New Gun Control Bill Hits Congress: “To Ensure That The Right To Keep And Bear Arms Is NOT Unlimited”

In the wake of the Sandy Hook shootings we warned that sweeping changes were in the works for Americans’ right to bear arms. It started with ammunition tax proposals, restrictions on firearm accessories imports and most recently Governors began bypassing Congress altogether by banning gun ownership for those on any of the government’s many watchlists. The Obama administration has also targeted licensed firearms sellers across the United States by forcing banks to treat them like pornography businesses and impeding their access to transaction processing systems and business banking accounts.

States like California already ban “assault weapons” and outlaw “high capacity” magazines that can hold more than ten rounds of ammunition. But the kinds of restrictive laws that strike at the very heart of the Second Amendment of the U.S. Constitution have thus far been limited to just a dozen or so heavily liberal states.

Until now.

While Americans anxiously prepared for their Christmas festivities, anti gun proponents in Congress were hard at work drafting a new bill. If passed H.R. 4269 would literally redefine the Second Amendment as evidenced by the bill’s description, which in no uncertain terms clarifies its ultimate goal:

“To regulate assault weapons, to ensure that the right to keep and bear arms is not unlimited, and for other purposes.”

The bill directly targets every semi-automatic firearm in the United States including handguns, shotguns and rifles. It specifically mentions certain firearms and manufacturers, including the popular AR-15 and AK-47 rifles.

Because the law is Federal it would blanket the country with new restrictions, including making it illegal to own any magazine that exceeds a capacity of ten (10) rounds. 

And here’s the kicker, even if your weapon has a legally-defined low capacity detachable magazine but is modified with any of the following accessories, it is considered an “assault rifle” and would be outright banned in the United States.

Semiautomatic rifle that has the capacity to accept a detachable magazine and any 1 of the following:

 

“(i) A pistol grip.

“(ii) A forward grip.

“(iii) A folding, telescoping, or detachable stock.

“(v) A barrel shroud.

“(vi) A threaded barrel.

 

“(B) A semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds, except for an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.

 

“(C) Any part, combination of parts, component, device, attachment, or accessory that is designed or functions to accelerate the rate of fire of a semiautomatic rifle but not convert the semiautomatic rifle into a machinegun.

To be clear, the new bill puts all half measures aside and goes for the jugular.

This is the worst case scenario that many Americans have feared.

If you own a weapon on the ban list or have accessories as described by the bill, your firearm will be outlawed in the United States of America.

SEC. 3.RESTRICTIONS ON ASSAULT WEAPONS AND LARGE CAPACITY AMMUNITION FEEDING DEVICES

 

(a) In General.—Section 922 of title 18, United States Code, is amended—

 

(1) by inserting after subsection (u) the following:

 

“(v) (1) It shall be unlawful for a person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a semiautomatic assault weapon.

 

 

“(37) The term ‘large capacity ammunition feeding device’

 

“(A) means a magazine, belt, drum, feed strip, or similar device, including any such device joined or coupled with another in any manner, that has an overall capacity of, or that can be readily restored, changed, or converted to accept, more than 10 rounds of ammunition;

 

 

“(w) (1) It shall be unlawful for a person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a large capacity ammunition feeding device.

The bill was introduced in Congress on Decemeber 16, 2015 and currently has 123 co-sponsors – all democrats.

We know that gun bans don’t work but one can’t help but think the agenda goes much further than the notion that they want to make us safer. If that were the case then our lawmakers wouldn’t allow drug cartels, gang members and Islamic terrorists to cross into the U.S. through our porous southern border.

The reality is that a cloud of tyranny has descended upon America. For it to be successful the American people must first be disarmed.

As history has proven time and again, a disarmed populace can easily be led to slaughter. But unlike the tens of millions executed in ethnic, religious and political cleansings of the 20th century, Americans have a rich tradition of personal liberty and the right to bear arms. It is embedded in our culture and our founding document. And as Texas police chief Randy Kennedy recently warned, if the government pushes too far they may well incite a revolution.

They usually claim this power under the right to regulate trade between the States.

Ignoring the fact that the 2nd Amendment was written at a later date and modifies this the same way the other amendments modified, nullified, or added to. previous provisions of the Constitution.

Not that I would expect Congress or the Courts to recognize that if their agendas are hampered by it.

But keep in mind that, as Chairman Mao once succinctly pointed out, “all political power grows from the barrel of a gun”.

Those wishing to seize all political power always want the only guns to be their own, with none left to the people at large.

