Stucky QOTD: F**K SELECT PORTFOLIO SERVICING!!!!!!!!!

We sold our house for $425,000.

The original mortgage …. FIFTEEN YEARS AGO was for exactly that amount …. $425,000.

Ms. Freud often makes a bigger payment than needed … to be applied to principle.  Therefore, I estimated that our mortgage balance would be about $325,000 – $350,000.

We just yesterday got our Mortgage Payoff Statement from Select Portfolio Servicing. It is $430,000!!!  We’re underwater??!!  After fifteen fucking years of payments the balance INCREASED by $5,000??????

It’s much worse than just a $5k deficiency.  SPS is claiming we haven’t paid the mortgage in nine months!  This is a bold faced motherfucking lie!!  Soooo …. we supposedly need to bring $38,000 dollars to the closing table.  #OverMyDeadBody

We just ordered a complete mortgage payment history from the bank.

I also called SPS. I told them I want a complete mortgage payment history starting from Day 1 when they took over the loan up until today … including payment amount, amount applied to principle, an ending balance for each and every month.  I will reconcile the two sources.

My attorney advised me to tell them that if I suspect fraud that I will file a complaint with the Consumer Financial Protection Bureau …. because the banks are afraid of these people. So, I told them.

We met with our new landlord on Saturday. They made us dinner. We are still moving in, come hell or high water on March 1st.

So, I told SPS that either they resolve this quickly because by March 1st one of two things WILL happen. 

— 1)  We will receive cash at closing because of the equity we have in the house … and our buyers will be living here. 

— 2)  The house will be completely empty. We will leave the house keys on the table and they can enjoy the property. Not kidding.

What a bunch of low life thieving lying motherfuckers!! 

Q: Anyone else have similar dealings with them?

Sorry to say this Stucky, but the banks are afraid of NOONE. These “servicers” are nothing but front companies for the TBTF banking syndicate. The law has not, and will not ever be enforced on this scum. Visit what happened with the FAS 157 change that congress made during the housing crisis of 2008 – 09. The accounting would have caused the banks to be insolvent, and have to negotiate with homeowners on principal. Can’t have that, much better to CHANGE THE F’ing accounting standards than to have to deal honestly with homeowners. Also, see OCWEN financial. What a “den of vipers”, to quote Jackson. Don’t even get me started on the whole MERS title problems.
The CSFB, created by Pocahontas Warren, is a joke. It is there to make you THINK that you have an advocate. Please. They will waste your time with paperwork, “resolution managers”, “investigations” and then some pansy might call you from the bank in 6 months, offering a compromise of owing just $15000.00, but you will still have the bad mark on your credit, and need to sign a promissory note for the 15k.
My advice, after owning some rental properties in the past, and dealing heavily with these asshats when my “servicing” was sold to Ocwen and Americas Servicing Company – AKA Wells Fargo, is that your credit rating is NOT worth $38000.00. Neither are the attorney fees against an adversary that can print money. Take the same policy as the US Government – Don’t negotiate with financial terrorists. Period. If ANY of the servicers I dealt with had said this to me, my next sentence would be exactly what yours was to them – get the F’ing keys off the counter, and HOPE that the vagrants don’t move in first. The credit mark will last 3 years, and then you are back in the clear.

If you walk away underwater, the bank then gives you a 1099 for “Debt Forgiven” (unless you declare bankruptcy)

Now you have the IRS to deal with, rather than the bank. Tax plus the social security portion as well. All added to your current income in this calendar year. All bumping you into a new higher tax bracket too.

There was an exemption earlier for the crisis that helped you avoid such tax issues for short sales.
I believe that perk has since expired. However many states are what’s called, “Non recourse” Meaning the bank cannot sue you for bailing. Their only security for the mortgage is the house proceeds. Even if you’re underwater when you bail, they cannot sue you for the underwater amount. They can only foreclose & use whatever proceeds they get and live with those numbers.

If I was gonna bail on a house with no equity, along with all the associated legal & credit hassles, I’d rather live there rent free, for a couple years before they can kick you out. One can save alot of money living rent free for a while.

No they are afraid of the gov overseeing. I filed my complaints in Oct.
I uploaded all my letter between Chase the mortgage I had to SPS comp that would take over July 1 2017. I had pd Chase in June but payment was lost for 90 days. SPS has added 12,000.00 more to the loan and are talking late fees and interest from original $85,000.00 payoff. SPS should be shut down but they will come back w diff name. CHASE is writhing letter today with the payoff, apparently I was $1049.17 short when I pd even thought it came from escrow and I paid inside Chase. It’s been a nightmare and SPS is still problems, they took original $85,000.00 ck even though I had pd Chase in correct time, they took 18,000.00 from money, his 70,000.00 in unapplied area and raised my fees late and interest plus I’m billed for foreclosure paperwork and them to send people to house for foreclosure.
I will fund out today if Chase can straighten it out, they lost the payoff check for 90 days and returned me the money but SPS is adding all this to take our custom home.
There are some class action law suits I am trying to join. God help us because SPS is a scam company .

