A New Excuse to Harrass and Collect

Orwell described things that seemed a bit much in his novel, 1984. Like, as a for-instance, the Telescreen-prompted mandatory morning calisthenics – physical jerks – the novel’s main character, Winston Smith, was forced to endure each day.NJ SS

Well, things that seemed a bit much when I read this book back in high school – back in the ‘80s – have become our Loving Big Brother reality.

Like this, for instance:

The state of New Jersey – arguably, the California of the east coast as far as regulatory idiocy goes (this is the state in which you are not allowed to pump your own gas) is on the verge of passing what would be the most idiotic “distracted driving” law in the country.

The legislation – see here – defines “distracted driving” as “any activity unrelated to the actual operation of a motor vehicle in a manner that interferes with the safe operation of the vehicle.”

Italics added.

This to be defined by the New Jersey State Police (and other police) who literally wear uniforms that – excepting the lightning bolt insignia on the collar – look like they were designed by Hugo Boss for Heinrich Himmler’s minions.SS uniform

It could be drinking a cup of coffee. Eating. Almost anything – literally. Hands not at “10” and “2” – both eyes (in the opinion of a cop) not firmly fixed on the road ahead?

Distracted driving!

“The issue is that we need to try, in every way, to discourage distracted driving, it’s dangerous,” Assemblyman John Wisniewski, a Democrat in Central Jersey, who sponsored the bill, told The Star-Ledger. “Education and enforcement can change the attitudes of people.”

It’s even worse than “drunk” driving laws, which at least have a specific – objective – measure defining the offense. Your BAC level is either over or under the threshold. It is not up to the cop’s opinion.

But “distracted” driving would be.

The bill is onerous – and tyrannical – on many levels. In addition to criminalizing yet another category of non-harmful actions, it also gives cops a pretext to stop any car, at any time. All a cop need do to justify the stop – and whatever happens subsequent to the stop – is claim he witnessed “distracted” driving.

Excepting the egregious random/dragnet-style “safety” and “drunk driving” checkpoints we’re forced to occasionally deal with, in other cases, a cop must have probable cause – some specific, tangible reason that can be substantiated later on, in court,  to justify initiating the pull-over. You have a dead inspection sticker, a burned out brake light. You’ve committed a moving violation of some kind.

Something like that.

But provided you do not have a dead sticker or a burned out brake light and have not committed some specific traffic violation (e.g., failing to come to a complete stop, turning right on red where not allowed) the cop can’t – legally – pull you over. And if he does so regardless, you have a defense, legally speaking, when the matter goes to court. Not just for the initial stop but for whatever occurs subsequently. If the initial stop was not legally defensible, it is possible all charges stemming from the stop will be dropped. This is the “fruit of the poisoned tree” doctrine.

But with the “tool” of an offense so vaguely defined as “distracted” driving – which could be defined by the cop as you glancing at him momentarily (you took your eyes off the road!) or any of a dozen different things, he can no pull you over at will. And go fishing. And even if he doesn’t find anything, you’re not going home empty-handed.SS head shot

The proposed legislation lists fines starting at $200-$400 for the “first offense,” graduating to $400-$600 for the second, ascending from there to $600-$800 and a three month suspension of one’s privilege to drive.

All at the discretion of a costumed and heavily armed state thug whose job is to extract as much money from our hides as possible.

How would one defend oneself against a cop’s claim that he “saw us look away” from the straight ahead? Or “glanced down” to change the radio station?

And is it really “distracted” driving to sip coffee behind the wheel?

The only upside to this business is that it may be Too Much and Too Soon – like Virginia’s equally over-the-top “aggressive driving” statutes (written by a state lawmaker who just happened to be a lawyer whose area of law just happened to be providing high-cost legal assistance to drivers charged with “aggressive driving”) that hit people with four figure fines for simple speeding and other such “offenses.”

It was repealed on a tsunami of public outrage and – hopefully – the same will happen to this New Jersey awfulness.

Laws like this usually become all inclusive because proposed laws to get rid of obvious dangerous distractions such as texting and other cell phone use while driving bring about the cry of “Well what about ……” (you fill it in with everything from crying babies to drinking coffee, etc.) so the legislators just include those things to satisfy the criticism and avoid looking like they are singling out specific activities even those are the ones proven dangerous.