It seems the Author is confused about the processes:

This and other statement seem to suggest he failed to read the “Grandfathering” provisions laid out in the bill.
All that are owned and possessed at time of passing will remain in Civilian hands. No?

So the authors of this bill feel they need to throw the public a little deception to have a chance at passing this. This could just as easily been titled The Big Lie

ALL Assault Weapons that are here and registered on the civilian market at the time of enactment will get to stay, including hi capacity mags(which must be serialized), and will be ‘Transferable’ among the general Civilian population.
Just like NFA items currently: Machine Guns, Silencers, Short Barrel Shotty’s, ect, the AW ban will fold seamlessly into a long, proven, established curriculum.
Now or eventually, this will come to be, and then they will fold semi-automatic pistols into the group.
Grandfathering, proven tactics, threaten confiscation loudly and often, then compromise by allowing all to stay. The socialist play the long game, the sun sets for many.

“(2) Paragraph (1) shall not apply to the possession, sale, or transfer of any semiautomatic assault weapon otherwise lawfully possessed under Federal law on the date of enactment of the Assault Weapons Ban of 2015.”

SEC. 5. Background checks for transfers of grandfathered semiautomatic assault weapons.

(c) Identification markings for large capacity ammunition feeding devices.—Section 923(i) of title 18, United States Code, as amended by this Act, is amended by adding at the end the following: “A large capacity ammunition feeding device manufactured after the date of enactment of the Assault Weapons Ban of 2015 shall be identified by a serial number and the date on which the device was manufactured or made, legibly and conspicuously engraved or cast on the device, and such other identification as the Attorney General shall by regulations prescribe.”.

Yo- All transfers between Civilians will need to transfer under federally licensed dealars(FFL’s), and ATF, just like now for all NFA items.
The value of Assualt rifles will absolutely skyrocket under this plan, bank on it, just like Machine Guns after 85, same rules, same proven track record.

A Little Gun History Lesson

* In 1929, the Soviet Union established gun control. From 1929 to 1953, about 20 million dissidents, unable to defend themselves, were rounded up and exterminated. This doesn’t include the 30 million ‘Uncle Joe’ starved to death in the Ukraine.

* In 1911, Turkey established gun control. From 1915 to 1917, 1.5 million Armenians, unable to defend themselves, were rounded up and exterminated.

* Germany established gun control in 1938 and from 1939 to 1945, leaving a populace unable to defend itself against the Gestapo and SS. Hundreds of thousands died as a result.

* China established gun control in 1935. From 1948 to 1952, 20 million political dissidents, unable to defend themselves, were rounded up and exterminated.

* Guatemala established gun control in 1964. From 1964 to 1981, 100,000 Mayan Indians, unable to defend themselves, were rounded up and exterminated.

* Uganda established gun control in 1970. From 1971 to 1979, 300,000 Christians, unable to defend themselves, were rounded up and exterminated. The total dead are said to be 2-3 million

* Cambodia established gun control in 1956. From 1975 to 1977, 1-2 million ‘educated’ people, unable to defend themselves, were rounded up and exterminated.

* Defenseless people rounded up and exterminated in the 20th Century because of gun control: 56 million at a bare minimum.

* Gun owners in Australia were forced by new law to surrender 640,381 personal firearms to be destroyed by their own government, a program costing Australia taxpayers more than $500 million dollars. The first year results:

Australia-wide, homicides went up 3.2 percent

Australia-wide, assaults went up 8.6 percent

Australia-wide, armed robberies went up 44 percent (yes, 44 percent)

In the state of Victoria alone, homicides with firearms are now up 300 percent. Note that while the law-abiding citizens turned them in, the criminals did not, and criminals still possess their guns.

It will never happen here? I bet the Aussies said that too.

While figures over the previous 25 years showed a steady DECREASE in armed robbery with firearms, that changed drastically upward in the first year after gun confiscation…since criminals now are guaranteed that their prey is unarmed.

There has also been a dramatic increase in break-ins and assaults of the ELDERLY. Australian politicians are at a loss to explain how public safety has decreased, after such monumental effort and expense was expended in successfully ridding Australian society of guns. The Australian experience and the other historical facts above prove it.

You won’t see this data on the US evening news, or hear politicians disseminating this information.

Guns in the hands of honest citizens save lives and property and, yes, gun-control laws adversely affect only the law-abiding citizens.

Take note my fellow Americans, before it’s too late.

The next time someone talks in favor of gun control, please remind him of this history lesson.