Stuck: I see this all the time in my business. And they are certainly lying because after 90 days of no mortgage payments they would have started, or at the very least, sent collection notices to you, phone calls, etc.
I would assume you have proof of payments in the form of cancelled checks or withdrawals from your bank going to them? If so, then that is sufficient to prove payment.
If they cannot find the money that is not your problem, but theirs.
I see a hefty lawsuit coming their way, because if they cause your sale to fall through due to their book keeping negligence then they would be on the hook for the lost sale and fiduciary damages they have caused you.
It’s very simple: Proof of payments + payments withdrawn= payments made. End of story.
Have your lawyer send them a certified letter along with copies of all your payments made and withdrawals or cancelled checks and demand they be applied correctly with the interest that accrued on the incorrect amount be removed ASAP or you will see them in court.
The local judges take a dim view of this kind of shenanigans. A call into your local TV station may be sufficient to light a fire under the right people at SPS as well.

a 30 yr note is bad never too late, please read and learn about loans and how it is paid. some loans you can’t apply to paying off early for a number of yrs. if you buy another house get a lawyer. never go over 15yrs.

Stuckey, I bought 5 acres in Monticello Fl and financed it locally for about 8%. For years I paid double the mortgage payment and when I was ready to pay it off, I called the bank for the payoff. Their number was thousands off and I explained I was a math major and the payoff is just a few dollars bla bla. He kept calmly telling me I was wrong bla bla. Finally it came out that my money over the due amount was put into a savings account at about 2%; the banksters call it “Front Loading”. I never got screwed again because I go over the way payments are posted before signing and I never miss an opportunity to advertise that Capital City Bank of Monticello Fl is as crooked as a Clinton.

Get everything in writing, absolutely everything.

Verbal agreements, conversations, information or promises mean absolutely nothing to a Court unless you can validate them, which is almost impossible.

Hindsight is always 20/20 so this isn’t a question as much as advice for anyone else selling: Get everything stated and qualified by your mortgage holder before selling, don’t assume anything no matter how clear it would seem to be.

BTW, walking away usually leaves you responsible for difference between whatever the house gets sold for by the bank at auction and what is still owed on the mortgage. People go bankrupt all the time over stuff like this.

My wife bought a truck before we got married and when I paid it off I expected to see the title arrive in the mail. Silly me! I was too young to realize that they had to run me through the scam machine first. Initially they claimed we missed all sorts of payments and accrued fees. This was bs and I sorted that out over the phone. They next claimed that we failed to carry insurance for several different periods and we’d have to pay that. I asked which dates and mailed them copies of all insurance documents for the entire loan period. I’m anal about keeping paperwork. 🙂 A couple of weeks later the title showed up in the mail.

I’ve always wondered how many poor saps fall for that bullshit? Send them proof of payment by certified mail and you should be good to go. For everyone else…….read your monthly statements as if your life depended on it and request a payoff amount every year or two and read that over closely.

Not sure how the miscalculation can happen.
We’ve been making the extra payments in order to get to 50K at the end of this year. Then I am going to pay the 50K and be done with it. I’ve been following the payment schedule on line. It matches up pretty well with a mortgage pay off spreadsheet that I used seperately to insure the mortgage company/bank was accurate.

Lessons learned here all around. YOU must have access to ALL you spouses financial record past and present. Bi-Weekly pay stub, 401k, etc. You not only share the your bodily fluids, but all your money.

From the good side, I noted an old roll over IRA that my wife had been sitting on for years. Had 24K just sitting getting sh__ in interest….

Agree in principle, but in practicality, you are still paying for it, indirectly. As I said above, I owned several rental properties, and all the costs of ownership I passed on to the tenants. Admittedly, it was a different world back then (mid 1990’s – early 2000’s) and tenants / landlords were different, however, unless the landlord is a complete idiot (not beyond the pale nowadays) the costs plus a profit margin of renting in the long run are far more than owning, in my humble opinion.
That being said, today is a different world. Sheeple buy homes to “rent” because they can get a loan, and think that housing appreciation will make up for their upside down mortgage because Terik and the blonde bimbo on HGTV said so. They think that “owning” (on credit of course) a brand new car every 5 years is a status symbol, and that a wallet full of department store cards is actually #winning.
The way to own is, to paraphrase old man Rockefeller – Own nothing, control everything. There are ways to “own” that will keep you anonymous and allow even very high net worth individuals to mix in with the world in a way that the parasites can’t extract their pound of flesh from you. The “owning” part though keeps you from being the unfortunate victim of someone else’s bad decision. Example, in 2008, a lot of the sheeple landlords bit off more than they could chew, and some unfortunate families found out one day, through a note on the door, that their landlord had not paid the mortgage with their rent money for months. Now they had to find a new place to live, in 30 days. Not owning is depending on the “owner” to be responsible, because you are on his train, and have to hope that he is not jumping out of the cab before you, and the train go over the bridge. Not my brand of security. Just bringing this up as the “counterparty risk” of the not owning trade.

