Illinois Town Bypasses Constitution, US Citizens Given 60 Days To Turn In Guns Or Become Criminals

Residents of a town in Illinois were just handed down an unconstitutional decree from their local government, they now have 60 days to give up their guns or be fined up to $1000 per day…

As the state promises gun rights activists they’re not coming for their guns, behind the scenes they’re pleading for it to happen. And now the feared gun grab is occurring. Residents in Deerfield, Illinois have 60 days to surrender their “assault weapons” or face fines of $1000 per day per gun.

The gun ban ordinance was passed on April 2nd with residents left with few choices of how to dispose of their valuable “assault weapons.” Upon careful reading of the ordinance, residents will be left with revolvers, .22 caliber “plinking” rifles, and double barrel shotguns to defend their homes and families from criminals who could care less about the law.

Fines for not disposing of the weapons range from $250 to $1000 per day per gun for those who choose not to comply with the city’s ordinance. While a fine may seem reasonable to some, as TFTP has reported on multiple occasions, failure to pay fines always results in police action. It is not far-fetched to predict major turmoil and arrests in the event of non-compliance.

One example of the so-called “assault weapon” is the Ruger 10/22 which can accept magazines that hold more than 10 rounds. Even though the 10/22 is not listed in the list of guns the village wants to see banned, the gun cannot legally be possessed in the village.

Residents have been instructed to either sell their guns, transfer the ownership to someone who lives outside the village, surrender their guns to Deerfield’s sheriff, or begin paying the fines.

Deerfield mentioned a number of cities where mass shootings took place, including Sutherland Springs, TX where 26 people were killed in the First Baptist Church. That shooting was actually stopped by a man who used the very gun Deerfield voted to ban. No mention was made of that fact in the ordinance.

Also included in the gun ban were semi-automatic pistols which can accept higher than 10 round magazines. That’s virtually all full size semi-automatic pistols.

Even though the village trustees ignored the pleas of residents to leave their guns alone, and passed the ordinance anyway, many residents were encouraged to ignore the gun ban and engage in civil disobedience.

Joel Siegel, a resident of Lincolnwood, warned the village’s residents that governments all across the world have moved to confiscate guns then turned around and ran roughshod over the people. He said,

“There’s an ancient and honored American tradition called disobeying an unjust law…I have urged (people) to listen to their conscience and if so moved do not obey this law.”

Deerfield Mayor Harriet Rosenthal implied the students from the local high school helped sway her decision to bring about the ordinance.

“Enough is enough,” Rosenthal said adding, “Those students are so articulate just like our students. There is no place here for assault weapons.”

The statement mirrors the knee jerk reaction to ban guns following a nationwide public outcry of students who supposedly feared for their own lives following the recent mass shooting in Florida.

Opponents of the gun grab vow to fight the action in court while others praised the trustees decision to ban semiautomatic rifles, pistols and shotguns. Ariella Kharasch, a Deerfield High School senior said she wants more action to be taken on both a local and national level.

“This is our fight…This is our generation’s fight. We’re going to keep fighting and this is part of it. Change happens gradually step by step. The fight does not end at the borders of our village.,” Kharasch said.

Predictably, law enforcement and retired law enforcement members of the community are exempted from the ban. Currently, in the U.S., law enforcement kills around 1,200 citizens per year. Ironically, that number is actually four times higher than those who die from rifles.

As TFTP has reported, cops have killed 450 percent more people than have died in the past forty years of mass shootings.

might be easier to challenge this law under the Takings Clause of the 5th Amendment rather than the 2nd Amendment:

“nor shall private property be taken for public use, without just compensation”

I am sure Kelo can be tweaked to “constitutionally justify” this grab. Legal challenges are a waste of time anyway. The system is irretrievably corrupt.

Not a good approach. In order to file suit, you have to show damages, which is to say you have to be fined. By assessing the fines on a daily basis, you end up racking up millions of dollars in fines while the judicial process plays out and they will file liens on your accounts and property to rob you of funds to pay legal expenses. The Sacketts had to take their case all the way to SCOTUS just so they could file suit against the EPA against a similarly structured law.

The best response is to shoot the officers they send to evict you from your liened home (they’ll never say they’re there for your guns) and then mount a Constitutional defense in your criminal trial. While that sucks for the police, they have a duty not to enforce unconstitutional laws.

This law is so blatantly in violation of ‘Heller’ that it will be overturned….I expect the Illinois Rifle Association to file suit…

It appears that this ordinance also violates State law, which preempts local municipalities from legislating on guns and ammo..

I imagine this will end up being overturned by the Court in light of a few recent decisions, the laws they like to claim make it a legitimate law were from before those decisions.

This is a test to see if they can get away with it without suffering blowback.
Expect that this will be challenged. It should be, by NRA, or some large backers for a legal battle.

If this holds up, and owners fear fines, get creative.
Draw up a bill of sale, to a relative or friend in another jurisdiction.
Have an unwritten gentlemen’s agreement with an option to buy back, or
retake possession at some later date, after the coming legal battle is resolved.

Or, sell it to a gun shop in another jurisdiction and see if it can be held in reserve for potential buy back.
Owners of nearby gun shops where those are still allowed could fill a need, if they get creative, too.
Temporary storage possible? Just tossin’ out ideas here. Might not be feasible or legally possible.

-> Move out of Deerfield. Too close to the ghetto, where the gangs surely won’t turn in their pistols.