Note: Admiral Yamamoto who crafted the attack on Pearl Harbor had attended Harvard University 1919-1921 & was Naval Attaché to the U. S. 1925-28. Most of our Navy was destroyed at Pearl Harbor and our Army had been deprived of funding and was ill prepared to defend the country.

It was reported that when asked why Japan did not follow up the Pearl Harbor attack with an invasion of the U. S. Mainland, his reply was that he had lived in the U. S. and knew that almost all households had guns.

And which agency will have the honor of enforcing such a law? Aside from 25% to 50% of the agents becoming violently ill and not reporting for duty, who would volunteer to be the tip of the spear? ATF? FBI? DHS? The first batch of raids on civilians resulting in 100% casualty (on the side of LEO) would cause the rest to consider their career versus their family collecting life insurance benefits. Let alone the open season on all Federals. No, I think this bill is for bragging rights within the Democratic Party. I believe they know it would ignite civil war.

I am relieved to know that millions of similarly minded citizens would decide “enough” and return all their “assault” weapons. Bullets first. Fired from distance and delivered with wicked accuracy. That darned 2nd amendment makes for a rough road to achieve tyranny. That enough of us agree means the representatives in DC can do only what they can implement. Imagine an Afghanistan the size of the US.

Tactical- There will be no raids, there will be no mass confiscation, ATF will administer it of course, just like NFA(34),GCA(68), FOPA(85), and even the last Assault Weapons ban in 92. If it passes, everyone will go along without fanfare, everyone.

Suzanna… I don’t see any reason to tell footless until she is actually able to organize a visit. I did indeed discuss the issue bluntly with her son when he was invited to deer hunt here… I told him that while his mother and I had been friends in the past, there was probably not room for her lifestyle choices here.

The round bale feeder is not that great of a loss and since the four fence panels were used to pen in one very sad and pathetic feeder steer for fattening up for several months until it finally got large enough to break down one of the panels and bend another I simply decided that the lesson learned from that unfortunate experience was enough to merit the loss of the equipment.

When I saw what they were being used for, I was sickened, knowing that I would NEVER eat any meat at any of the tables any of that steer would be served. AS a matter of fact, I will never be in the presence of any of those people. Maybe that is payment enough. Who needs the kind of people in their life who will put an animal in a ten by ten foot square pen and make it live there for a year. Not anyone I ever want to admit as being related to me.

It is out of my mind until she is well enough to try to visit. Then I will tell her. Don’t worry, I’m quite capable of it. I don’t like to be a bitch, but I do it quite well.

suzanna- There will be no confiscation, all the AW here, get to stay, its only future AW’s. This will put the vast majority of people on the sidelines. The price will rise dramatically on them, and people will be happy, you will still be able to buy any that are here now.
Where were all the 2nd Ammendment Stalwart’s in 92′, 88′, 85′, 68′ or 34′?
If it passes nobody will do anything, including you, we will all enjoy our fortune to be ‘Grandfathered’ and so it will go.

Technically there are States that already have full ‘Bans’ in place, many people are illegally possessing these AW’s and nobody has done squat about it. Granted the States have not tried to collect them yet, but this bill does not even go that far, possession and transfer will still be legal. Just expensive.
I give it an almost 50/50 chance.

I only recently became a gun owner–something I have been looking to do for a while…cleared up some money and after San Bernadino the wife got fully on board. It’s funny, but although my dad grew up with guns (in fact he was given a rifle by Amelia Earhart when he was 7 years old), he never taught any of us kids about guns.

I have always been a little bit conflicted about guns…never our absolute right to have them, just whether I personally wanted to be a gun owner myself. Well now, after two short weeks, I am hooked. I got the very basics covered (rifle, pistol, shotgun) but I would by ten more tomorrow if finances allowed. Went shooting at a friend’s land last weekend and can’t wait to go again.

Any Amazonian natives on TBP? Imagine the conniptions in the House and Senate if some home-visiting Congresscritter (Democrat, because they created this bill) were to go back home and perish from a poisoned blowgun dart. Can you imagine the contortions they would go through trying to define an “assault blowgun”, “high-caliber blowgun darts” and such?
I think they need a heavy dose of reality, but not from TBP-ers. Let’s just make it a law that every Congresscritter has to spend 96 hours unaccompanied in his / her home district in the highest-population-density area. Having to spend four days surrounded by their constituents would probably put an end to bills like these overnight!
BTW; if this passes, the Second Amendment (as currently written, not amended) is automatically a CCW permit for the entire nation. No questions asked!
