Government Outlaws Freelance Work

Freelance jobs are “feudalism,” says California Assemblywoman Lorena Gonzalez.

She persuaded California’s legislature to pass a new law reclassifying freelance workers as employees. That means many people who hire them must now give them benefits like overtime, unemployment insurance, etc. Politicians said it would help freelancers a lot.

Of course, much of the media agreed. Vox called it “a victory for workers everywhere”!

Sigh. Young reporters just don’t understand that stifling economic freedom always creates nasty side effects.

Actually, more understand now, because they got a very personal lesson. Once the bill passed, Vox media cut hundreds of freelance writing jobs.

When Gonzalez was asked if she felt bad about that, she sneered, those weren’t “real jobs.”

The arrogance of politicians! People choose jobs. Freelancers like flexibility. Politicians have no right to say certain jobs aren’t good enough.

“You’re thinking you’re helping us, but you’re not,” says musician Ari Herstand in my new video. He says the anti gig-work law could “crash the California music economy.”

Why? Before the law passed, if he played a gig where he’d hire a drummer, bassist and guitar player, “I just cut (each) a check for $200. Now, I have to take that drummer, put him on payroll, W2 him, get workers’ comp insurance, unemployment insurance. I have to pay payroll taxes. I also have to now hire a payroll company.”

All to hire musicians for one just night. The paperwork alone might cost more than the music.

The anti-gig-work law originally targeted rideshare companies like Uber and Lyft, because unions claimed the companies abuse drivers.

But now many rideshare drivers are upset because the law takes away their freedom.

“I liked being independent!” said one. “I don’t want a boss to tell me when or where to drive.”

Herstand says Uber and Lyft drivers would often tell him: “I’m a photographer and this is my fourth side gig. I want to do this when I want to do this, and if now I’m an employee, and I’m W2’d, they’re going to dictate my hours. I don’t want that. (The law is) preventing us from doing what we want to do.”

The law upset independent truck drivers, too. After some nosily drove big rigs in front of the legislature, they got an exemption from the law. Other politically connected professions, like lawyers and realtors, got exemptions as well.

Now Herstand’s working on getting an exemption for musicians, too.

“Why is that good law?” I asked him. “An exception for whoever is clever enough to get to the politicians?”

“It’s definitely not the solution,” laughed Herstand. “‘Write us out of this law and help us out? Here’s money for your next campaign.’ No, that doesn’t seem like that’s a way to legislate.”

But that’s how it’s often done. The more rules politicians pass, the more money they extract from people who are regulated.

Now other politicians want to copy California’s law. New York, New Jersey and Illinois have their own versions of gig economy bills. The House of Representatives wants to nationalize the law. And, this week, Democratic front-runner Joe Biden cluelessly said such a law “will give workers the dignity they deserve.”

Democrats do what unions ask them to do. Politico points out that just a few years ago, New York Governor Andrew Cuomo called gig work “a great service for people, giving people jobs. I don’t think government should be in the business of trying to restrict job growth.” He even joked that Uber drivers might earn more than he does.

But now he wants to outlaw most gig work and calls it “exploitive, abusive!”

It’s no surprise that Gonzalez’s biggest political donors are unions. She talks a lot about “protecting our union jobs.” But now that her bill is killing jobs, she wouldn’t agree to an interview.

Neither would the California unions, or any of 75 law professors, political scientists, sociologists, etc., who published a letter in support of the law.

Yes, we contacted all 75.

Herstand says that’s because the law now embarrasses its supporters, but politicians won’t repeal it because “no politician ever wants to admit they did something wrong.”

I think people should stake out the politicos homes and when JosA and JosB come to mow the lawn demand the homeowner produce all the documents to prove they are in compliance. If not, a citizen’s arrest on the spot.

This type of law passes for two reasons:

1) Unions want to drive out competition and the unions are willing to pay off lawmakers to get this done.
2) Government wants everyone to work for big organizations so it is easier to collect all the taxes that go with any worker.