Move out of the State of Illinois. It is heading toward insolvency.
Taxes, licenses, fees and fines will only march higher, as the situation erodes.

If all else fails, or remaining in Deerfield is the only option, then turn ’em in, and obey.

When they ask you for the ammo for it, too, then bleat out your Yeah-ah-ah-ahs, Sir.

Expect too, a FF or a confrontation of some kind, so the banning advocates can say: “See?”

If you aren’t in a universal background State, just say you sold it to “some guy” at a garage sale.

The burden of proof is on them to prove you didn’t if they don’t know where you have it and having bought one in the past isn’t enough to get a warrant to do a search for one if you keep it out of sight.

If you’re in a universal background State, you have to pursue a different course since there would have to be a background check record or it would be assumed you either sold it illegally or still have it.

Google search says Deerfield is 94% white . The Mayor last name sounds Jewish. If this is correct it explains this unconstitutional decision .Jews want white people disarmed more then any other group.

Let’s see what happens with the proposed “bump-fire” stock regulation.
The ATF is about to outlaw certain accessories, claiming it is a “machinegun” and “accelerates” the rate of fire. It’s incoherent legislation (by rule making) which could potentially make semi-auto’s illegal and calls for all such devices to be destroyed or turned in… nationwide.
Let’s see what level of compliance that gets.

and just how will they know who has one of these supposedly illegal weapons? Oh right, its because only the LAW ABIDING citizen complied with the legal registration requirements when they purchased the weapon. What I’m waiting for is the day the worthless LEO’s go into javontaetown and do a house to house search for unregistered weapons, yeah like that’s gonna happen! I feel that law enforcement will be making lots of enemies rather than allies against the day that will come when they need allies, and would hope sincerely that some sheriffs refuse to comply with this order and that all policemen in that town resign en masse, then let the town council wonder who is going to protect them now.

Deerfield will be an interesting case study when Barney Fife shows up with the homeland security Intercontinental Ballistic Winniebago Crisis Command Center . That’s when we will find out if our police force support the citizens or are they badge wearing minions that are enemies of the people ??

i just heard on the radio that an arrest has been made in a road rage killing that occurred wed am here in tampa–
a late 50s guy put a lugee out of his truck window–unfortunately for him it hit a younger guy’s bmw–next light,the older guy was dragged out of his truck & beaten to death by the bmw driver–
do you think the older guy could have used a gun?

A video is making the rounds today of a Greensboro resident giving what could be considered one of the most eloquent, and passionate defenses of an individual’s right to bear arms in quite some time.

Mark Robinson, a self described law abiding citizen, made an appearance at the Greensboro City Council Meeting on April 3rd, 2018 to make his voice heard. Robinson speaks for over 4 minutes touching on a variety of topics, including which citizens will turn in their guns should a ban occur, as well as the merits of calling an AR-15 an “assault weapon.”

Robinson’s best line however was the following:

“The law abiding citizens of this community, we are the first ones taxed, the last ones considered, and the first ones punished when things like this happen.”

These issues cannot be resolved in the administrative courts because administrative law does not recognize constitutional law; nor the rights of people.

We are talking about apples and oranges.Constitutional law and administrative law. Constitutional law serves the people while administrative law serves the government and those that participate in governing the people.

Notice that the city counsels and the mayor of a large town or cities do not represent the majority of it’s citizens. They don’t even know most of the people they are elected to represent.

What gives them power over the people of their community is the dumb law enforcement that listen to them.

Unfortunately as these unconstitutional ordinances continue to deprive people of their natural rights under the color of administrative law with a totally dumb law enforcement naive of constitutional safeguards it is going to cause blowback that will lead to rebellion. And rightfully so.

The majority of our city counsel members and mayors are communists. But worse than that they are in their positions to satisfy self interests and their friends. Not all of them but most of them. And the sad part is these councilmen and women don’t even know they are communists. They are ignorant of history including natural & moral philosophy. They are ignorant of the constitution but are well versed in administrative law; a law with no moral foundation. And this suits these mayors and councilmen well because they demonstrate no conscience at all.

Our communities are to big and too diversified for a councilman to know everyone he or she represents. But do you see them going through the community trying to meet everyone? No.

Our communities are too large for the type of political system we now have. This system needs a huge overhaul. It attracts the wrong people to represent us. The vision of our current leaders is a communist vision. And this has led to the inability to solve society’s many problems caused by them. We should be well aware of this system collapsing under the former Soviet Union but our uninformed citizens are totally unaware of this. We are sliding down the same path as the former Soviet Union. How naive we are because of our ignorance.

What is going to happen is the responsible people out of necessity will have to act. Remember the declaration of independence? Rights are not guaranteed by a constitution; only stated. Rights have to be fought for and maintained by force just like amoral administrative laws have to be maintained by force.

We have many cowards in our society. Unfortunately the majority of cowards reside in the professional class because they value money over rights. Perhaps when the economy finally tanks and they loose everything they will undergo a change in mind and join the crusade for a change in government. A government that truly serves the people.

Natural law has no respect for people. Those who ignore natural law will pay the price severely.

Can we not make the case that DELIBERATELY trying to pass and enforce an UNCONSTITUTIONAL LAW (not just by interpretation, blatantly unconstitutional on the face of it) is just cause for dismissal from office, forfeiture of all assets and confinement in Federal prison for perpetuity?