I am minor league compared to the $$$ in play, but for the past 17 years I track the payments we’ve made versus our year end statement from the mortgage company. Only screw job was the refinance year when suddenly after 12 months of payments the principal increased. There must be a whole different payroll cycle on the east coast versus us shack dwelling mid-western types.

The first time I paid a larger payment then the normal monthly mortgage payment with the intent that the extra be applied to the principle, I of course was anxious to see my next monthly statement to see the large drop in principle. When the statement arrived I was shocked to see the principle had only gone down the small amount constant with having only paid the normal monthly payment. Where the fuck did that extra money go? I called the bank and what I learned was they assumed I had sent in the extra payment as though I was going on vacation for over a month and so they were simply holding it to apply it to the next month’s payment. I told them NO, that extra was to be applied to the principle. They told me that any over payment that I sent with the intent to be applied to the principle needs to be clearly noted when that payment is sent in. So what I did from then on was when I sent extra to be applied to the principle I sent two checks, one which was the normal monthly payment and a second check that was the extra principle payment and I always included a note stating CK1 #xxxx was the mortgage payment for that month and CK2 #xxxx was a principle pre-payment.

I never had a problem after that and every month I watched the principle rapidly decline.

You will love it. You won’t believe how much money we have stashed by not owning things, and not paying taxes and insurance on the things we don’t own. I will say that in the 14 years time since we stopped owning stuff, we have lived very nicely and ratholed a shitload of funds. Liquidity.

Our poor mortgaged-to-the ears landlord is currently spending a bundle re-siding the building. He also got clipped when our hot water heater rusted out out in September and flooded the apartment (we got a new hot water heater and new carpeting, free of charge). It won’t be long before his building needs a new roof too.

He’s raised our rent less than $200 a month in the nearly 10 years we’ve lived here, in one of the most expensive cities on the west coast. We always pay the rent on time and keep the sidewalk swept. He’s eating a ton of costs, and we’re sweeping the sidewalk. If he jacks up the rent (he won’t) we’ll just move to another rental where the owner is the serf of local tax extractor and government whimsy.

In America you really never ‘own’ anything. They have a hundred ways to take it away from you.

We just came back from a second trip to south America where we were thinking to retire (we’re not). Property and wage ownership down there in a tin-pot socialist country are more protected than in the US. The citizens can actually own stuff down there and it’s legally very hard for the government to steal it from them.

Tough times are in the wind. I think it’s best right now to be free of constrictions and ready to move if the need arises, with some pesos in your pocket for necessities.

haha. Before we got married my wife bought a new hyundai excel in the second year they sold them in the US. And, cuz of here earlier bankruptcy, she got hosed on a 5 YEAR loan. At the end of the 5 years, she could have bought a used BMW with what she paid on that loan AND all the money lost on the service for that POS.

Stucky, how touching! This is a traditional TBP welcome. Not the recent namby-pamby kid gloves treatment. I recall Sensetti talking about his walk through the fire. I won’t forget LLPOH circling, gathering ammo and like a good chess player, telling me what he was going to do. First, he said, he needed to assemble a psychological profile, maybe to see if I was going to survive the initiation. It was tough, he and KB began playing with my mind. I almost got to the point every man gets to while working on a car or hanging off a cliff with one hand; they begin to wonder, why was I born?

If you’ve never been in a firefight with LLPOH, you have missed out. I’d almost say you haven’t lived. He cases you like a rabid dog, smelling out the weak underbelly of your psyche. He doesn’t fight fair but he doesn’t kill you immediately, he first has to inflict a hundred cuts with his slashing teeth, bastard. Somewhere along the line, you begin to like him, even look forward to him killing you with mercy. Dying is such sweet sorrow at the hands of LLPOH.

Matter of fact, I almost gave up. Then I remembered that admin had welcomed me here. I recalled an asshole kid in grade school who harassed me on my first day at the new school, he wanted to see my passport. I ran home and asked my mom for my passport and she smiled and said, you don’t have one, you were born here. Shit!