Therefore, expect more and more of these laws until the only people working independently are doing it on the black market.

It never fails to amaze me how liberals lie through their teeth and twist the meaning of words. Perhaps Ms. Gonzalez should take a History course and discover that feudalism is life under a tyrannical all powerful master. Kind of like the State of California who dictates to people what they must do. Freedom and liberty are derived from the government staying the hell out of peoples lives and providing a few basic services.
Liberalism is communism, and communism is feudalism. Freedom and prosperity can never be derived from communism and feudalism, so Ms Gonzalez needs to stop lying and admit it is the State which has turned the people of CA into serfs, not the employers who provide people an opportunity to earn.

As usual, Stossel has his head up his ass. In capitalism, the rewards should go to those who take the risks. In the feudal system he quaintly calls the gig economy, the workers take all the risks and the assholes who own the website take all the money. Fuck you Stossel. You’ve never met an oligarch yet who’s dick you didn’t like to taste.

True, except the web site owners aren’t making money either.
Uber, Lyft, all of the food delivery companies, etc etc are all losing money hand over fist.

Government keeps trying to pigeon hole gig jobs into one of their two outdated employment categories. The fact is, they are neither 1099 nor W-2 jobs, they are hybrid. Gig workers get slammed because the client orders them about as an employee, while the government reams them in taxes and fails enforce any protections, as a contractor. It’s clear that a new category should be made for gig jobs. However, government has proven it is anathema to change and always operating about 30 years behind the times.

Gig workers biggest concerns are:
— Lack of security. While many employers can fire someone at will, it’s not in their interest to do so. However, replacing a gig worker costs nothing in terms of recruiting/training. As a result, many gig workers are simply “ghosted” by their employees. Not only no reason, but no communication given! You wake up one day and the job is gone; you’ll never find out why.

— Getting crushed on taxes. They are taxed as if they own a brick and mortar business, which can pass on costs to the consumer, when in fact they can’t raise the price of labour because they are largely competing with the Third World for jobs.

— Lack of access to health insurance. The sorry state of health insurance in America affects many, but is compounded for gig workers who have no additional protections if an accident befalls them.

Some simple protections would go a long way to bringing America’s rotten economy into the 21st century. However, that would require government to actually think critically about the problem, instead of just jamming gig workers into one of the two pre-existing categories. There should be a common-sense income threshold; a session musician working for one day is not the same as a long term freelancer who works from home.

Uber and Lyft are their own thing, they are billion dollar businesses that control everything their employees do, except they believe having flexible scheduling gives them a loophole to provide zero support or benefits. After taxes and depreciation, their drivers make around $5 an hour. They should be reamed over the coals and really do not fall into common sense discussion about freelance regulation.

Using Uber talking points is the stupidest thing imaginable.
They’ve been caught lying so many times, it isn’t even funny. “Make $80K a year driving for Uber” was the most egregious.
Equally, the notion that you have flexibility when attempting to make a living driving Uber – also bullshit. You can be flexible only if you want to starve.

Gov. Screwsome is a danger to humanity and a pure idiot if ever I saw one. I am sure that he embraces this nonsense. Remember CA is poorly managed and deeply in debt. They tax everything even the air. A strange myth has come to the fore that Government was meant to help people and god help they are doing their best. The road to hell is paved with good intentions. I wish CA would secede from the Union. No tears here.

My struggling band just got it’s big break. We can all stay alive and make money now that we booked this show at the greatest beach bar in California.
Oh…. wait.. the bar now can’t afford to hire us because they didn’t buy health insurance and provide vacation time for the band they just employed for 3 hours….

The irony, freely exchanging services for compensation = feudalism…. taxation without representation, ie slavery is much better, for the State.
Secondly employers can 1099 you, work around that. Talk to the Feds shit bags.
Lastly when you have to compete against illegal third world labor, you will do what you must in order to eat, working for a cartel is looking like a option vs the tyranny of the State’s edicts. Black market economy becomes viable, risk vs reward.