So critics of such proposed laws get what they are demanding, even if they really weren’t demanding it and trying to use a ridiculous example to attack a reasonable law.

What the fuck do sheople expect as we build a for profit prison system where the contractor operating the prison gets paid based on occupancy rate?

This is why I was shocked that states were so easily allowed to legalize weed. Now they have to figure a way to imprison more people for minor infractions to keep up the occupancy rate.

Saw that in this past Sunday’s Newark Shit Ledger. Excessive blinking could be construed as distracted driving. And what about squeezing the snake and driving?

I can’t imagine a more evil, money grubbing, hellish, Gestapo-ish state than shitfuk NJ.

When I lived in Wilmington, the nearest WalMart was across the river in Pennsville. I’d go there, and sometimes drive back in the boonies a ways and go visit some Lenape friends. There was a hog farm with a pork store. Pork stores and my Lenni-Lenape friends were all I liked about Jersey.

Sure he can. He just makes up some pretext. Happened to me almost 20 years ago. It was my first ever encounter with an American police officer. In the beautiful Texas Hill Country, somewhere between the towns of Bratwurst and Weizenbier.

We were in a car with Mexican plates and darkened windows. Yeah, right, wtf did I know back then.

Lights flashing behind us. Can’t possibly mean me? Did nothing wrong. Kept on driving. Hmm. Doesn’t go away. Better pull over.

Then I did everything wrong you can imagine. First mistake: I got out of the car, see what’s up. As I said, wtf did I know. A stoopid German in a Mexican car in Texas.

Then my girlfriend gets out too. Officer starts yelling, “get in the car get in the car GET IN THE CAR” right hand on his holster. WTF?

I asked why he stopped me. He said she didn’t have her seat belt on.

Fuck me hard. I was totally dumbfounded by the fact that a police officer USED A LIE to pull us over.

License, is there anything in the trunk I should know about and so on. Really tense. At least for me.

Guy relaxed when he found out he dealt with a harmless out-of-the-country jackass who doesn’t know shit about how to behave in a traffic stop. “Ok, I will not write you a ticket”. “Never thought you would”, me, still being stoopid and defiant.

Only years later did I fully understand what could have happened that night. Guy was on the edge because he probably thought he dealt with some narcos.

Phew.

Fuck New Jersey. Everybody should just NOT go there, ever. Don’t fly through Newark, don’t drive up 95, don’t stay in Jersey, go to the shore, nothing. If you live in Jersey, move. If your business is in Jersey, move or sell and leave. That is the only way to deal with these mutts. Vote with your feet and your wallet.

Same goes for New York, City and State. Fuck them.

Funny how 5 years ago “distracted driving” meant you were using your cell phone while driving. Today it is a “catch all” phrase to include anything BUT cell phone use!! They now have a separate cell phone law that carries HUGE penalties. Oh yes and don’t forget “distracted driving” accounted for all the 435 road deaths this year!! It’s all BS and lies……

Sadly selective enforcement has become so common place and speed / red light cameras accepted as natural after all it’s for the children , BULL SHIT ! Except for serious criminal activity and no I don’t mean some teenage kid with a bag of weed drug war same BULL SHIT . Criminalize as much normal behavior as possible and take in the fines after all the retirement benefit package for the bulk of the legal system are counting on it ! The real criminals are the pension fund managers that predicted pie in the sky returns of 7 to 10% and planed accordingly so it’s a desperate act to fund keeping the powers that be afloat and as for you Jane Q & Joe Six Pack pay up so your government workers can retire in their 50’s while you stock shelves at Walmart till you drop yea that’s why the fines drug laws drunk driving stops etc … Funny around the holidays you only see DUI Check Points in mostly Blue Collar areas but not near the “CLUB” wonder why ? Yes I know same BULL SHIT !

Good thing the cops are never distracted by the computers, radios, donuts etc. they have with them.

I rarely see a cop even use a turn signal now, just like the other jackasses who can’t be bothered.