So here I was again in the same damn situation and I had to man up or go down swinging.

When I lived in the barracks there were two guys, one named Hatfield, the other McCoy- no joke- and they were best friends but when the week was over they would go back to their room and begin to drink in earnest. Cards games were always going on, fist fights, guys pissing into open lockers, screaming out the windows, music blaring, laughter and howls of pain. You had to knock to gain admittance to the game and the booze but otherwise the door was always shut and the sound was always full volume from 5:01 on Friday until whenever they passed out-

This thread reminds me of that room.

And I’m glad we paid off the farm even if I can’t afford to drink like Llpoh.

Another option for your consideration:

In 2010 the MERS issue hit my desk. I sent a registered mail to the mortgage holder asking for clear title information. They responded by claiming I had no standing to ask such questions. So I stopped paying the mortgage. Lived there another 22 months before I voluntarily left the keys on the counter and drove away. Lived there for free those 22 months, didn’t even bother to pay the insurance but somebody did because eventually they sent me a refund. Gee, I wonder who could have been paying the insurance all that time? Don’t know about your state but in Colorado in 2014 the average time before a foreclosure notice was sent was 22 months. So I planned accordingly. The only liability they could stick me with was taxes due on what the federal tax thieves claim was income because I did not pay the mortgage. They sold the house to somebody else for exactly the balance of my note, of course the poor sucker then had to do the $10k of deferred maintenance. If you realize that the mortgage you have been paying for 28 years has left you with no equity and no clear property title then maybe the idea of living in their property for free for awhile will appeal to you.

You just fixed the place up to be nice enough to sell, why not just live there until they do evict you? You may just out live their ability to collect, especially if they do not hold clear title. And what is the downside, a ruined credit rating, ha ha ha, sorry but that really has no value anyway in my opinion.

Just my opinion but I think deplorably Stanley offered the best advice.

Sorry to hear about your difficulties, Stuck, but not surprised. I bought one house and one property (neither in the USA) for cash and was told as a lad by my banker grand-dad to NEVER take out a mortgage, given that he was in that biz as a George Potter type figure, but eventually sold out to the thieves for a healthy profit. I realize that in the good ol’ USA very few can escape that trap if they want to “own” a house and/or property, but your (bueno, your companion’s) unfortunate experience is a tragic example of what the bankster scum do all the time to folks less prepared to deal with it than are you. I wish you luck in getting what’s rightfully yours.

As a first time home buyer combined with my trust no one attitude. I chose a local bank for our mortgage for the single purpose that they continue to service the loan for the life of the loan. This means every month I go to the bank (by choice, I never opt for auto pay) I physically hand them the payment and in return I get a receipt. If I pay extra to add to the principle, I have a receipt to prove it. I save every receipt by month by year. Each receipt shows the balance of the loan. It’s not to say that I couldn’t end up in a similar situation, but at least I could go home and grab every gawd damn bank receipt to dump on someones desk.

Check every penny that has ever been disbursed from your escrow.Many banks keep paying both companies when you change insurance companies.Many also force place insurance when you change companies but neglect to refund your premium when they realize that it was a mistake.

Taxes-I believe most states require banks to pay property taxes when the property owner is eligible for the largest discount,not all banks do so unless prodded.

Extra payments-unless told differently,most banks will put extra payments into your escrow.
Check every deposit/disbursement going in/out of escrow as far back as you can.

When folks I have always respected like Mike come out and suggest things like reservations and treaties should be cancelled because of the debt, I think TBP may well have jumped the shark. And those ideas get a lot of support. As you said, I care little for thumb action, either way, but I do note what comments get support. And some of it is very disturbing.

I see more and more self-promotion going on. It annoys hell out of me (Buy my book!).

It is not TBP as I remember it. I will continue forward, at least for now, but what I am seeing does not make me happy. If I disappear for a while, please understand. It will be disgust with posters, and naught to do with Admin, you, or the old timers.

I approached success from the other direction. In doing so, I have been screwed twice with houses. I told you about the time a realtor sold my house for ten dollars American and charged me $2400 commission. The second house I lost to foreclosure. (Ex kicked me out of the house, let the payments lapse and let me have it back when she moved out, just before the sheriff notice.)

The bank sent, as a matter of routine, a hired crew to remove the fairly new carpet and major appliances. They figure houses will be improved by removing these items which are moldy and dirty. They strip the house in preparation for sale. Some asshole buys it dirt cheap.

Shit – it pisses me off to recall the story of a woman who had been renting a house. Her landlord let the house go into foreclosure. She quit paying rent for a couple of years and the bank paid her to stay in the house. She used her saved-up rent to buy the house on the cheap.
