislatures.
You people really ought to at least attempt to understand how the US government actually works: federal, state and local levels are defined more by where each level is not defined than what each level is responsible for.
There are no federal laws anywhere saying an election has to be run according to any specification. A state can split its electoral vote or go all-or-nothing. It could institute ranked choice voting, if they desired. They could use darts.
It doesn’t matter so long as the state legislatures don’t actively oppose it.
And that’s the key point here: are the Michigan, Georgia, Pennsylvania etc legislatures actively opposing the election results?
The answer seems quite clear: no.

Election fraud goes on all the time, by both Republicans and Democrats.
The New York Times ran a story in 2012 about how Republicans were known for…absentee mail-in voting, and that mail-in voting was much more easy to enable fraud than in-person.
This is funny since it is 100% opposite to the bullshit Newsmax and what not are talking to.
Was there fraud? Certainly. Was the fraud exclusively Democrat? No.
Did the fraud change the results? Not at all clear.
Again – the fact that mail-in balloting changed the demographic of the election *is not* a sign of fraud. This was the highest turnout (in the votes submitted sense) seen in a long, long, long time.
Prove that the frauds mattered and we’ll see – but the reality is that none of the evidence is clear.
And I say this as someone who does investigations for a living.

The problem was that the legislatures did not approve any of it, the Local officials and Secretaries of state changed the rules on absentees and late ballots without the legislatures. That was the whole point of the lawsuit

That “remedy” would become a cruel joke, once all of these new states are overrun by non-white immigrants (a 100 pct certainty during Biden’s reign), and instead of red senators you would actually get blue ones. In case you missed it, Texas’ demographic overhaul pretty much tracks California’s, so the former will go blue soon enough. Secession is the only option at this point, anything else is too little/too late.

The Justices will defend the Establishment. Paramount in their consideration is the potential effect of that judgement on the durability of the Establishment they belong to. The Constitution is but one part of the Establishment, less important than others, that they will defend.

It is apparent to everyone, including the Justices of the Supreme Court, that the entire establishment, without any significant exception, is opposed to another Trump term. It is also apparent that the November election was full of fraud, and that fraud changed the outcome of POTUS (at least, perhaps some House and Senate races as well) to favor the name on the ballot favored by that establishment. Thus to find and judge that enough votes were illegally and fraudulently awarded to Mr. Biden would be to go against the entire establishment that these Justices (save Mr. Thomas, perhaps) are so very, very proud to be members of. It seems quite unlikely that the Justices will make that judgement.

If SCOTUS did judge that enough votes in enough states were to be voided to stymie a majority in the Electoral College, (seems like the preferred outcome. No one is presuming that any of the Big 4 States will send a Trump slate) there is little reason to be confident that the House would vote to seat Trump. They might, but would not be bound to, and the Establishment would exert powerful force to get Biden (or any not-Trump) into office. So SCOTUS would put the legitimacy (if any is left) of the entire system on the line, knowing that it may be entirely for naught. That seems pretty unlikely to me. Lotta risk for little reward. They don’t like Trump either. They need the favor of the Establishment, or they will have to get real jobs.

And if they find for Trump, and the Prog/lefties turn out to burn and smash (as it seems is possible if not likely) Trump will have to move to quell with troopers under his command. That means either nationalizing State National Guard over the head of the governor, or sending in regular troops. It beggars belief that SCOTUS is going to render any judgement that may very well lead directly to that end, with Trump doing the ordering.

Don’t get mad, get even. Mean. Sneaky. Forget about honor and fair fights. We can make these idiots sorry they were ever born, one nasty little episode at a time. No Facebook meeting notices, no TIKTOK reports, no coordinated effort. Don’t tell your friends. Just pick out a member of the establishment and…. make them wish they weren’t. Then go quietly back to whatever it was you were doing.

I think they will take the case and “split the baby”. I’ve been reading about the process and heard a law professor on Sirius today that helped me to finish my nonqualified opinion of what will happen.

1. They will take the case because there are some very legitimate problems with the last election that cannot be ignored.

2. Per Article 2 Sec 1, the Electoral College meets Monday, Dec 14th per the Electoral Count Act. Conventional thinking is that the winner needs 270 votes. If we want the Constitution followed that include Monday. Sometimes following the Constitution doesn’t work for the good guys but more on that later.

3. January 6th congress counts the votes from #2. I think here is where the SC comes in. The SC will throw out the votes from one or more of the contested states. They aren’t going to award them to Trump. They just won’t be counted.

4. Per Article 2 Sec 1 and 12th ammendment,

The person having the greatest Number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President.

Even throwing out those states Biden wins, Texas lawsuit wins, and us plebes lose. Nowhere in there does it say 270 electoral votes.

Most stoics were soldiers before the became philosophers.

The nation we knew as America is gone and holding onto ideas like the Constitution or justice are not only pointless, but are in fact handicaps. People are quite literally watching those who cheat win the game and are trying to seek recourse through the official rules. It’s the same kind of chivalric nonsense that sent human waves up against machine guns.

A contract is only as good as the paper it is written on when one party doesn’t abide by the terms and conditions.

It’s time to adopt new tactics, but more importantly to first develop a workable strategy.

Voting and courts are clearly not it.

Cassandra was given the gift of prophesy and the curse of having no one believe her. I am old enough to remember the Kennedy assassination and who climbed into power as a result of his murder and what came into being as a result of that coup. I am also old enough to remember the casualties of the Viet Nam war and the direction the country went as a result of Johnson and his cabal being in office.

I have come to enjoy your contributions over the past year and have a great deal of respect for your talents, but you have a pessimism that runs through your posts more often than not and it makes me feel a genuine sympathy for you .

I don’t know what Stalin thought (or why you felt that was important to mention), but I do know that far more people survived the Soviet system than died in it, especially the ones who produced the food. In war those living in urban environments face far greater risk to their life and liberty than those who live in rural ones. I know that people with a wide range of skill sets and a positive outlook fare better in life than those who are specialists and live in perpetual anxiety. In life it is best to play the odds which favor a successful outcome.

I don’t worry about whether I’ll be killed for my opinions or die from a fall out of a tree because everything dies and death isn’t something to live in fear of, but to be accepted as a fact of life. I choose not to worry about things over which I have no control and focus instead on those things which are in my mind and hands to do every moment of my life.

I’m sorry you think I’m so cynical. I’ve seen things that most people don’t believe exist, much less actually happen, so I have this cynicism and lack of rose colored glasses. I hold no illusions, the people pushing the agendas have made no secrets of what their ultimate goals are and said goals aren’t exactly wonderful for anyone who cherishes their independence. They aren’t confined to the USA either, this is a global coup, witness Europe, Australia and England and what is happening there as regards lockdowns, economic destruction, loss of freedoms and massive police state activities.

I do marvel that you can be so sanguine about the death of the country, I suppose it is because you are born here and take (took) it for granted. America was unique, one-of-a kind and to crassly brush off her death as some cavalier, ‘oh, well, ces’t la vie kind of moment’ astonishes me.

Thank you for your good thoughts, I wish the same to you and yours as well.

Those are my sentiments too.

Tonight I watched Rudy G. impotently rage as Sean Hannity stared back in doe-eyed disbelief. That was before Hannity was preempted by “breaking news” regarding the FDA’s approval of Pfizer’s covid vaccine.

In the next hour, I watched Laura Ingraham and Congressman Jim Jordan discuss Hunter Biden’s ties to China. Jordan’s final comment before the commercial break described his anticipation for John Durham’s forthcoming report.

It’s surreal, like discussing Jackie Kennedy’s dry cleaning bill in the moments after JFK’s head exploded.

Strange times. And I honestly believe it’s going to get more strange in the next several days and weeks – with even more twists and turns in the road ahead.

Therefore, as it all unwinds, I’ll be contemplating the “Parable of the Taoist Farmer” as well as some of the solutions which were left as breadcrumbs in the final paragraphs in each of my last three articles here on TBP.

It is what is.

“Deep State” moniker originated in Turkey, and the only way to fight it is the way Erdogan did it. Mass arrests, mass trials (Ergonekon), etc. Due process is optional.
Nothing else will do.
But I think it’s too late anyways.

The supreme court just F–ked up. It shows that they do not recognize the constitution. This means that they have become irrelevant. I do not recognize them. It is obvious that we are in the same position that the former soviet union was in in 1989. The democrat states are broke. The republican states are doing OK. Biden will not become president of the republican states. The Union is finished.

There are only two possibilities with whats going to go down. 1) Trump is going to concede and he was just put in the presidency to ratchet this thing up about 15 notches for the cabal. 2) Or he’s a good guy and was more than ready for this fight and under no circumstances be leaving the white house. In my mind there is no wishy washy crap about him being a good president but got cheated. If he leaves office, he was in on the scam all along.

The Constitution does not give any state the authority to challenge the validity of the legislation, or its enforcement, of any other state—which is what Texas is [was] doing.

It would appear the citizens within the state, who file affidavits the fraud resulted in the lose of their vote, have standing. With such claims in -3-4-5-states, there could be a consolidation–or a class action ??

The way I have been reading the dismissals, the supporting evidence appears to have been poorly presented as conjecture.

I thought the Article IV., Section 4. argument was stronger. The criticism was that it is rarely invoked in any legal theory before the Supreme Idiots and therefore its status is lowly. It states, “The United States shall guarantee to every State in this Union a Republican form of government….” As another American Thinker contributor argued, what is more evident of republican governance than free and fair elections? The fact that any non-citizen is registered automatically to vote because legislators in various states have found it illogically convenient to hand out licenses to drive is proof of intent to undermine elections by cancelling out valid votes from citizens.

Of course, all of this, every bit of it is can be laid at the feet of the Republican Party, which has betrayed every single American citizen by failing to take up this cause beginning in January of 2017, and that includes Donald Trump. Was there any doubt that 2018 was a dry-run for 2020? Democrats told us so.

Not one single solitary court, from the local level all the way to SCOTUS, allowed a single witness to take the stand, be sworn in and testify about the fraud he/she saw occur. NOT ONE!

WHY DO WE HAVE ELECTION LAWS ON THE BOOKS IF THEY WON’T ENFORCE THEM OR EVEN QUESTION WITNESSES WHO REPORT ELECTIONS VIOLATIONS?!?!

Did the conservative justices give the election over to Biden for the same reason republicans undercut themselves in congress; to turn power over to liberals so they can’t be held responsible? Time and again republicans in congress put themselves in the minority so they can say, “Hey! We don’t have the numbers to fight!” With Biden threatening to pack SCOTUS, did Roberts and the conservative justices pull a republican congress move so they could safely be outnumbered from the sidelines?
